Abstract

This research titled “performance of provincial electoral commission Riau in managing information on the implementation of election of the governor and deputy governor of Riau in the first round of 2013”. Purpose of this study is to know how the performance of provincial electoral commission Riau in managing information on the conduct of elections for governor and deputy governor of Riau. This research uses qualitative descriptive method. Data collected by observation and interview. Of the results of this research is that performance of provincial electoral commission Riau in managing information on the conduct of elections for governor and deputy governor of Riau in the first round of 2013 can be seen through several stages of, management information on the stages of the selection list remains, management information on the stages of registration, verification and determination of the candidate pairs, management of information on the phase of socialization,management of information on the phase of the campaign, management information on the voting stage, management information on the stages of counting and management information on the stages of the determination of the selected pair. of one of these stages still have shortage but what has been done by local election commissions Riau was based on procedures.It is concluded that the performance of local election commissions in Riau in managing information on the conduct of elections for governor and deputy governor of Riau in the first round of 2013 good enough.Key world : Performance, Local Election Commission, Information Management

Abstract

This study examines the implementation of Law No. 14 of 2008 concerning Public Information Openness in the Pariaman City Information and Documentation Management (PPID) Officer and the factors that influence it. The implementation of wisdom in this study uses the Edward III policy implementation model which consists of four variables, namely communication, resources, disposition and bureaucratic structure. The results showed that the Pariaman City PPID in carrying out the mandate of Law 14 of 2008 concerning KIP did not run optimally, although in terms of regulations and implementation guidelines (SOP) already had complete guidelines, information services were still limited to the use of external media in the form of magazines. print and electronic media and the use of government website media that have not been compiled according to the KIP Act. The implementation of the UU KIP has not been optimal due to policy communication related to the promotion of understanding that has not been maximally maximized for PPID members, the availability of human resources and budgetary resources also has an impact on the attitude of the implementing apparatus in carrying out their main tasks and functions. Standard in standardizing the standards applied, but existing SOPs have not been applied in the practice of public information disclosure.

Abstract

ABSTRACTKewenangan diskresi selalu melekat dalam semua jabatan pemerintahan. Kewenangan diskresi juga dimiliki pejabat kepolisian negara Republik Indonesia yang berkedudukan sebagai penyidik ketika akan melakukan penahanan. Wewenang diskresi penyidik dalam melakukan penahanan tersebut diatur dalam Pasal 21 ayat (1) Undang-Undang No.8 Tahun 1981 tentang Kitab Undang-Undang Hukum Acara Pidana.  Dalam praktek, wewenang penyidik tersebut  dapat menyalahgunakan  wewenangnya untuk suatu tujuan yang menyimpang dari maksud dan tujuan pemberian wewenang tersebut kepada penyidik. Sehubungan dengan itu maka permasalahan yang akan dibahas dalam penelitian adalah :1) Apakah perlu dilakukan pembatasan terhadap wewenang penyidik dalam melakukan penahanan? 2) Apa indikator yang perlu diterapkan  untuk mencegah penyimpangan diskresi? Untuk menjawab persoalan di atas, maka penulis melakukan penelitian dengan mengunakan metode penelitian yuridis normative, untuk memperoleh data sekunder melalui wawancara terhadap aparat penegak hukum seperti Hakim, Jaksa, dan Advokat, sedangkan untuk data primer penulis melakukan studi kepustakan dengan mempelajari buku-buku yang berkaitan dengan judul yang diteliti,  serta bahan-bahan lain yang berkaitan. Berdasarkan hasil penelitian dapat penulis simpulkan: Pembatasan wewenang penyidik dalam melakukan penahanan perlu dilakukan, alasannya agar pejabat penyidik yang melakukan penahanan tidak sewenang-wenang.  Kata Kunci: Diskresi, Penahanan, Wewenang Pejabat. ABSTRACT Discretionary powers are inherent in all government positions. Discretionary powers are also held by the state police officers of the Republic of Indonesia who act as investigators when they are about to carry out a detention. Discretion The authority of investigators in carrying out detention is regulated in Article 21 paragraph (1) of Law No.8 of 1981 concerning the Criminal Procedure Code. In practice, the authorized investigator may abuse his / her authority for a purpose which deviates from the aims and objectives given by the authority to the investigator. In connection with that, the problems that will be discussed in the research are: 1) Is it necessary to manage the investigator's authority to carry out detention? 2) What indicators need to be applied to prevent discretionary drift? To answer the above problems, the authors conducted research using the normative juridical research method, to obtain secondary data through interviews with law enforcement officials such as judges, prosecutors, and advocates, while for primary data the authors conducted a library research by studying related books. with the title under study, as well as other related materials. Based on the results of the research, the authors conclude: It is necessary to limit the authority of investigators to carry out detentions, the reason is so that investigating officials who carry out detention are not arbitrary. Keywords: Discretion, Detention, Official Authority.

Abstract

ABSTRAKSalah satu fenomena kelompok yang sedang meresahkan masyarakat Jawa Barat umumnya dan khususnya masyarakat Kabupaten Garut akhir-akhir ini adalah kelompok geng motor. Bahwa perilaku kekerasan yang dilakukan oleh geng motor dikarenakan beberapa faktor yaitu faktor internal yang berasal dari dalam diri si pelaku, misalnya peran keluarga tidak berjalan semestinya dan faktor eksternal yang berasal dari luar diri si pelaku, misalnya pergaulan tempat dimana mereka sering berkumpul dan berkelompok. Untuk itu Kepolisian Resort Garut melakukan upaya-upaya untuk menanggulangi aksi kekerasan yang dilakukan oleh geng motor yang ditempuh dengan tiga cara, yaitu secara preemtif, preventif, dan represif. Upaya preemtif dilakukan dengan membina para anggota geng motor yang kemudian mebuat pernyataan untuk membubarkan diri dari kelompok geng motor, upaya preventif dilakukan dengan cara memberikan penyuluhan hukum kepeda masyarakat dan pelajar SMP dan SMA di Kabupaten Garut dan disamping menyampaikan himbauan-himbauan atau pesan-pesan. Agar tidak terlibat terhadap segala aktifitas kegiatan yang berkaitan dengan berandalan motor baik dengan media indoor, media outdoor, maupun disampaikan secara langsung, sedangkan upaya represif ditempuh dengan di jalankannya Oprasi street Crime berupa razia-razia serta penindakan secara hukum terhadap aksi-aksi kekerasan yang dilakukan oleh geng motor. Oprasi street Crime di Polres Garut masih berlangsung sampai sekarang. Selain itu upaya penanganan terhadap perilaku anarkis dari geng motor memerlukan peran serta dari seluruh elemen masyarakat untuk menekan perilaku anarkis geng motor.Kata kunci : tindak Pidana geng motor, penanggulangan ABSTRACTOne of the phenomena groups that are troubling the general public of West Java and especially the people of Garut Regency lately is the motorcycle gang group. That violent behavior committed by motorcycle gangs is due to several factors, namely internal factors originating from within the perpetrator, for example the role of the family is not working properly and external factors originating from outside the perpetrator, for example the association of places where they often gather and group. For this reason, Garut Resort Police make efforts to tackle acts of violence perpetrated by motorcycle gangs in three ways, namely pre-emptive, preventive, and repressive. Preemptive efforts are carried out by fostering motorcycle gang members who then make statements to disperse themselves from motorcycle gang groups, preventive efforts are carried out by providing legal counsel to the community and junior and senior high school students in Garut Regency and in addition to conveying appeals or messages. In order not to be involved in all activities related to motorcycle delinquency both with indoor media, outdoor media, or delivered directly, while repressive efforts are pursued by carrying out street crime operations in the form of raids and legal action against violent acts carried out by a motorcycle gang. Street Crime operations in Garut Police Station are still ongoing. In addition, efforts to deal with anarchist behavior from motorcycle gangs require the participation of all elements of society to suppress the anarchist behavior of motorcycle gangs.Keywords: Motorcycle gang criminal acts, countermeasures

Abstract

This journal provides an explanation of Green Open Space Regulations, in this lesson the aim is to explain that there are still many cities that do not have proper Green Open Space, therefore in managing Green Open Space a policy management must be implemented to maintain a balance between urban development and environmental preservation along with a perspective from spatial planning law. In the explanation of this journal, there is one example of the implementation of green open space regulation which is still relatively low, namely in the city of Bandung due to an imbalance regarding the human development index which continues to increase. And this journal helps provide in-depth information about the effectiveness of Regional Regulations regarding green open spaces in spatial planning law as well as the impact of green open space development plans on spatial planning in Indonesia. Apart from that, this journal aims to find out about urban areas which are currently a problem that is quite difficult to overcome due to the increasing demand for land. Abstract

The Graha Amarilis inpatient building has high Energy, Water, and material consumption because it operates 24 hours daily. The building’s performance must be evaluated based on green building standards to ensure the sustainability of the building and the environment surrounding it. This study aims to determine the performance of green buildings and optimize the Graha Amarilis inpatient building. A combined strategy of case studies with simulations is used as research methodology. Field surveys and measurements were carried out on research cases and digitally modeled using Autodesk REVIT. Then, building performance analysis calculations are carried out using the EDGE Building application simulation method, which presents data on green rating of Energy, Water, and Material saving in buildings. The results of this study were obtained on energy and water items that had not reached green building rating in EDGE Building by 20%. So, optimizing energy items at points EEM 18, EEM 07, and EEM 33 and Water at points WEM 01, WEM 02, WEM 14, and WEM 15 is necessary. Finally, after several simulations on that item, Energy saving consumption becomes 20.07 %, Water 34.69%, and Material 23.00%. With these adjustments, the Graha Amarilis inpatient Building can reach the green building standards and become more sustainable and environmentally friendly

Abstract

AbstractThis study aims to ensure public welfare by granting the state administration the freedom to act independently within its authority. Such freedom becomes crucial, especially when addressing issues that require solutions not explicitly stated in existing laws and regulations, or when governance proves inadequate or unclear. The primary goal of this research is to hold the government accountable for its reasonable actions while providing a warning against potential abuses of power. The research adopts a normative legal method with a common law system approach, utilizing secondary data from primary legal books, secondary legal books, and tertiary legal documents. The study addresses problems related to various forms of power misuse, including government officials acting under the guise of their institutions for personal gain. The findings reveal that Law No. 30 of 2014 on Government Administration provides a framework for government officials to tackle issues encountered in administrative governance while maintaining principles of accountability and transparency. In conclusion, the state administrative court plays a vital role in resolving administrative disputes arising from government actions and decisions. Legal enforcement through this court aims to ensure that government decisions do not harm specific individuals or entities while preserving integrity and accountability in the decision-making process. Keywords: Common Sense, Legal Products, People.
