Abstract

Indonesia has issued a fisheries subsidy policy to encourage the development of the fishing industry because this sector contributes to national development, but the subsidies applied must be in accordance with the provisions stipulated in the WTO. Indonesia is a member of the WTO and in the last few meetings held by the WTO in which the WTO prohibits subsidies, besides that fisheries subsidies can cause depletion of fish stocks and damage to marine biota. This is not in line with the UN program, namely Sustainable Development related to sustainable fisheries, so the implementation of fisheries subsidy policies can cause problems. the 12th WTO ministerial conference, a draft was drafted, but until now the draft has not been ratified, the draft fisheries subsidies at the WTO specifically regulate fisheries subsidies that are prohibited and exceptions in general. the 13th Ministerial Conference 2024 has not yet concluded negotiations on agricultural and fisheries subsidy issues, which remain key concerns for the conference organizers. Trade or Economic Ministers of the WTO engaged in negotiations are aware of the significant differences in positions among member states, necessitating further time for additional negotiations to be continued by permanent delegations in Geneva. The impact of the draft WTO fisheries subsidy, if successfully ratified, will have a negative impact on Indonesia in terms of the fishery market, fishery resources and employment.

Abstract

Sengketa antara Hasan Azhari dan PT Gojek Tokopedia menyoroti pentingnya pemahaman tentang validitas klaim hak cipta atas metode bisnis di Indonesia. Penelitian ini bertujuan untuk menganalisis klaim tersebut berdasarkan hukum hak cipta Indonesia, yang hanya melindungi ekspresi ide yang terwujud dalam bentuk konkret dan bukan ide atau konsep bisnis. Dalam kasus ini, metode bisnis yang diklaim oleh Hasan Azhari, yang lebih bersifat abstrak dan belum diwujudkan dalam bentuk nyata, tidak memenuhi kriteria untuk dilindungi oleh hak cipta. Selain itu, penelitian ini juga mengeksplorasi bukti dan dasar hukum yang menjadi pertimbangan Mahkamah Agung dalam memutuskan perkara No. 1033 K/Pdt.Sus-HKI/2023, yang didasarkan pada pengertian hak cipta yang membedakan antara ide dan ekspresi. Mahkamah Agung menolak klaim hak cipta atas metode bisnis tersebut karena tidak memenuhi persyaratan perlindungan hak cipta, yang lebih tepat untuk dilindungi melalui hak paten atau rahasia dagang. Hasil penelitian menunjukkan bahwa meskipun terdapat kerangka hukum yang cukup jelas, masih terdapat kesenjangan dalam penerapan hukum yang memerlukan pemahaman lebih lanjut mengenai batasan perlindungan hak cipta terhadap konsep atau metode bisnis.

Abstract

This study aims to analyze the legal responsibility of PT. Gojek Indonesia regarding the mismatch of driver identity in the Go-Send delivery service in Serang City, based on Law Number 8 of 1999 concerning Consumer Protection. The main issue examined is the loss or non-delivery of goods due to drivers whose identities do not match the information displayed in the application. The research employs an empirical juridical approach, collecting primary data through interviews and secondary data through literature studies. The findings reveal that PT. Gojek holds legal liability to compensate consumers for their losses, either in the form of money or equivalent goods, as stipulated under consumer protection regulations. However, in practice, the dispute resolution process has not been effective, as consumers have not yet received clear compensation. Consequently, some consumers have escalated the matter to consumer protection agencies. The study concludes that PT. Gojek must improve identity verification procedures for its drivers and enhance the dissemination of information regarding claim mechanisms to users. Additionally, it is recommended to implement a mandatory-read agreement feature to ensure that consumers understand their rights. These efforts are expected to strengthen consumer trust and the overall credibility of Go-Send services.
