Abstract

Everything regarding marriage that has been regulated is a binding provision and must be stipulated for members of society. The legal consequences of divorce is regulated in Article 37 of Law Number 1 of 1974 regarding Marriage. In the verdict the author uses as research material, Verdict Number 1718/Pdt.G/2021/PA. Btm has determined based on the Supreme Court jurisprudence Number: 3405/K/PDT/2012 which confirms that marriage agreements that aren’t registered has no legal force. The author’s goal is to determine the legal consequences of unregistered marriage agreements. The author uses written materials as main sources to analyze with the results of interviews. The results of the research by the author is that the Verdict Number 1718/Pdt.G/2021/PA. Btm has to be cancelled because the jurisdiction verdict number 3405/K/PDT/2012 has been cancelled and the marriage agreement between Nurevi binti Muhammad Mubazzir and Andrew Kevin Plant should be a permenant legal force. The conclusion of the research is after the issuance of Constitutional Court Decision No. 69/PUU-XIII/2015, a marriage agreement is no longer interpreted only as an agreement made before marriage, but also made during marriage.

Abstract

This research aims to examine the validity of the deed made by the Deed Official. The State of Indonesia declares itself as a State of law which means that all aspects of life including all activities, regulations, and decisions to be taken by the Government must be based on all applicable laws in the State of Indonesia. The leadership system adopted by Indonesia is a Presidential government where the President is given the duty and trust as the Head of State. In exercising his governmental powers, the President is assisted by state ministers appointed and dismissed by the President. Regarding the scope of Land Registration in Indonesia, the Government is assisted by the National Land Agency and the Land Deed Official. The presence and role of the Land Deed Official in ensuring legal certainty of land status and ownership is very important because it is the main pillar, the condition for the authenticity of a deed, as proof that a legal action has occurred regarding land rights. In carrying out his position, the Land Deed Official is obliged to comply with statutory regulations, namely Government Regulation Number 24 of 2016 concerning Amendments to Government Regulation Number 37 of 1998 concerning Regulations on the Position of Land Deed Officials.  The presence and role of the Land Deed Official in ensuring legal certainty of land status and ownership is very important because it is the main pillar, the condition for the authenticity of a deed, as proof that a legal action has occurred regarding land rights. In carrying out his position, the Land Deed Official is obliged to comply with statutory regulations, namely Government Regulation Number 24 of 2016 concerning Amendments to Government Regulation Number 37 of 1998 concerning Regulations on the Position of Land Deed Officials. This research, namely by examining the Supreme Court Decision Number 3507 K / Pdt / 2023, and the statutory approach to understanding how the law is applied in the concrete situation of the case.

Abstract

Kegiatan ini bertujuan untuk memberikan sosialisasi mengenai perjanjian kontrak kerja kepada siswa SMK BPP Bandung, mengingat pentingnya pemahaman mengenai kontrak kerja sebagai bekal memasuki dunia kerja. Kegiatan ini mencakup penyampaian materi tentang elemen-elemen penting dalam kontrak kerja, seperti hak dan kewajiban tenaga kerja, durasi kerja, sistem pengupahan, serta perlindungan jaminan sosial berdasarkan regulasi ketenagakerjaan yang berlaku, khususnya Undang-Undang Nomor 13 Tahun 2003. Metode yang digunakan dalam kegiatan ini adalah penyuluhan hukum secara interaktif dan partisipatif. Ruang lingkup kegiatan mencakup peningkatan pemahaman hukum dasar kontrak kerja serta kemampuan siswa dalam mengidentifikasi unsur-unsur legal dalam perjanjian kerja. Hasil dari kegiatan menunjukkan peningkatan kesadaran hukum serta kesiapan siswa dalam menghadapi dunia kerja secara lebih bijak dan terinformasi. Sosialisasi ini memberikan manfaat dalam meminimalisir potensi pelanggaran hak pekerja dan memperkuat posisi tawar siswa di dunia kerja.

Abstract

Fenomena perkawinan beda agama masih terjadi di Indonesia hingga saat ini, meskipun dilarang oleh agama. Semua perkawinan yang terjadi di wilayah hukum Indonesia harus dilakukan secara agama. Pasal 8 UUP menyatakan bahwa: “Perkawinan dilarang antara dua orang yang mempunyai hubungan yang oleh agamanya atau peraturan lain yang berlaku, dilarang kawin”. Perkawinan beda agama tidak dapat dipaksakan dan perkawinan beda agama yang dipaksakan adalah ilegal dan melawan hukum. Penelitian ini merupakan jenis penelitian hukum normatif yang bersifat deskriptif analitis dengan berdasarkan pada data sekunder yang dikumpulkan dan dianalisis melalui studi kepustakaan. Hasil penelitian ini menunjukkan bahwa ketentuan Pasal 2 ayat (1) UU Perkawinan seringkali menimbulkan persoalan multitafsir di masyarakat tetapi terkait pencatatannya, Mahkamah Agung melalui Surat Panitera Mahkamah Agung Nomor 231/PAN/HK.05/1/2019 telah memberikan kepastian hukum yang secara tegas menyatakan bahwa perkawinan beda agama tidak diakui oleh negara dan tidak dapat dicatatkan. Akan tetapi, jika perkawinan dilakukan atas dasar agama salah satu pasangan dan pasangan yang lain tunduk pada agama pasangannya dapat didaftarkan.

Abstract

Janji kawin merupakan janji dari seorang laki-laki untuk menikahi kekasihnya ataupun sebaliknya Banyak kasus yang muncul mengenai adanya ingkar janji kawin antara para pihak, sehingga salah satu pihak menggugat pihak lainnya karena merasa dirugikan akibat adanya ingkar janji tersebut. Rumusan masalah yang akan menjadi pembahasan di dalam penulisan ini yaitu mengenai bagaimana pengaturan terkait pengingkaran janji untuk menikahi dalam perspektif hukum perdata. Metode yang digunakan dalam penulisan ini yaitu dengan menggunakan penelitian normatif dengan spesifikasi penelitian preskriptif. Jenis dan teknik pengumpulan data yang digunakan adalah dengan menggunakan studi pustaka dimana penulis mengumpulkan data melalui bahan hukum primer, sekunder, dan tersier. Pendekatan yang digunakan penulis yaitu dengan pendekatan undang-undang (statute approach) dan pendekatan kasus (case approach) serta teknik analisis data secara deduktif. Janji kawin diatur di dalam Pasal 58 Kitab Undang-Undang Hukum Perdata. Mengenai ingkar janji terdapat yurisprudensi Putusan Mahkamah Agung Nomor 3191 K/Pdt/1984 yang memutus bahwa perkara pembatalan perkawinan secara sepihak merupakan perbuatan melawan hukum yang diatur pada Pasal 1365 Kitab Undang-Undang Hukum Perdata.

Abstract

The development of culture in society has various impacts including on social life, such as the rise of interfaith marriages in Indonesia. Generally, interfaith marriages are not common in Indonesian society because marriages in Indonesia are very thick with religious and ethnic rules which often cause conflicts and problems in the family aspect, the Marriage Law also emphasizes that marriage is considered valid, if it is carried out according to each religion or belief that has agreed. As a result of this provision, interfaith marriages are often not allowed because they are not permitted according to religious provisions. In this modern era, interfaith marriages do not yet have special regulations so that there is no clarity on the rules of marriage validity and child inheritance in interfaith marriages. Therefore, this research will conduct a legal review of the granting of a permit for an application for an interfaith marriage. This normative juridical research uses secondary data supported by the results of interviews which will be analyzed qualitatively and described descriptively. The results of this study indicate that the granting of permission for interfaith marriages is not in accordance with the theory of legal certainty because the Marriage Law and KHI do not allow interfaith marriages or if both religions of the bride and groom do not allow it.
