Abstract

Abstract: The concept of the time value of money (TVM) is a foundational element in conventional finance, yet its application within Islamic law remains a subject of conceptual and normative debate. This study aims to reassess the notion of TVM through the lens of turāṡ in Islamic legal theory (Uṣūl al-Fiqh), with particular focus on the perspectives of the four major Sunni schools (Ḥanafī, Mālikī, Syāfi‘ī, and Ḥanbalī). Employing a normative-legal approach and a library-based research method, this article explores how classical jurists differentiate between the permissibility of time-related value in credit-based sales contracts and its prohibition in loan-based transactions involving riba. The findings suggest that Islamic law recognizes time value only within a limited scope, embedded in the price of goods in deferred sales, but rejects the monetization of time as a stand-alone commodity in loan arrangements. Foundational legal juridical principles derived from Uṣūl al-Fiqh and the objectives of Islamic law (maqāṣid asy-sharī‘ah), such as justice, property preservation, and benevolence, provide the ethical and juridical basis for this distinction. The study concludes that TVM is Sharīʿah-compliant only when applied within the framework of real economic transactions, not in exploitative financial mechanisms. This research remains limited to conceptual legal analysis and does not assess practical applications in the Islamic finance industry. Future studies are encouraged to explore TVM implementation in contemporary Islamic financial products and its relevance to international standards and regulatory frameworks. Abstrak: Konsep nilai waktu uang (TVM) merupakan unsur dasar dalam keuangan konvensional, namun penerapan konsep ini dalam hukum Islam masih menjadi subjek perdebatan konseptual dan normatif. Penelitian ini bertujuan untuk mengevaluasi kembali konsep TVM melalui perspektif turāṡ dalam teori hukum Islam (Uṣūl al-Fiqh), dengan fokus khusus pada pandangan empat mazhab Sunni utama (Ḥanafī, Mālikī, Syāfi‘ī, dan Ḥanbalī). Dengan menggunakan pendekatan normatif-hukum dan metode penelitian berbasis perpustakaan, artikel ini mengeksplorasi bagaimana ulama klasik membedakan antara kelayakan nilai waktu dalam kontrak penjualan kredit dan larangan nilai waktu dalam transaksi pinjaman yang melibatkan riba. Temuan menunjukkan bahwa hukum Islam mengakui nilai waktu hanya dalam lingkup terbatas, tertanam dalam harga barang dalam penjualan tertunda, namun menolak monetisasi waktu sebagai komoditas mandiri dalam perjanjian pinjaman. Prinsip-prinsip hukum dasar yang berasal dari Uṣūl al-Fiqh dan tujuan hukum Islam (maqāṣid asy-sharī‘ah), seperti keadilan, pelestarian harta, dan kebaikan, memberikan dasar etis dan hukum untuk pembedaan ini. Studi ini menyimpulkan bahwa TVM hanya sesuai dengan Syariah jika diterapkan dalam kerangka transaksi ekonomi nyata, bukan dalam mekanisme keuangan yang eksploitatif. Penelitian ini masih terbatas pada analisis hukum konseptual dan tidak mengevaluasi penerapan praktisnya dalam industri keuangan Islam. Studi-studi di masa depan didorong untuk mengeksplorasi implementasi TVM dalam produk keuangan Islam kontemporer dan relevansinya dengan standar internasional dan kerangka regulasi.

Abstract

AbstractThis article discusses al-Ka>fi>, written by Abu Ja'far Al-Kulaini>, with an emphasis on studying the Prophet Muhammad’s will to ‘Ali>> ibn Abī Ṭālib found in the section Raudat al-Ka>fi>. As the third part of al-Ka>fi>, Raudat al-Ka>fi> consists of a collection of hadiths that cover various religious aspects, including the letters and sermons of the Imam, which have a different system compared to the previous two sections. This article highlights the importance of the Prophet's will in the context of leadership and the spiritual authority of ‘Ali>> by discussing key themes contained in the will, namely justice, wisdom, and social responsibility. This article offers a perspective on the influence of these teachings within the Shia hadith and their relevance in contemporary society. This analysis is expected to deepen understanding of al-Ka>fi>’s contribution to the development of Islamic thought and the significance of the relationship between the Prophet and ‘Ali>> in Islamic history.Keywords: al-Ka>fi>, Raud}at al-Ka>fi>, Will. AbstrakArtikel ini membahas kitab Al-Kāfī yang ditulis oleh Abū Ja‘far al-Kulainī, dengan penekanan pada studi wasiat Nabi Muhammad kepada ‘Alī ibn Abī Ṭālib yang terdapat dalam bagian Rauḍat al-Kāfī. Sebagai bagian ketiga dari Al-Kāfī, Rauḍat al-Kāfī terdiri dari kumpulan hadis yang mencakup berbagai aspek keagamaan, termasuk surat dan khutbah Imam, yang memiliki sistematika berbeda dibandingkan dua bagian sebelumnya. Artikel ini menyoroti pentingnya wasiat Nabi dalam konteks kepemimpinan dan otoritas spiritual ‘Ali>>. Dengan membahas tema-tema kunci yang terkandung dalam wasiat, seperti keadilan, kebijaksanaan, dan tanggung jawab sosial, artikel ini menawarkan perspektif tentang pengaruh ajaran tersebut dalam tradisi Syiah dan relevansinya dalam masyarakat kontemporer. Analisis ini diharapkan dapat memperdalam pemahaman tentang kontribusi Al-Kāfī terhadap pengembangan pemikiran Islam dan signifikansi hubungan Nabi dan ‘Ali>> dalam sejarah Islam. Abstract

The humanitarian conflict affecting the Rohingya ethnic group in Myanmar continues to this day. The conflict, which began after Myanmar's independence in 1948, has resulted in millions of Rohingya fleeing to other countries, including those in Southeast Asia that border Myanmar. Indonesia is also one of the destination countries for refugees. Recently, news about the influx of Rohingya refugees in Indonesia has flooded the mass media and social media. To what extent does Indonesia have the authority to resolve the Rohingya refugee conflict? This study complements existing studies, which lack focus on Indonesia's sovereignty in handling the Rohingya refugee case. This problem formulation is divided into three questions. First, what is the history of the Rohingya ethnic conflict? Second, what has been the response and attention of the international community to Rohingya ethnic refugees? Third, to what extent does Indonesia's sovereignty resolve the Rohingya ethnic refugee issue? This study is a literature study conducted using qualitative research. The data used is secondary data, namely books, articles, news, and other literature. The analysis in this study uses the content analysis theory ( ). The results are as follows. First, the Rohingya ethnic group, which has long occupied Myanmar, which borders Bangladesh, has been massively discriminated against by other ethnic groups and the Myanmar government. Second, the international organisations involved in handling Rohingya refugees are ASEAN, UNHCR, OIC, IMO, and the UN. Third, Indonesia has the absolute sovereign right to determine its own policies in accordance with the principles of the second principle, Civilised Humanity.

Abstract

The phenomenon of emotional infidelity or emotional affair has increasingly gained attention due to its serious impact on marital harmony, even though it does not involve physical relations. This topic was chosen because, in practice, non-physical infidelity often leads to conflict, even divorce, yet its regulation in family law in both Indonesia and Brunei Darussalam remains unclear. This study aims to examine and compare how the two countries address the issue of emotional infidelity within their respective legal frameworks. This research is a normative legal study employing a comparative approach. Data were collected through library research and analysis of legal documents, including statutes, regulations, and court decisions in Indonesia and Brunei Darussalam, and then analyzed using the theory of legal pluralism and Zweigert and Kötz’s comparative law methodology. The findings reveal that Indonesia does not yet have specific provisions that explicitly categorize emotional infidelity as a legal violation, although it is often cited as grounds for divorce in religious courts. In contrast, Brunei Darussalam has stricter regulations through the Islamic Family Law Order 1999 and the Syariah Penal Code Order 2013, which classify emotional infidelity as part of moral and religious violations with clearer legal consequences. These findings are significant as they highlight a regulatory gap that affects the protection of marital institutions in Indonesia. By understanding this comparison, the study is expected to contribute to the development of Islamic family law in Indonesia, particularly in formulating more responsive regulations toward the increasingly complex phenomenon of non-physical infidelity in the digital era.
