Abstract

Every citizen has the right to marry because this marriage is a sacred event so that there are manylegal responsibilities. This is stated in Article 1 of Law Number 1 of 1974 concerning Marriage whichstates "Marriage is an inner and outer bond between a man and a woman as husband and wife withthe aim of forming a happy and eternal family (household) based on the One Godhead. ." So we need alegal regulation itself that regulates marriage law so as not to cause a problem in the future. This legalarrangement of marriage must be focused first on the registration of marriages because theregistration of marriages is very important for the continuity of the parties who have carried out themarriage procession. An unregistered marriage will have legal consequences for the position of thewife, the position of the children, and the position of assets. A marriage that has occurred must berecorded because this is an ef ort made by the government to create order in an administration in thefuture.

Abstract

In the past, marriage at a young age was still considered commonplace, but over time it has changednot a few people who oppose marriage at an early age, for example in the determination of the KediriRegency Religious Court Number 0230/Pdt.P/2018/PA.Kab.Kdr there are application for dispensationof marriage submitted by the Petitioner, whereas the Petitioner in his application letter stated that thePetitioner has a nephew who is 16 years old, the Petitioner will soon marry of the niece of thePetitioner to his future wife who is 15 years old. The problem in writing this thesis is how to apply fora marriage dispensation permit after the birth of Law Number 16 of 2019? and how is the judge'sconsideration in determining the marriage dispensation in the determination of Number0230/Pdt.P/2018/PA.Kab.Kdr.?. Marriage dispensation is a decision that can provide freedom fromseveral rules, which are given by the Religious Courts to be able to carry out marriages, for men andwomen who have not yet reached the minimum age limit set by Law No. the marriage can be carriedout and ratified by the KUA (religious af airs of ice). In conclusion, the granting of a marriagedispensation permit by the Religious Court of Kediri Regency, the author feels that there are severalregulations that have not been included as a consideration in the determination apart from beingbased on Law Number 16 of 2019.

Abstract

Society utilize the land as a place to do business and place to live which it means a house. House canbe obtained from buy and sell transaction upon the agreement of the parties. Problems can be found intransaction process as in the case of West Jakarta District Court Decision Number339/Pdt.G/2018/PN.Jkt.Brt. regarding the seller committing an unlawful act by pledging a housecertificate bound by a sale-purchase agreement without buyer permission. The problem are how is thestatus of the buyer ownership rights of the house that is pledged to the bank without buyer permissionand how is the buyer legal protection for the house that is guaranteed to the bank without the buyerpermission. The research method using legal research normative data supported by interviews. Theresearch result shows the buyer is not the owner of the house because the process of transferringownership has not been carried out and the certificate is still listed as the name of the seller, but it’s theright of the buyer to have the house, because the buyer has done his obligations to pay the price housein installments, so the house cannot be guaranteed by the bank. Buyer don’t get legal protectionbecause the buyer lost in court. Buyer must file a re-suit to the court by providing a legal basis andwithdraw the parties involved in the case with the aim of providing arguments for the lawsuit in thecourt.

Abstract

A legal marriage is a marriage that is carried out between a man and a woman and the marriage islegally registered according to the law in force in Indonesia. If a man and a woman have not reachedthe minimum age for marriage and wish to marry, they can apply for a marriage dispensation at theReligious Courts or at the District Courts according to the religion of both parties. Examples includethe application for dispensation from marriage in the Sumedang Religious Court Decision Number541/Pdt.P/2020/PA.Smdg and the Sumedang Religious Court Decision Number475/Pdt.P/2020/PA.Smdg. The problems that occur in the research of this thesis, namely what is thebackground of the filing of a marriage dispensation, how is the judge's consideration in deciding theapplication for a marriage dispensation, and how is the ef ectiveness of Law No. 16 of 2019 onapplications for a marriage dispensation. This thesis research uses a normative research method wherethe approach used is a conceptual approach, a legal approach, a case approach supported by data andliterature reviews and also interview data to strengthen the research material of this thesis. After 1(one) month the issuance of the latest revision of the Marriage Law, BADILAG noted that applicationsfor dispensation for marriage experienced a fairly rapid increase from the previous year, this was dueto a change in the minimum age limit for marriage which changed to 19 years for both men andwomen. woman. Then the judge's consideration in deciding the application is to see the benefit of thePetitioner's child, on that basis the judge grants the marriage dispensation application and issupported by the completeness of the requirements for submitting a marriage dispensation application.Unfortunately, the latest Marriage Law is considered less ef ective in suppressing the rampantmarriage of minors which continues to this day.

Abstract

Polygamy is a form of marriage that is often problematic in society because it invites controversial views, this is because polygamy sometimes does not promise justice and prosperity for the life of the wife and children, especially if polygamy is allowed for reasons not stipulated in Islamic law or Marriage Law. This study discusses how the Bojonegoro Religious Court judges granted a polygamy permit application that was not in accordance with the provisions of the Marriage Law and KHI in the Court Verdict Number 342/PDT.G/2019/PA.BJN. The writer uses normative research using qualitative methods and the material was obtained from the literature study. The results of this study indicate that the granting of polygamy permits is based on alternative and cumulative requirements in Articles 4 and 5 of the Marriage Law. In addition, polygamy permits are also based on fairness to their wives. However, the reasons put forward in case Number: 342/PDT.G/2019/PA.BJN are not regulated in Article 4 Paragraph (2) of the Marriage Law of Jo. Article 57 of the KHI and can cause injustice to his wife and children in the future because there is no emergency situation found in the applicant's condition to be allowed to have polygamy.

Abstract

The legality of interfaith marriages, particularly between Indonesian citizens and foreigners, is the focus of this investigation. With the assistance of statutes and regulations, this study adopts a normative legal approach. In simple terms, Indonesian marriage must adhere to Article 2 jo. UU No. 56, as amended by Section 1 of 1974, which governs marriage. The analysis reveals that interfaith marriages are in violation of international private law and Indonesian positive law, so they cannot be annulled. There are a lot of steps that need to be taken, whether in Indonesia or elsewhere, to end a marriage. In this way the local area should know how dangerous interfaith marriage is, despite the fact that it has a high gamble, the local area just ganders at it with one eye. whether or not the marriage is valid. It is possible that the number of interfaith marriages will be lower than the percentage scale for this year because of the government's important role in early counseling on the dangers of interfaith marriage. One way for people to learn how to choose a partner correctly and marry in accordance with religious law is through counseling.

Abstract

Siri marriage is considered as an illegal relationship by the state, so that the child born from the marriage is considered legal and varies according to religion. This position is based on Article 43(1) of the Marriage Law which states that a child born out of wedlock can only have civil relations with his mother and family. Based on the decision of the Constitutional Court, she can have a civil relationship with a man out of wedlock, her biological father. , said: National relations are between children born out of wedlock and their mothers and their families, and between fathers and their children in so far as a natural relationship between them can be scientifically explained; it can support technical evidence and/or other evidence such as relationships, including civil contacts with family members. In this case, unregistered marriages are considered to only provide protection and freedom to the men. Amendments to Article 43 (1) of the UUP generally apply to provide full legal protection to all born children and oblige fathers to take full responsibility for their children in accordance with the law.

Abstract

Penelitian ini dilatar belakangi oleh banyaknya permohonan dispensasi perkawinan setelah penerapan undang-undang terbaru terkait batasan usia perkawinan. Penelitian ini mengkaji pertimbangan hakim baik dari aspek normatif maupun sosial agar permohonan dispensasi ini dapat diterima. Penelitian ini fokus pada bagaimana hakim meninjau permohonan dispensasi perkawinan pasca diundangkannya Undang-Undang Nomor 16 Tahun 2019. Penelitian ini menggunakan pendekatan undang-undang. Hasil penelitian ini menunjukkan bahwa hakim dalam memutus perkara dispensasi perkawinan tidak hanya melihat pada kelengkapan administrasi hukumnya saja. Namun juga dari sudut pandang sosiologi, pemberian permohonan dispensasi melihat aspek manfaat yang harus diperoleh untuk menghindari kerugian yang lebih besar. Implikasinya, perubahan undang-undang terkait dispensasi perkawinan semakin meningkat karena menjadi tata cara penyelesaian administrasi perkawinan bagi pasangan di bawah umur dalam ketentuan undang-undang.

Abstract

Janji kawin merupakan janji dari seorang laki-laki untuk menikahi kekasihnya ataupun sebaliknya Banyak kasus yang muncul mengenai adanya ingkar janji kawin antara para pihak, sehingga salah satu pihak menggugat pihak lainnya karena merasa dirugikan akibat adanya ingkar janji tersebut. Rumusan masalah yang akan menjadi pembahasan di dalam penulisan ini yaitu mengenai bagaimana pengaturan terkait pengingkaran janji untuk menikahi dalam perspektif hukum perdata. Metode yang digunakan dalam penulisan ini yaitu dengan menggunakan penelitian normatif dengan spesifikasi penelitian preskriptif. Jenis dan teknik pengumpulan data yang digunakan adalah dengan menggunakan studi pustaka dimana penulis mengumpulkan data melalui bahan hukum primer, sekunder, dan tersier. Pendekatan yang digunakan penulis yaitu dengan pendekatan undang-undang (statute approach) dan pendekatan kasus (case approach) serta teknik analisis data secara deduktif. Janji kawin diatur di dalam Pasal 58 Kitab Undang-Undang Hukum Perdata. Mengenai ingkar janji terdapat yurisprudensi Putusan Mahkamah Agung Nomor 3191 K/Pdt/1984 yang memutus bahwa perkara pembatalan perkawinan secara sepihak merupakan perbuatan melawan hukum yang diatur pada Pasal 1365 Kitab Undang-Undang Hukum Perdata.

Abstract

The development of culture in society has various impacts including on social life, such as the rise of interfaith marriages in Indonesia. Generally, interfaith marriages are not common in Indonesian society because marriages in Indonesia are very thick with religious and ethnic rules which often cause conflicts and problems in the family aspect, the Marriage Law also emphasizes that marriage is considered valid, if it is carried out according to each religion or belief that has agreed. As a result of this provision, interfaith marriages are often not allowed because they are not permitted according to religious provisions. In this modern era, interfaith marriages do not yet have special regulations so that there is no clarity on the rules of marriage validity and child inheritance in interfaith marriages. Therefore, this research will conduct a legal review of the granting of a permit for an application for an interfaith marriage. This normative juridical research uses secondary data supported by the results of interviews which will be analyzed qualitatively and described descriptively. The results of this study indicate that the granting of permission for interfaith marriages is not in accordance with the theory of legal certainty because the Marriage Law and KHI do not allow interfaith marriages or if both religions of the bride and groom do not allow it.
