Abstract

E-wallet is a digital wallet that is used as a transaction tool in digital form, with the existence of an e-wallet the transaction process is faster and easier in this digitalization era because it only has to scan the QR code. However, behind the efficiency and benefits provided, of course there are risks arising from the use of this e-wallet such as the security of our personal data is threatened. The purpose of this study was to determine law enforcement against cybercrime on e-wallet and protection of personal data on e-wallet. The method used in this research is normative research. Based on the principle of legality of cyber crimes such as data theft has violated the ITE Law, therefore a person's personal data must be protected according to the Regulation of the Minister of Communication and Information and Bank Indonesia. According to Philipus M. Hadjon's theory of legal protection, to overcome legal problems such as data theft on e-wallet, preventive and repressive measures are needed.

Abstract

The current crisis situation, due to the Covid-19 pandemic, has caused the government to enact the Job Creation Law as an effort to advance the economy, in particular, micro and small businesses. The existence of the Job Creation Law expands the concept of a limited liability company with the recognition of a new legal entity, namely an individual company. The existence of an individual company gave birth to a number of contradictions in the basic concept of a limited liability company. This normative juridical research will discuss the regulation of micro and small business criteria based on the Job Creation Law and the limited liability company law as well as legal loopholes and proposed improvements. This study aims to determine the arrangements related to individual companies. The results of the study indicate that the legal basis for individual companies still has legal loopholes so that the government plays an important role in strengthening the regulation.

Abstract

Foreign Investment or commonly referred to as PMA is an investment activity carried out by foreign investors with the aim of being able to expand business or business in a country territory. In this case, the Indonesian government is trying to improve the investment climate in Indonesia by presenting the Job Creation Law. The existence of the Employment Creation Law has created a number of contradictions with the laws and regulations. This normative juridical research will discuss legal certainty for foreign investment in relation to the constitutional work creation law. This study aims to determine the basis and reasons for the formal examination of the Job Creation Act in the Constitutional Court, as well as to determine legal certainty for PMA. The results of the study indicate that legal certainty for PMA is currently a problem, so that the government plays an important role in making policies that do not harm the parties.

Abstract

Looking at the effects of globalization, the amount of expatriates coming to Indonesia and Singapore is constantly increasing. They come as a foreigner to do business and stay within a period of time. The scarcity of land area and certain national interest against land, are factors pushing the development of flats and strata living area (strata title). This type of dwelling is commonly the choice preferred by foreigner to live on. The flat ownership criteria and its rights to serve as a security interest for loan, especially for foreigner who owns it is then the problems arising out of it. This research is carried out to find out the process of owning a flat and its charge as security interest, such as encumbrance right/mortgage, especially by foreigner, both in Indonesia and Singapore. The prerequisite, process, advantages and disadvantages of methods used by the two countries. This research is using the normative juridical method of analyzing the laws of Indonesia and Singapore. Sources of data used are in forms of primary legal materials, secondary legal materials and tertiary legal materials. Data collection technique is done through the method of literature study (library research). After all of the data are collected, the data are processed and analyzed. The qualitative analysis is used with the intentions to classify aspects of data studied. Furthermore, it is then concluded that the research associated with this is then described descriptively. Based on the results of this study and research showed that there are some similarities and differences regarding the process of owning a flat and its charge as security interest, such as encumbrance right/mortgage by foreigner in Indonesia and Singapore. This similarities and differences, especially in the law system implemented by both countries also caused several advantages and disadvantages regarding it.

Abstract

Abstract The nexus between investment and intellectual property often intersects with the international movement of capital. A robust legal structure is essential in comprehending potential issues, particularly concerning copyrights, which is one of the most frequently utilized intellectual property rights systems within the Indonesian economy. Consequently, this study seeks to pinpoint the elements linking these two notions within the framework of copyright regulations. Findings indicate that specific challenges may result in protracted and intricate administrative processes, as revealed through normative legal research methodologies. Concurrently, a thorough analysis employing the statutory approach reveals that these challenges stem from normative constraints, which may deter investors from engaging in the Indonesian economic landscape. Abstrak Hubungan antara investasi dan hak kekayaan intelektual sering kali saling terkait dengan arus modal global. Struktur hukum yang kokoh sangat penting untuk memahami potensi masalah, khususnya terkait hak cipta, yang merupakan salah satu sistem hak kekayaan intelektual yang paling sering digunakan dalam ekonomi Indonesia. Oleh karena itu, penelitian ini bertujuan untuk mengidentifikasi faktor-faktor yang menghubungkan kedua konsep ini dalam konteks regulasi hak cipta. Temuan menunjukkan bahwa tantangan-tantangan tertentu dapat mengakibatkan proses administratif yang panjang dan rumit, sebagaimana terungkap melalui metodologi penelitian hukum normatif. Sementara itu, analisis menyeluruh yang menggunakan pendekatan statutori menunjukkan bahwa tantangan-tantangan ini berasal dari pembatasan-pembatasan normatif, yang dapat menghalangi investor untuk terlibat dalam lanskap ekonomi Indonesia.

Abstract

The accounting profession in the industrial era 4.0 faces significant challenges in maintaining business ethics. In the context of Rural Credit Bank (BPR) Dana Nusantara Tanjungpinang Branch Office, efforts to avoid violations of business ethics are very important. By referring to literature studies and descriptive qualitative interviews, this research method reveals the strategies implemented by BPR Dana Nusantara Tanjungpinang in controlling ethical violations. The research results show that BPR Dana Nusantara Tanjungpinang uses internal audit and data crosscheck as the main strategy to ensure the accuracy of recording financial transactions. In addition, separation of functions and strict supervision of business processes are important steps in maintaining the integrity and honesty of company operations. However, challenges related to employee internet access present obstacles in efforts to prevent ethical violations. However, BPR Dana Nusantara Tanjungpinang continues to strive to use good vendors and implement strict operational procedures. The research results show that BPR Dana Nusantara Tanjungpinang continues to be committed to improving their internal control practices in order to create an ethical business environment and reduce the possibility of ethical violations in the future.

Abstract

Dalam lingkungan bisnis, terdapat berbagai bentuk badan usaha yang dibagi menjadi perusahaan dengan status badan hukum dan non-badan hukum. Perusahaan adalah entitas yang secara konsisten menjalankan kegiatan ekonomi di Indonesia untuk mencapai keuntungan. Dalam konteks hukum, badan hukum adalah badan yang ada karena hukum dan memiliki tanggung jawab hukum yang terpisah dari individu yang terlibat di dalamnya. Tujuan penelitian ini adalah untuk mengetahui prinsip Piercing The Corporate Veil dalam hukum perusahaan dan untuk mengetahui ketentuan serta penerapan doktrin Piercing The Corporate Veil dan pertanggungjawaban pemegang saham di Indonesia, Perancis dan Jerman. Jenis penelitian ini adalah jenis penelitian yuridis normatif dengan menggunakan pendekatan terhadap peraturan perundang-undangan dan pendekatan konseptual. Pendekatan perundang-undangan merupakan pendekatan yang mengacu pada ketentuan peraturan perundang-undangan yakni Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Hasil penelitian menunjukkan Meskipun konsep PVC diterapkan dalam berbagai negara, penerapannya memerlukan analisis yang cermat dan bukti yang kuat untuk menghindari penyalahgunaan atau penyelewengan hukum. Prinsip-prinsip keadilan, kebebasan berkontrak, dan perlindungan terhadap pihak ketiga menjadi pertimbangan penting dalam pengambilan keputusan pengadilan terkait kasus piercing the corporate veil.

Abstract

This study aims to address and ultimately find the solution to the phenomenon of underage driving and motorcycling in Indonesia. The continued rise of vehicle ownership has also increased the risks of traffic accidents, which are then exacerbated by the phenomenon of underage driving and motorcycling. Ultimately, this has raised the urgency to thoroughly analyze the causes behind this phenomenon and explore other legal angles to curb this problem and increase the safety of all road users. Through the normative legal research method with statutory approach, this study finds that there are normative inadequacies within the relevant legal framework to tackle the issue of underage driving and motorcycling. This study also proposes a strategy to help tackle this problem by focusing on holding vehicle owners more accountable with a structured penalty system directly to the owners of the vehicles, as they are enabling this dangerous behavior.
