Abstract

 In 2019, the Constitutional Court Decision Number 18 / PUU-XVII / 2019 has been issued which interprets that default cannot be determined unilaterally by creditors. This decision also stipulates that the collateral object cannot be executed directly, even though it has a fiduciary guarantee certificate. The formulation of the problem in writing this thesis is how the executorial power of the fiduciary guarantee object after the Constitutional Court Decision Number 18 / PUU-XVII / 2019 and what are the legal consequences for creditors after the Constitutional Court Decision Number 18 / PUU-XVII / 2019. The research results from the writing of this thesis are that the executorial power on fiduciary guarantees after the issuance of the Constitutional Court Decision Number 18/2019 remains inherent and as strong as a court decision which has permanent legal force, as long as there is an agreement between the debtor as the fiduciary and the creditor as the fiduciary recipient that There has been a breach of contract, and the debtor submits the object of fiduciary security voluntarily and the creditor as the recipient of the fiduciary can still be executed by the creditor as the fiduciary recipient as long as it has been promised from the beginning regarding the default clause.

Abstract

This paper is motivated by the existence of new innovations in the world of capital markets and banking, namely an investment sukuk (state sharia securities) which is a bond investment based on sharia principles that can be issued by companies or governments. Sukuk investment is issued to finance the state budget, including the construction of a project. There are various types of sukuk investments because the contracts used when investing also vary. Every investment will certainly cause losses for the parties, so this will also be a loss for every investor who makes an investment, as well as sukuk investment, investors can also experience the risk of loss. Losses that can be experienced by each investor are different due to the different contracts in investing in sukuk. Loss experienced by investors is caused by negligence on the part of the management (company) then the company must be responsible for losses incurred due to negligence, the extent to which the company's responsibility depends on how much negligence the company did to cause losses to investors.How to cite item: Mochtar, D., Rahayu, D. Abstract

The principle of equilibrium contains a hope of achieving equilibrium included in an agreement or business contract, where the interests of the individual are guaranteed by objective law, in carrying out the agreement there must be a balance of rights and obligations of each party in accordance with the agreement. So far the implementation of factoring agreement refers to article 1338 of the Civil Code following the principle of freedom to make a contract, and if there are problems arising from this institution, legal settlement is possible through a court or through arbitration. It depends on the agreement made by the parties involved. The results showed that the nature of the legal relationship between factor and client is the nature of the legal relationship in the form of a loan agreement, and the fact that the principle of balance does not apply to factoring agreements, this is due to the format and content of the agreement unilaterally determined by factoring , and cannot be negotiated again by the debtor. As a result, the debtor's position is very weak compared to the creditor's position. To realize the principle of balance requires efforts from the government in the form of laws governing the basic rules that must be considered by the parties who wish to enter into factoring agreements.How to cite item: Mochtar, D. Abstract

Legality for tax officers to know customer data, without having to get approval from Bank Indonesia, enough through the approval of the Minister of Finance is regulated by Law Number 9 of 2017 concerning Access to financial information for tax purposes. This research examines how the regulation regarding customer data information at financial institutions after the issuance of Law Number 9 of 2017 concerning Access to Financial Information for Taxation Purposes and how is legal certainty regarding bank secrecy after the issuance of Law Number 9 of 2017 concerning Access to Financial Information for Purposes Taxation. This study uses a normative juridical approach. This approach focuses on examining laws and regulations concerning confidential customer data information as well as book material in the form of books and other legal journals related to these issues. The result of this research is that after the issuance of Law Number 9 of 2017 concerning Access to Financial Information for tax purposes, the taxation authorities have full authority and authority in accessing each customer’s data from banks and the principle of bank secrecy related to customer data protectionafter the issuance of Law Number 9 of 2017 concerning Access to Financial Information for Taxation Purposes is still ongoing and applies as long as it is outside of what is stipulated in the law.

Abstract

This study aims to find out how the implementation of article 65 paragraph 1 of Law No.32 of 2009 and the legal protection of people affected by sand removal in Lumajang Regency. Based on the law adjusted to the experience that occurs in the community to better know and understand the law as a set of rules or positive norms that apply. That the Lumajang District community has a legal protection. But unfortunately, this regulation is not used as a reference for the government in managing the resources contained in Lumajang regency in the form of sand mining assets. In general, the existence of mining will result in losses both in the environment and for the people who live around the mining area. Abstract

This study discusses the legal protection of consumer personal data in e-commerce transactions and the regulation of consumer personal data in e-commerce transactions. The method used in this research is normative legal research with a statute approach and a conceptual approach. The results show that the protection of personal data as part of privacy is a human right. This recognition is reflected in both the constitution and various regulations at the level of laws. However, no specific regulations are governing the protection of personal data at the statutory level. In Indonesia, there are no regulations on personal data in e-commerce transactions. This problem is only regulated in Article 26 of the ITE Law and several other articles. Legal protection for consumers in e-commerce transactions is needed to facilitate online consumer transactions. The goal is to enforce all transactions in the same way regardless of the medium selected. AbstraksPenelitian ini membahas tentang perlindungan hukum terhadap data pribadi konsumen dalam transaksi e-commerce dan pengaturan terhadap data pribadi konsumen dalam transaksi e-commerce. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan pendekatan statute approach dan conceptual approach. Hasil menunjukkan bahwa perlindungan data pribadi sebagai bagian dari privasi merupakan hak asasi manusia. Pengakuan tersebut terefleksi, baik dalam konstitusi maupun beragam peraturan selevel undang-undang. Namun demikian, peraturan yang khusus mengatur mengenai perlindungan data pribadi pada level undang-undang belum dimiliki. Di Indonesia belum mempunyai peraturan terhadap data pribadi dalam transaksi e-commerce. Masalah ini hanya diatur dalam Pasal 26 UU ITE dan beberapa pasal lainnya. Perlindungan hukum bagi konsumen dalam transaksi e-commerce dibutuhkan untuk menfasilitasi transaksi konsumen secara online. Abstract

Di era saat ini untuk bisa memenangkan persaingan seorang siswa tidak hanya harus pintar dalam ilmu, namun juga harus ditunjang berbagai ketrampilan baik softskill maupun hardskill. Dengan softskill dan hardskill yang mumpuni seorang siswa setelah lulus pendidikan dasar tidak harus bekerja pada orang lain, namun bisa menciptakan lapangan pekerjaan bagi diri sendiri maupun orang lain, pendidikan dasar menjadi sesuatu yang memandirikan anak didik, terutama bagi kelompok miskin, anak didik akan menjadi mandiri ketika mereka dibekali keterampilan serta dekat dengan alam dan budayanya. Secara softskill siswa Al Azhar telah banyak menerima pendidikan dari sekolah, namun secara hardskill masih minim dikarenakan fasilitas sekolah yang belum memadai. Dengan melihat latar belakang keluarga siswa kebanyakan pedagang maka pelatihan ketrampilan tata boga ini sangat cocok dilakukan dengan harapan hasil pelatihan bisa diterapkan siswa dan hasilnya bisa dijual orang tua mereka. Sehingga nantinya ketika mereka lulus dan tidak meneruskan pendidikan ke jenjang yang lebih tinggi mereka bisa menciptakan pekerjaan bagi dirinya dan memberikan penghasilan bagi dirinya. DOI: https://doi.org/10.26905/abdimas.v2i1.1288

Abstract

The purpose of marriage according to Article 1 of Law Number 1 of 1974 is to createa happy family and to have children. However, there are some married couples whoare not blessed with children due to several factors. This is the background of theresearch entitled Rights and Status of Inheritance for Adopted Children. The problemis discussing how the rights and position of inheritance for adopted children and howthe distribution of inheritance for adopted children. The method used is normativejuridical, namely research that is produced from library materials that have beenstudied, both sources obtained from books, journals, laws and regulations concernedwith the discussion of the issues raised. The results of this study are that adoptedchildren have the same rights and position as legitimate children in certain matters,but in terms of inheritance, adopted children have 1/3 rights in the form of grants. Inaddition to grants, adopted children can get assets left by the heir, if the heir has made a will before he dies.

Abstract

Most binary options operators operate via internet-based platforms without complying with existing regulations in Indonesia. The problem discussed in this research is whether binary options are included in trading regulated in the Commodity Futures Law and legal protection for investors in binary options. This research uses normative legal research with a statutory approach. The results of this research are that Binary Options cannot meet the criteria as a commodity as regulated in Law Number 10 of 2011 concerning Amendments to Law Number 32 of 1997 concerning Commodity Futures Trading. This can be seen in the indicators listed in Article 1 number 2 of the Commodity Futures Trading Law

Abstract

In the Linkage product, banks provide facilities for BPR (Rural Banks) to obtain credit facilities of significant amounts to ensure smooth operations and productive capital for debtors in need. Additionally, the guarantees used are in the form of Asset Replacement or Nominative Performing Loans. The list of Nominative Performing Loans provided by BPR includes the names of borrowing debtors, personal data of the BPR debtors, including identification numbers, addresses, telephone numbers, account numbers at the BPR, and the credit limits utilized. This creates legal issues in the event of default regarding loans that are not secured by valuable assets. This research is conducted using a normative legal approach, where the author will delve into positive legal norms and other legal literature. The research questions raised are: What is the process of credit agreements under the Linkage scheme with Asset Replacement or Nominative Performing Loan collateral and how is the resolution process for defaulting debtors under the Linkage scheme with Asset Replacement or Nominative Performing Loan collateral. The research findings indicate that the credit agreement process under the Linkage scheme with Asset Replacement or Nominative Performing Loan collateral is valid in contractual law, as it meets the validity requirements stipulated in Article 1320 of the Civil Code. Furthermore, the resolution process is carried out through judicial procedures, namely by filing a default lawsuit accompanied by a request for asset seizure against the debtor's property, as regulated in Article 1131 of the Civil Code.
