Abstract

This article explains the mechanism for selecting government and state leaders according to Abu Hassan al-Mawardi's benefit theory. According to al-Mawardi, Islamic teachings require legal norms that are closely related to political and constitutional issues. Based on the interpretation of QS Ali Imran verse 59, al-Mawardi reconstructs the meaning of Ulil Amri as the political representation of the people in the state power system. According to him, Ulil Amri is a group of selected people from various circles, namely soldiers, ulama, scientists, and so on who have an important key in the political decision-making process. The interesting thing about al-Mawardi's thinking is that he emphasizes the political consensus side (ijma fi fiqh al-siyasi) in the process of making political decisions, one of which is used in choosing government and state leaders.

Abstract

This article examines the construction of the Indonesian legal system through the theoretical lens of maṣlaḥah mursalah, an Islamic legal principle centered on public interest and benefit. The study contributes to the expansion of Islamic legal scholarship within the realm of legal politics in Indonesia. Employing a normative legal research method, it integrates conceptual, historical, and statutory approaches to examine the relevance and application of maṣlaḥah mursalah in the national legal framework. The findings indicate that maṣlaḥah mursalah can serve as a foundational legal theory for constructing a just legal system, especially one that aligns with societal needs and promotes the common good. The Indonesian legal system's development, when viewed through the prism of maṣlaḥah mursalah, reveals two key dimensions: first, the legal construction rooted in the Pancasila-based system as constitutionally mandated by the 1945 Constitution, and second, the partial institutionalization of Islamic law within the national legal order. This dual structure reflects Indonesia's efforts to harmonize religious values with national legal development, offering a model for integrating Islamic jurisprudence with modern state law.

Abstract

Goldziher, seorang orientalis barat yang memiliki pandangan bahwa praktik dan tradisi yang dikenal sebagai sunnah Nabi Muhammad SAW sebenarnya berasal dari adat istiadat masyarakat Arab pra-Islam yang kemudian diserap ke dalam ajaran Islam. Kebiasaan-kebiasaan ini, seiring waktu, menjadi bagian integral dari kehidupan umat Islam secara luas. Namun, ketika masyarakat Muslim pada abad kedua Hijriyah mulai mengklaim bahwa tradisi-tradisi ini adalah contoh langsung dari Nabi Muhammad SAW, Goldziher merasa ragu dan kesulitan untuk menerima hadis sebagai catatan otentik dari kehidupan Nabi. Penelitian ini menggunakan metode kualitatif-deskriptif dengan pendekatan analisis literatur terhadap karya-karya Ignaz Goldziher yang mengkritik literatur hadis. Selain itu, metode historis (historical method) juga diterapkan untuk memahami pemikiran Goldziher dalam fase-fase perkembangan intelektualnya. Pendekatan ini memungkinkan peneliti untuk mengkaji secara mendalam argumen-argumen Goldziher dan konteks di baliknya. Hasil penelitian menyimpulkan bahwa pemikiran Goldziher cenderung skeptis terhadap otentisitas hadis. Meskipun ia mengakui bahwa praktik keagamaan umat Islam didasarkan pada hadis Nabi, ia tetap meragukan keotentikannya sampai terbukti benar-benar berasal dari Nabi. Keraguan Goldziher ini bahkan didukung dan dikembangkan oleh orientalis lain seperti Joseph Schacht. Dua poin utama yang ditekankan Goldziher adalah masalah titik awal kodifikasi hadis dan peran Imam al-Zuhri

Abstract

The MUI's fatwa in the Second National Deliberation on May 26 – June 1, 1980, on Mixed Marriage stipulates that "the marriage of a Muslim woman with a non-Muslim man is unlawful; A Muslim man is forbidden to marry a non-Muslim woman. The research method used is the descriptive method of content analytics, or document analysis techniques, or content analysis by collecting information and views, analysis of interpretations and opinions, in manuscripts, literature, or books of interpretation. The result found that the interpretation of the verses of the Qur'an that stipulates the law prohibiting marriage between Muslims and non-Muslims is the interpretation of Sura al-Baqarah verse 221 which stipulates that Muslims are prohibited from marrying non-Muslims and reveals that Ahl al-Kitab women are allowed to be married by Muslim men. And also, the interpretation of sura al-Mumtahanah verse 10, and sura al-Tawbah verses 30-31, and reinforced by other narrations, which implies that the legal provisions of marriage between Muslims and non-Muslims are haram, including the law of marriage between a Muslim man and a woman Ahl al-Kitab is haram.
