Abstract

This study aims to analyze the factors influencing the decision to remain unmarried, childfree, and childless within the Muslim community in South Korea, focusing on socio-demographic perspectives and Islamic legal views. South Korea's low fertility rate of 0.78 children per woman by 2022 is the main background of this research, which explores the phenomenon of changing family structures amid contemporary economic and social complexities. The research method uses a descriptive-analytical approach with data collection techniques through literature study, in-depth interviews, and document analysis from official sources such as the Organization for Economic Co-operation and Development and worldometers. Demographic and statistical data were analyzed comparatively with reference to Islamic normative perspectives. The results identified four main typologies in the family phenomenon: (1) single individuals who reject marriage due to economic and social concerns, (2) a preference for adoption over having biological children, (3) couples who experience childlessness due to procrastination, and (4) the childfree decision as a conscious choice. The study of Islamic law shows the flexibility of the four madhhabs in viewing postponement of pregnancy, provided that it does not violate reproductive and spiritual principles. The research concludes that the choice of childfree or childless is a complex response to socio-economic uncertainty, which requires mathematical planning.

Abstract

The article examines the challenges of justice in Sinoman culture in the era of contemporary Islamic economics, focusing on the Time Value of Money (TVM) concept. Using a descriptive qualitative approach and a case study in Brangsong Village, Kendal, data were collected through interviews and observations. Theories like al-ghunmu bi al-ghurmi and al-kharāj bi al-ḍamān explain how sinoman ensures fair distribution of benefits and risks without exploitation or TVM inequality. Social reciprocity is driven by solidarity and collective responsibility, not mere financial profit. Sinoman embodies distributive and commutative justice, rejects usury, and reflects local gotong royong, yet faces challenges within TVM-based modern Islamic economics. Abstrak:Artikel ini mengkaji secara kritis konsep keadilan dalam praktik tradisional sinoman di Jawa, dalam konteks ekonomi Islam kontemporer yang banyak bergantung pada konsep Time Value of Money (TVM). Menggunakan pendekatan kualitatif deskriptif, studi ini berbasis pada penelitian lapangan di Desa Brangsong, Kabupaten Kendal, melalui wawancara mendalam dan observasi partisipatif. Analisis didasarkan pada prinsip keadilan ekonomi Islam seperti al-ghunmu bi al-ghurmi dan al-kharāj bi al-ḍamān yang menekankan distribusi manfaat dan tanggung jawab risiko secara adil. Praktik sinoman mencerminkan sistem pertukaran sosial non-finansial yang didasarkan pada solidaritas, keadilan distributif dan komutatif, serta penolakan terhadap ribā. Tradisi ini memperlihatkan semangat gotong royong dan resistensi terhadap komodifikasi waktu dalam relasi ekonomi. Namun, tantangan muncul ketika sinoman dihadapkan dengan sistem keuangan Islam modern yang mengadopsi TVM sebagai dasar pengukuran keuntungan dan risiko. Artikel ini memberikan kontribusi terhadap wacana epistemologis ekonomi Islam dengan menunjukkan bahwa tradisi lokal dapat menjadi paradigma alternatif keadilan yang tidak berpusat pada kapital.

Abstract

This study aims to analyze the use of the Fake GPS application by Shopee Food drivers in Ambarawa District from the perspective of Maqāṣid Ash-Sharī'ah and Legal Sociology. The research method used is field research with a descriptive qualitative approach. The research subjects were Fake GPS user and non-user drivers, marketplace owners, and consumers. Data were collected through in-depth interviews, observation, and documentation. The theory used is Maqāṣid Asy-Sharī'ah (Haroen, 1996) to assess the suitability of this practice with the principles of justice and Islamic values, and the theory of Legal Sociology (Rahardjo, 1982) to understand the relationship between law and social reality. The results show that the practice of using Fake GPS is driven by economic pressure, the Shopee Food bonus system, and the tight competition between drivers. From the perspective of Maqāṣid Ash-Sharī'ah, this action harms the values of Hifz ad-Din, Hifz an-Nafs, Hifz al-Mal, and Hifz al-Aql because it triggers dishonesty, potential harm, economic injustice, and cheating habits. From a Sociology of Law perspective, this phenomenon shows a mismatch between the ideal norms of Shopee Food and the social conditions of the drivers. This research recommends religious value education, revision of order algorithms, humanist law enforcement, economic empowerment of drivers, and dialog forums so that solutions are more holistic and according to local needs.

Abstract

Praktik sewa menyewa (Ijārah) rumah di Kelurahan Dukuh Kota Salatiga umumnya hanya berbasis perjanjian lisan tanpa klausul tertulis terkait pembatasan modifikasi rumah oleh penyewa. Kondisi ini menimbulkan persoalan hukum, terutama potensi ghārār (ketidakjelasan) menurut Hukum Islam dan wanprestasi menurut KUHPerdata, karena modifikasi rumah tanpa izin sering merubah objek sewa dari manfaat semula, memicu kerugian, dan mempersulit pembuktian sengketa. Penelitian ini bertujuan menganalisis unsur ghārār dalam praktik modifikasi rumah sewaan menurut syarat sah Ijārah serta mengkaji bentuk wanprestasi berdasarkan Pasal 1548 dan Pasal 1550–1552 KUHPerdata. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan kualitatif, pengumpulan data dilakukan melalui observasi, wawancara mendalam dengan pemilik dan penyewa rumah, serta studi dokumen. Hasil penelitian menunjukkan bahwa tindakan modifikasi rumah secara sepihak oleh penyewa melanggar kejelasan objek dan manfaat sewa sehingga menimbulkan ghārār dan wanprestasi, serta berpotensi membatalkan akad sewa. Ketiadaan perjanjian tertulis semakin memperlemah posisi hukum para pihak. Penelitian ini merekomendasikan perlunya kontrak sewa tertulis yang memuat klausul modifikasi fisik, pembagian tanggung jawab, serta legalisasi notaris untuk mengurangi risiko sengketa. Temuan ini diharapkan menjadi rujukan bagi pemilik, penyewa, dan pembuat kebijakan untuk menciptakan akad sewa yang sah, adil, dan berkepastian hukum.

Abstract

Underage marriage in Kedu Subdistrict is still a complex social issue, with the main focus on the fulfillment of children's rights, especially the ḥaḍānah aspect of Wahbah Az-Zuhaili. This research uses a qualitative approach through field research methods, with data collection techniques in the form of in-depth interviews, participatory observation, and documentation of eleven early-age couples registered at the Kedu District KUA for the 2020-2023 period. The results showed that although the couples did not formally understand the fiqh of ḥaḍānah, they practiced parenting based on instinct, social support, and gradual adaptation. The main challenges faced include limited education, economic pressure, and emotional immaturity, but no divorce cases were found in this group of subjects. This finding indicates the potential for successful parenting in underage marriages with the right support. This research emphasizes the importance of a contextualized socio-religious approach and ongoing coaching to strengthen the quality of parenting from a fiqh perspective.

Abstract

Legal awareness in disabled families shows a fifty-fifty point, where someone with a disability has the courage to try to get married and fulfill their rights and obligations as a husband, especially the right to support their family. Although not all blind families know and understand the details of marriage law such as marriage conditions, rights and obligations of husband and wife, child gifts, as contained in applicable family law principles. Efforts to work coupled with skills and job opportunities have grown significantly, in Indonesia in 2022, there will be 720,748 disabled workers, an increase from 277,018 people in 2021. On the other hand, awareness of disability law in the public sphere is still lacking, where it is still limited. access to facilities and infrastructure at Special Schools and Community Learning Activity Centers at the village level which motivates increasing insight and skills with disabilities as an improvement in living standards, whereas in the realm of legal apparatus, judiciary and correctional institutions, there is minimal implementation of the fulfillment of disability rights, such as supporting facilities for sign language interpreters and the use of Braille, disabled-friendly building facilities and legal information outreach to people with disabilities.

Abstract

The phenomenon of emotional infidelity or emotional affair has increasingly gained attention due to its serious impact on marital harmony, even though it does not involve physical relations. This topic was chosen because, in practice, non-physical infidelity often leads to conflict, even divorce, yet its regulation in family law in both Indonesia and Brunei Darussalam remains unclear. This study aims to examine and compare how the two countries address the issue of emotional infidelity within their respective legal frameworks. This research is a normative legal study employing a comparative approach. Data were collected through library research and analysis of legal documents, including statutes, regulations, and court decisions in Indonesia and Brunei Darussalam, and then analyzed using the theory of legal pluralism and Zweigert and Kötz’s comparative law methodology. The findings reveal that Indonesia does not yet have specific provisions that explicitly categorize emotional infidelity as a legal violation, although it is often cited as grounds for divorce in religious courts. In contrast, Brunei Darussalam has stricter regulations through the Islamic Family Law Order 1999 and the Syariah Penal Code Order 2013, which classify emotional infidelity as part of moral and religious violations with clearer legal consequences. These findings are significant as they highlight a regulatory gap that affects the protection of marital institutions in Indonesia. By understanding this comparison, the study is expected to contribute to the development of Islamic family law in Indonesia, particularly in formulating more responsive regulations toward the increasingly complex phenomenon of non-physical infidelity in the digital era.
