Abstract

The consequences of the bankrupt debtor brings considerable losses to his creditors. There are : preferred creditors, unsecured creditors, and separatist creditors. Since the date the debtor is declared bankrupt, the curator is in charge of all the assets of the debtor and determines the credits amount to pay the creditors, except for separatist creditors. As the separatist creditor, has the preferred position of other creditors to get paid first and also to execute specific guarantees by their own through parate executie. This thesis will aim to analyze and explain how the implementation of the parate executie for creditor to disbursement the deposit guarantee and  how the legal protection for creditors receiving deposit guarantee based on a case study PT. Plaza Indonesia and PT. Gagan Indonesia. The study belongs to normative legal research, using secondary data as the source. Technique of analyzing data employed by the research was a qualitative method. Based on the result of research, it can be explained that application of the parate executie is given by law to creditors who own a certificate of material security based on Article 55 of Law no. 37 of 2004 on Bankruptcy states. However, the execution cannot be conducted by unsecured creditors. PT. Plaza Indonesia in this case is an unsecured creditors. Even though the  creditor holds a deposit guarantee in the form of cash, without issuing a certificate as evidence, the creditor remains as an unsecured creditor. Therefore PT.Plaza Indonesia will get paid on a pro rata basis.

Abstract

Children are the next generation of our great country. Therefore, it is the country’s responsibility to protect children’s rights by creating regulations to enforce it. One amongst many of the regulations is UU No.1 Tahun 1974 tentang Perkawinan where it is stated in Pasal 7 ayat 1 that the minimum age of marriage is nineteen years old for male and sixteen years old for female. However, in 2019 with many considerations, Mahkamah Konstitusi ratified UU No. 16 Tahun 2019. Which means, the minimum age of marriage rose to nineteen years old for both male and female. Nevertheless, a judge in Bantaeng, South Sulawesi, decided to grant a request for dispensation of a matrimony between a fifteen years old male and fourteen years old female. The judge’s consideration was so the female child can have a protection. The writer perceives this decision as injudicious because it is fair to say that physically, mentally, and financially, this couple is not ready for marriage. Also, by uniting them in marriage, both the female and male child will be at risk of losing certain rights that they suppose to receive as children.

Abstract

A sale and purchase agreement (PPJB) is often carried out in the process of buying and selling land, which there is an absolute power of attorney. There are pros and cons regarding the use of absolute power of attorney that there are problems regarding the validity of the PPJB which contains an absolute power clause as a transfer of rights to land and legal consequences of prohibiting the use of absolute power as a transfer of rights to land. This research uses normative legal research methods and uses data collection or processing techniques through literature review and interviews with related sources. The results of this study are that the use of absolute power in the sale and purchase agreement is valid as long as the power granted is contained in the principal agreement. The use of absolute power that is prohibited is the granting of power that does not follow the main agreement, meaning that this power is independent. The legal consequence of the use of absolute power in the transfer of land rights is that the absolute power can be canceled and null and void by law, however such absolute power can only be canceled by a judge's decision and generally will occur if there is a dispute. The suggestion is that there needs to be clear rules governing absolute power in more detail so that the pros and cons regarding this absolute power are resolved, land deed officials should be more careful when going to use absolute power.

Abstract

Land is one of the basic needs of every human being, because humans usually need soil for their activities, and the soil grows through the utilization of natural resources on the surface of the earth. Life exists in most lands, which makes land an important part of human interests, so land is also necessary for the construction of houses as dwellings. Based on Article 28H paragraph (1) of the State Law of the Republic of Indonesia in 1945 (hereby called the 1945 Constitution), it governs that everyone has the right to live prosperously and live in a good and healthy region. The problems in this study can be formulated: How is the legal position of land and building lease agreements in terms of transfer of land rights in supreme court ruling No. 931 K/PDT/2019. Its contents are determined by PT PLN (Persero), employees of PT PLN (Persero) and Public Officials (Notaries), but the agreement made is not balanced between PT PLN (Persero) and its employees because of the difference between PT PLN (Persero) and its employees in the lease agreement that only benefits is PT PLN (Persero). It is best for employees of PT PLN (Persero) to be able to position themselves as buyers rather than employees, this is a better option, because in the eyes of the law buyers and sellers have the same rights.

Abstract

Marriage is a strong and firm agreement to live together legally between a man and a woman where the ideal marriage is a marriage in which both partners reach sufficient age. However, when one of the partners or both parties do not reach the age for marriage, the next step is to apply for a marriage dispensation. In this paper, there is a problem that will be discussed, namely how the status of the prospective bride and groom as an exempted marriage dispensation applicant.The purpose of this paper is to understand the status of the prospective bride and groom as an exempted marriage dispensation applicant. The research method used in this study is the normative research method. The research data was collected by means of literature study through the method of approaching laws and interviews. Then analyzed using qualitative analysis techniques. In terms of the status of the prospective bride and groom as an exempted marriage dispensation applicant is not legally competent. Child may not be the Petitioner in court because considering his age is still not legally competent. Court decisions made by judges have a major role in changing behavior and increasing legal awareness. It is necessary to have a common ground between the child protection law and the marriage law.

Abstract

Reconciliation in the PKPU process is basically the same as an agreement in general, but the peace in the PKPU process is more specific because its enforcement requires legal approval from the court, this is contained in Law No. 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations. Peace that has received approval from the court is in the form of homologation, resulting in peace becoming a court product, namely in the form of a decision that has permanent legal force. In fact, the homologation decision can still be changed to the contents of the Peace Agreement without a decision from the Commercial Court Judge and the case taken in the Supreme Court Decision Number 718K / Pdt.Sus-Pailit / 2019. The author examines the ratification of peace (Homologation) on the postponement of debt payment obligations (PKPU) on the contents of the agreement which has been amended according to Law No. 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations. In obtaining the data, juridical legal research methods are used, and through the statute approach and the case approach. Amendments to the contents of the Homologated Peace Agreement are null and void and the process of settlement of payment of accounts receivable is returned to the original homologation decision.

Abstract

The life of society has evolved, there are no boundaries between people from any race, religion, tribe background in Indonesia. Because of that, it's very possible for people from two different religions to have any relationship and want to get married. One of those people is Agustinus Dwi Nugroho and Ika Dede Yuniar, they appeal some pleas to Surakarta Court, demanding for their marriage to be legalized. In the verdict, the judge granted all the pleas. The issue in this research is how is different religion marriage in Indonesian laws? (Case Studies number 278/Pdt.P/2019/PN.Skt), the research method is Normative with conceptual, laws and case approach and supported by data from library and some interviews. Different religion marriage in Indonesian law is not yet being regulated but there are a few laws related to the topic, such as: Article 2 Paragraph (1) and Article 8 Law Number 16 Year 2019, Article 35 Law Number 23 Year 2006, and Article 40 and Article 44 in Islamic Law Compilation. In the verdict that became the subject in this research, the writer feels there's some law that is not yet included in the consideration, such as Article 8 Law Number 16 Year 2019 and Article 44 in Islamic Law Compilation because one of the parties in that verdict is moslem.

Abstract

PT Aes Agriverde Indonesia did not make full payment for the shipment and installation of goods. Panel Distribution Board DB901 (Blower) and DB905 (Lagoon) Repowering PHS and delivery of goods OMM Spare Inverterand PLC PHS Repowering Unit that has been installed, PT Elmecon Multikencana filed a lawsuit to the District Court Central Jakarta for default by PT Aes Agriverde Indonesia. In the lawsuit, one of them is a request for a late fee of 2%. The problem that was raised was how the Judge's consideration of rejecting the interest compensation in Article 1250 of the Civil Code on sale and purchase transactions (Study of Decision Number 46 / Pdt.G / 2018 / PN.Jkt.Pst)? The research method used is a normative research method supported by interview data to strengthen the research results. Whether or not there is an agreement regarding late fees or interest rates that have been submitted to the District Court, it is not impossible or cannot be granted, but it all depends on the judge who will judge at the time the trial begins. It can be concluded that even though the plaintiff does not have a strong legal basis regarding the amount of interest rates, the Panel of Judges at the Central Jakarta District Court should have granted the request for late fees or interest rates.

Abstract

Article 1678 paragraph (1) of the Civil Code regulates the prohibition of granting between husband and wife as long as their marriage is still in progress. The problem in this research is how can the grants be canceled between husbands and wives who commit acts against the law based on the Supreme Court Decision Number 91 / PK / Pdt / 2017? The research method used is juridical normative using primary data and secondary data, and the results of research using qualitative data analysis methods. The results showed that the cancellation of grants between husband and wife who committed an illegal act was carried out through a lawsuit to the district court. Based on court facts, Denpasar District Court judges to the Supreme Court have been careful in making considerations by looking at the provisions of the laws and regulations regarding the prohibition of grants between husband and wife and exceptions as regulated in Article 1678 of the Civil Code and also the validity conditions of the grant agreement deed as regulated in Article 1320 of the Civil Code. Even though Decision Number 723 / Pdt.G / 2013 / PN.Dps rejected the Plaintiff's claim, nevertheless, the decision was in accordance with the provisions of positive law in Indonesia, resulting in legal certainty, namely the cancellation of the grant made between I Gusti Ayu Ita Dewi and Sven. Hollinger.

Abstract

Sengketa konsumen merupakan salah satu hal yang perlu diresponi secara pro-aktif mengingatperkembangan bidang perindustrian dan perdagangan secara nasional maupun dalam skopa kawasanASEAN. Mediasi merupakan salah satu alternatif penyelesaian sengketa baik secara out of courtmaupun sebagai bagian dalam penyelesaian perkara di pengadilan dalam menyelesaikan sengketakonsumen. Penyelesaian sengketa melalui BPSK merupakan salah satu penyelesaian sengketa di luarpengadilan dengan menggunakan mediasi sebagai salah satu alternatif penyelesaian sengketanya.Efektifitas ini dilihat berdasarkan terbentuknya Akta Perdamaian dari kedua belah pihak yangbersengketa. Jika Akta Perdamaian terbentuk, maka hal tersebut dapat dijadikan tolok ukur efektifnyamediasi. Hukum acara yang berlaku baik Pasal 130 HIR maupun Pasal 154 Rbg, mendorong parapihak untuk menempuh proses perdamaian yang dapat diintensifkan dengan cara mengintegrasikanproses ini ke dalam peradilan. Oleh karena itu, posisi mediasi sebagai bagian dari Hukum AcaraPerdata sejatinya dapat memperkuat dan mengoptimalkan fungsi lembaga peradilan dalampenyelesaian sengketa. Penelitian ini dilakukan dengan menggunakan metode pendekatan normatifempirisdengan spesifikasi deskriptif-analitis dalam menelaah mengenai efektifitas mediasi dalamsengketa konsumen oleh Badan Penyelesaian Sengketa Konsumen (BPSK) di DKI Jakarta.Pengolahan dan analisis data dalam penelitian ini dilakukan dengan metode analisis normatifkualitatif.
