Abstract

The rights and obligations in the world of labor have been regulated in the labor law, including the right of association which must be given to every worker to associate as stated in Law Number 21 of 2000 concerning Trade Unions / Labor Unions Article 28 and Article 43. In addition, problems arise when the Indonesian National Police Headquarters on behalf of the Indonesian National Police Chief through the Head of the Security Maintenance Agency issues Circular Letter Number; B/194/I/201/Baharkam concerning: Security Guards are Not Members of Trade Unions. In Article 5 of the Circular, it is stated that "in this regard, the security guard is not a member of a trade union and is not allowed to become a member of a trade union organization". Related to this, the writer will discuss about the position of the Security Unit in the perspective of human rights according to the 1945 Constitution of the Republic of Indonesia and how the protection of the right of association for the security unit in the perspective of human rights according to the 1945 Constitution of the Republic of Indonesia. The writing method that the author uses in writing this article is empirical normative, comparing a rule with the situation in the field related to the prohibition for the security unit to associate. The results of the research in this paper are that the regulation of freedom of association rights has two main objectives to be achieved, firstly human rights must be protected as basic rights, secondly there must be guarantees that the rights and freedoms of others can be carried out properly and a form of legal protection against workers in this case the security unit is an effort to fulfill human rights, where one of the important aspects of the application of a rule of law is law enforcement. A new legal instrument is said to be effective if the law can be implemented with sanctions and can be enforced if the law violates it.Keywords: Security Unit, Freedom of Association, Legal Protection

Abstract

Seiring dengan perkembangan zaman dan teknologi muncul hal-hal baru dalam hukum kebendaan, yaitu virtual property. Virtual property adalah salah satu wujud perkembangan dalam hukum benda yang ada di dunia maya melalui koneksi internet. Meskipun dalam undang-undang telah ditetapkan tentang syarat-syarat sahnya suatu perjanjian yang harus dipenuhi, akan tetapi dalam praktek kadang-kadang terjadi suatu perjanjian jual beli dimana jika dilihat sudut aspek hukumnya dapat dipandang bahwa perjanjian dimaksud menyimpang atau tidak memenuhi syarat sahnya suatu perjanjian yang ditetapkan dalam pasal 1320 KUH Per. Hal ini membuat banyak masalah kepada para pemain yang melakukan transaksi melalui fitur trade. Adanya transaksi ini dapat menimbulkan anonimitas dalam melakukan transaksi sehingga melanggar syarat sahnya dalam melakukan perjanjian. Dengan permasalahan tersebut muncul sebuah pertanyaan: Bagaimanakah keabsahan perjanjian jual beli virtual property dalam game online berdasarkan KUH Perdata? Bagaimanakah akibat hukum dari anonimitas dalam perjanjian jual beli virtual property dalam game online berdasarkan KUHPer? Penelitian ini menggunakan metode pendekatan yuridis normatif. Data penelitian ini dikumpulkan dengan studi kepustakaan dan wawancara dengan para pemain game online yang merasakan akibat dari anonimitas serta analisis data yang digunakan dalam penelitian ini adalah kualitatif. Hasil penelitian ini Jika terpenuhinya dari unsur-unsur syarat sahnya dalam melakukan perjanjian, maka perjanjian virtual property dalam game online ini dapat dikatakan sah dalam hal melakukan perjanjian antara kedua belah pihak. Namun dalam perjanjian ini dapat terjadi tidak memenuhi syarat subjektif dalam perjanjian khususnya pada kecakapan. Akibat hukum dengan adanya anonimitas dalam perjanjian jual beli virtual property dalam game online, menggambarkan bahwa adanya salah satu syarat subjektif yang tidak terpenuhi, maka perjanjian itu dapat dibatalkan (voidable). Apabila syarat subjektif dalam pasal 1320 KUH Perdata tidak terpenuhi. Selama perjanjian belum dibatalkan secara hukum oleh hakim, perjanjian tetap mengikat kedua belah pihak. Dengan dapat dibatalkannya perjanjian  ini mempunyai kelemahan terhadap pembatalannya seperti, jika salah satu pihak melakukan wansprestasi dalam perjanjian ini pihak yang dapat digugat tidak jelas, serta apabila pihak yang dirugikan akan mendapatkan pembebasan jaminan.

Abstract

Praktik share in jar pengemasan ulang kosmetik ke wadah lebih kecil semakin marak di Indonesia, terutama pada produk premium, didorong keinginan konsumen akan harga terjangkau dan kesempatan mencoba produk sebelum membeli ukuran penuh. Praktik ini menimbulkan ketidakpastian hukum, karena produk dipindahkan dari kemasan asli bersertifikat tanpa jaminan higienitas, informasi kedaluwarsa akurat, maupun label PAO. Penelitian ini mengkaji perlindungan hukum bagi pemilik merek kosmetik terhadap praktik share in jar serta tanggung jawab hukum pelaku usahanya. Menggunakan pendekatan yuridis normatif (kualitatif) dengan bahan hukum primer, sekunder, tersier, diperkuat wawancara dengan pemilik merek LT Pro, konsumen terdampak, BPOM, dan DJKI. Hasil menunjukkan praktik ini berpotensi melanggar hak merek, standar keamanan kosmetik, dan hak informasi konsumen, sehingga pelaku usaha dapat dimintai pertanggungjawaban perdata maupun pidana berdasarkan prinsip tanggung jawab atas kesalahan, Pasal 1365 KUHPerdata, UU Merek, dan UU Perlindungan Konsumen. Penelitian menyimpulkan bahwa kombinasi upaya preventif (seperti kemasan resmi kecil) dan penegakan hukum represif menjadi kunci melindungi pemilik merek sekaligus konsumen.

Abstract

Copyright protection is a legal mechanism that safeguards creators' exclusive and economic rights over their intellectual works. The dispute between Ari Bias and Agnez Mo regarding the commercial performance of the song Bilang Saja generated significant legal debate after the Supreme Court, through Decision Number 825 K/Pdt.Sus-HKI/2025, overturned the Commercial Court Decision Number 92/Pdt.Sus-HKI/2024/PN Niaga Jkt.Pst. This study aims to examine the conformity of the Supreme Court's decision with Law Number 28 of 2014 on Copyright and to analyze the legal consequences arising from the differing judicial interpretations. The research employed a normative-empirical method using statutory and case approaches, supported by interviews with the songwriter, the National Collective Management Organization, and the Directorate General of Intellectual Property. Primary and secondary data were analyzed qualitatively. The findings indicate that the Supreme Court's decision is only partially consistent with the Copyright Law because it emphasizes royalty payment obligations while providing insufficient protection for the creator's exclusive right to authorize the commercial use of copyrighted works. The conflicting judicial decisions also create legal uncertainty regarding the party responsible for obtaining permission and paying royalties for commercial performances. Therefore, harmonization of legal interpretation and strengthening of regulations governing licensing and royalty mechanisms are essential to ensure legal certainty, effective copyright protection, and justice for song creators in Indonesia.

Abstract

The commercialization of English Premier League live broadcasts through public viewing activities in cafés without a license has become increasingly common and raises legal issues concerning the protection of broadcasting rights. This study aims to analyze the legal protection provided to PT EMTEK Tbk as the exclusive broadcasting rights holder of the English Premier League in Indonesia against unauthorized commercial public viewing activities in cafés in South Jakarta, as well as the legal consequences arising from such violations. This research employed a normative juridical method supported by empirical data obtained through interviews with representatives of PT EMTEK Tbk, the Directorate General of Intellectual Property (DJKI), café owners, and café customers. The findings indicate that preventive legal protection has been implemented through a licensing mechanism, while efforts to disseminate information and increase legal awareness among small business owners remain limited. Repressive legal protection is legally available through civil remedies, criminal sanctions, and dispute resolution mechanisms; however, their implementation is still constrained by the complaint-based nature of copyright offenses and limited enforcement capacity. The legal consequences of unauthorized commercial public viewing are normatively regulated under the Copyright Law and the Broadcasting Law, although their application in practice has not yet been carried out consistently in the cafés examined in this study.
