Abstract

Salah satu fenomena penting yang muncul di dunia muslim sejak awal abad ke-20 adalah adanya upaya pembaharuan hukum keluarga di negara-negara berpenduduk mayoritas muslim baik dengan metode intra doctrinal reform maupun extra doctrinal reform. Adapun tujuan pembaharuan hukum keluarga di antaranya ialah untuk unifikasi hukum, tuntutan peningkatan status wanita dan merespon perkembangan masyarakat yang selalu bergerak dinamis. Dapat dikatakan bahwa tujuan kedua ini merupakan tujuan dari reformasi Undang-Undang Perkawinan di mayoritas negara-negara muslim, meskipun tidak menutup kemungkinan di beberapa negara mencakup beberapa tujuan sekaligus. Dengan menggunakan metode descriptive comparative, penelitian ini membahas tentang materi-materi pembaharuan hukum keluarga dan faktor-faktor yang melatarbelakangi terjadinya pembaharuan hukum keluarga di negara Tunisia dan Indonesia. Hasil dari penelitian menunjukkan bahwa adanya pembaharuan hukum keluarga di Tunisia tidak lepas dipengaruhi oleh dua faktor, yaitu faktor eksternal: pengaruh Prancis dalam usaha sekularisasi dan pengaruh Habib Bourguiba yang berhasrat menjadikan Tunisia sebagai negara sekuler dan faktor internal: adanya reinterpretasi nash Al-Qur?an dan peningkatan status wanita di Tunisia. Sedangkan pembaharuan hukum keluarga di Indonesia dilatarbelakangi oleh adanya heterogenitas masyarakat dan usaha unifikasi hukum.One important phenomenon that has emerged in the Muslim world since the beginning of the 20th century is the effort to reform family law in Muslim-majority countries with both intra-doctrinal reform and extra doctrinal reform methods. Some of the objectives of the renewal of family law are to unify the law, to legalize women?s equal rights, and to respond to the dynamic development of a society. It is well known that the legalization of women?s equal rights is mostly becomes the main goal in reforming the Marriage Law in the majority of Muslim countries, although some countries may also put other goals at once. Using descriptive-comparative methods, this study attempts to discuss the renewal material of family law and the factors that underlie the renewal in Indonesia and Tunisia. The results of the study show that the renewal of family law in Tunisia is inseparably influenced by two factors; namely external factors: the influence of France in their secularization efforts as well as the influence of Habib Bourguiba, who desires to make Tunisia as a secular state; and the internal factors: the reinterpretation of the Qur'anic text and some efforts done in Tunisia to improve the women?s status. On the other hand, the renewal of family law in Indonesia is motivated by the heterogeneity of the community and the effort of law unification.

Abstract

Abstract:Waqf is still interesting to do a study. Apart from being a form of worship to Allah SWT, waqf is also an instrument of welfare for Muslims. The object of waqf continues to expand. One model of the object of waqf in Muslim countries is the company akaf. This study aims to describe the management and ways of developing corporate waqf in Malaysia and Singapore. This governance is then used as material for the development of corporate waqf in Indonesia. This article is the result of a doctrinal law research with a comparative approach. The results of this study indicate that the company-based waqf concept in Indonesia needs to be developed transformatively. As practice in Malaysia and Singapore. So that it can be an instrument in improving the welfare of the people in a sustainable manner. The formulation of a corporate waqf legal development model in Indonesia needs to be adjusted and strengthened. Regulators as well as an integrative and holistic understanding of the ulama. So that company waqf can be a strategic alternative in an effort to accelerate national economic development.Keywords: waqf, south east Asia, welfare.Abstrak:Wakaf masih menarik untuk dilakukan kajian. Selain merupakan bentuk ibadah kepada Allah SWT, wakaf juga merupakan instumen kesejahteraan bagi umat Islam. Objek wakaf terus mengalami perluasan. Salah satu model objek wakaf di negara-negara muslim adalah wakaf perusahaan. Penelitian ini bertujuan untuk mendeksripsikan pengelolaan dan cara pengembangan wakaf perusahaan di Malaysia dan Singapura. Tata kelola ini kemudian dijadikan bahan pengembangan wakaf perusahaan di Indonesia. Artikel ini merupakan hasil penelitian hukum doktrinal dengan pendekatan perbandingan. Hasil kajian ini menunjukkan bahwa konsep wakaf berbasis perusahaan di Indonesia perlu dikembangkan secara transformatif. Sebagaimana praktik di Malaysia dan Singapura. Sehingga dapat menjadi instrumen dalam meningkatkan kesejahteraan umat secara berkelanjutan. Rumusan model pengembangan hukum wakaf perusahaan di Indonesia perlu disesuaikan dan dikuatkan. Pemangku regulasi sekaligus pemahaman yang integratif dan holistik di kalangan ulama. Agar wakaf perusahaan dapat menjadi alternatif strategis dalam upaya percepatan pembangunan ekonomi nasional.Keywords: wakaf; asia tenggara; kesejahteraan.

Abstract

One of the most widely promoted family law reforms in modern Muslim countries is the issue of polygamy. Until now, polygamy is considered as a form of discrimination and marginalization of women, in addition to the conditions for the permissibility of polygamy because the wife's condition is not found explicitly in the texts or opinions of traditional fiqh scholars. This study utilizes a comparative descriptive approach by analyzing the history, legal basis, and views of Madhab scholars regarding polygamy, as well as comparing the application of polygamy regulations in Asian and African countries (Indonesia, Malaysia, Pakistan, Morocco, and Tunisia). The results show that the reasoning behind polygamy regulations set in modern Muslim countries in Asia and Africa seems to be more dominant using the extra-doctrinal reform method. This cannot be separated from the goals of family law reform, the effort to unify law in a heterogeneous society, demands to increase women's status, and respond to community developments. The background factors include the influence of the colonizers, reinterpretation of the texts and madhabs adopted, and other geopolitical factors.

Abstract

Peran teknologi informasi (TI) dalam mendukung akreditasi rumah sakit sangat krusial. Implementasi sistem informasi manajemen rumah sakit (SIMRS) dan perangkat TI lainnya, seperti Personal Digital Assistant (PDA), secara signifikan meningkatkan efisiensi operasional, akurasi data, dan kualitas layanan medis. Studi menunjukkan bahwa integrasi TI dalam rumah sakit tidak hanya membantu dalam pengumpulan, penyimpanan, dan pengelolaan data yang lebih efisien, tetapi juga memastikan keakuratan dan konsistensi informasi yang diperlukan untuk proses akreditasi. Namun, implementasi TI menghadapi berbagai tantangan, termasuk biaya tinggi, resistensi dari pengguna, dan masalah interoperabilitas sistem. Penelitian ini juga menyoroti pentingnya dukungan manajemen dan pelatihan pengguna untuk mengatasi tantangan ini dan memaksimalkan manfaat TI. Dengan perencanaan strategis yang baik dan dukungan yang kuat, rumah sakit dapat memanfaatkan TI untuk meningkatkan kualitas layanan kesehatan dan memastikan kepatuhan terhadap standar akreditasi.

Abstract

Problems related to the misused of waqf assets have been taking their long way since previous decades to this era, as what has happened in Sooko Village, Ponorogo. Of the 31 mosques and prayer rooms that do not yet have a certificate, 11 areas have AIW while the rest of those have not recorded to have a waqf pledge. In addition, the discovery of Nadzir data, which recorded almost all of them have died and the waqf data entered in the Ministry of Religion's web (siwak) only lists the use of objects and addresses globally, which becomes a problem in the management of waqf assets. The method used in this research is Asset Based Community Development (ABCD). The results showed that the majority of waqf conditions in Sooko Village, Ponorogo, were not yet certified, Nadzir's Human Resources also still did not meet the expected standards. Stakeholder efforts in solving waqf problems in Sooko village, Ponorogo, are by organizing nadzir professionalism training in managing waqf assets and mass waqf pledges in Sooko sub-district, Ponorogo.Permasalahan yang berkaitan dengan aset wakaf yang disalahgunakan bukanlah merupakan hal baru, begitu pula yang terjadi di desa Sooko Kabupaten Ponorogo. Dari 31 masjid dan mushola belum memiliki sertifikat (11 bidang sudah AIW selebihnya belum melakukan ikrar wakaf). Selain itu, ditemukannya data Nadzir yang tercatat hampir keseluruhan sudah meninggal dunia serta data wakaf yang diinput dalam siwak web kementerian agama hanya mencantumkan kegunaan objek dan alamat secara global menjadi masalah dalam pengelolaan aset wakaf. Metode yang digunakan dalam penelitian ini adalah Asset Bassed Community Development (ABCD). Hasil penelitian menunjukkan bahwa kondisi wakaf di desa Sooko Kabupaten Ponorogo mayoritas belum tersertifikasi, Sumber Daya Manusia Nadzir juga masih belum memenuhi standar yang diharapkan. Adapun upaya Stakeholder dalam penyelesaian problematika wakaf di desa Sooko Kabupaten Ponorogo ialah dengan menyelenggarakan pelatihan profesionalisme nadzir dalam mengelola asset wakaf serta ikrar wakaf massal se kecamatan Sooko Kabupaten Ponorogo.

Abstract

The status of illegitimate children or children out of wedlock is a complex and sensitive issue that attracts attention in the Indonesian legal system. Although it has been regulated in various regulations and there is a Constitutional Court Decision Number 46/PUU-VIII/2010, implementing the protection of the legal rights of children outside marriage in different judges' decisions still experiences disparities. This article aims to analyze the differences in interpretation related to the status of children outside marriage in the judicial environment in East Java, as well as how to formulate the ideal protection of the group and civil rights of children outside marriage. This research is a non-doctrinal research using conceptual and philosophical approaches. This study found complexities in considering children's best interests in court decisions. Some judges seek to ensure the protection and rights of children born out of wedlock, while others think about social stability and religious norms. The ideal reformulation of the legal status of children born out of wedlock requires a comprehensive dialogue approach and more inclusive legal reforms. Recommendations are also made to strengthen more explicit legal guidelines for judges in dealing with such cases, considering the child's legal, religious, and best interests. This research contributes to efforts to realize ideal legal protection for out-of-wedlock children and anticipate evolving legal problems.

Abstract

Basically this dating application is intended for people who are looking for a mate. So if a married couple becomes a dating application user, it can affect household life in forming a sakinah family. And of course, it can lead to conflicts that will occur in domestic life, which can have consequences on Family Psychology. This study aims to determine the influence and efforts to use dating applications on married couples in forming families sakinah perspective of Islamic Family Psychology. The type of research conducted by the author is qualitative research that uses qualitative methods of netnography. Netnography is a research conducted online, through observation and in-depth interviews using digital media in accordance with the research. The results of this study is the use of dating applications in married couples can have a bad influence on domestic relationships, including: causing a less open attitude that occurs in married couples, silent attitude when knowing their partner becomes a dating application user on the grounds that they do not want to fight with a partner, hindering in forming a sakinah family, and infidelity. Then it can be understood that the effect of using dating applications for married couples according to the Islamic family perspective is to make married couples rarely or even never take the time to discuss domestic life, there is no sense of responsibility between husband and wife to maintain family harmony, and away from religion that can plunge a person into bad deeds. While preventive efforts that can be done on married dating application users include: maintaining communication, maintaining family harmony, being open to each other, having the principle of deliberation, and forgiving each other. It can be understood that the preventive efforts that can be done on the dating application users in accordance with Islamic Family Psychology, namely: maintaining good communication, building a good understanding between married couples, suitability in creating a sense of security and comfort that exists in the domestic environment, and a sense of reciprocity between couples in self-openness.
