Abstract

This study aims to examine the legal analysis of the conversion of agricultural land into housing development in Kabupaten Bima. This research is structured as an empirical legal research based on the consideration that this research in problem analysis is carried out by combining secondary and primary legal materials obtained in the field. The approach used is the statute approach, conceptual approach, and the sociological approach to law. Based on the results of the study, it can be concluded that the mechanism for changing the function of agricultural land into housing development is divided into two mechanisms, namely through a location permit if the land requested is more than 10,000 m2 while the land use change permit is used if the land use is less than 10,000 m2. With the provision that a treatise is required for technical land considerations issued by the National Land Agency of Bima Regency and a decision from the regional spatial planning coordination team regarding recommendations for space utilization permits for housing development. The policy issued by the Bima regency government is to become a reference in the conversion of land functions in line with the main agrarian law regulations and regional regulations on the spatial plan for the Bima district.

Abstract

This study describes the process of land ownership transfer application obtained from purchasing. It focuses on the time period from purchasing to application submission according to Article 103 Paragraph (1) and (7) of the Regulation of Ministry of Agrarian No 3 of 1997. This study is a normative-empirical one, with statute, conceptual, and sociological approaches. Results of this study show that according to the Regulation, application submission is no later than 7 days after purchasing. In the other word, it neglects Paragraph (7) that allows application submission exceeding 7 days. The Agrarian Office does not proceed application that is submitted more than 7 days. In the case it exceeds 7 days, applicant is to renew and adjust the deeds and its date.

Abstract

The aims of this research are to examine the implementation of land rights sporadically upon Pipil as evident and to determine whether Pipil has been legally admitted as adequate evidence in the sporadic land registration. The applied research method is the empirical legal research method. Research reports indicate that the implementation of land rights registration using Pipil as evidence is meant to provide legal certainty as long as it includes the owner’s identity, latest tax payment receipt and family card (KK) in a bundle to proceed to a notary of the land office. In the next stage, these documents will be checked and validated by the Head of the village, and lastly registered to the National Land Office (BPN).

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan hukum kepemilikan tanah absentee yang disebabkan pemekaran wilayah daerah, hambatan dan upaya Badan Pertanahan Nasional dalam penyelesaian masalah kepemilikan tanah absentee akibat pemekaran wilayah daerah serta persepsi masyarakat terhadap tanah absentee yang disebabkan pemekaran wilayah daerah. Penelitian ini merupakan jenis penelitian hukum empiris, dengan menggunakan pendekatan konseptual, pendekatan Undang-Undang, pendekatan historis, dan pendekatan sosiologis. Hasil penelitian ini bahwa: 1. Kedudukan hukum dalam kepemilikan tanah merupakan keabsahan suatu subjek hukum dalam hak penuh terhadap tanah sehingga apabila tanah yang dimiliki absentee kedudukannya wajib dialihkan. 2. Hambatan Badan Pertanahan Nasional yang paling mendasar dalam penyelesaian masalah kepemilikan tanah absentee yiatu masih banyak terdapat tanah-tanah yang belum terdaftar. 3. Persepsi masyarakat terhadap tanah absentee yang disebapkan pemekaran wilayah daerah yaitu masyarakat masih kurang pemahaman terkait tanah absentee.
