Abstract

Inheritance distribution is a crucial issue in Islamic family law, deeply rooted in custom and culture. The Minangkabau community recognizes inheritance, known as pusako tinggi, which cannot be transferred. Selling it means the loss of community wealth, resulting in the loss of Sako and Pusako. This study aims to explore the philosophy of pusako tinggi in Minangkabau and the context of its relevance. This study uses empirical legal methods with a philosophical and customary law approach. The study was conducted at the Syekh Ahmad Khatib Al-Minangkabawi Foundation in the village of Koto Tuo Balai Gurah. The selection of Koto Tuo was based on Minangkabau customs, namely salingka nagari (customs limited to one place). Data were collected through interviews and documentation. Interviews were conducted with representatives of parties who contributed to pusako tinggi. The documents described are books, articles, research reports, and all documents related to the discussion. This research applies empirical legal methods with a philosophical and customary law approach. The research was conducted at the Syekh Ahmad Khatib Al-Minangkabawi Foundation in the Koto Tuo Balai Gurah village. The research was conducted at the Sheikh Ahmad Khatib Al-Minangkabawi Foundation in Koto Tuo kenagarian Balai Gurah. The selection of Koto Tuo is based on the custom in Minangkabau of salingka nagari (customs are limited to one place).  This study found that the land is not a mere symbol but represents the existence and dignity of the civilised Minangkabau society. Pusako tinggi in Minangkabau community consensus can be transferred when dealing with crucial customary and religious interests. This also does not contradict the principle of the relationship between Islamic law and custom, but this reality shows that the Minangkabau people adhere to custom and religion.

Abstract

The Minangkabau people are deeply committed to preserving their customs and culture, which are based on Islamic law, one of which is manifested through the Gadang house. However, the function and meaning of the Gadang house are gradually declining, which naturally affects the continued survival as a symbol and philosophy of the Minangkabau Muslim community. This is field research with a qualitative method. Primary data was obtained from interviews, observation, and documentation. The secondary sources referred to books, journals, and other documents. This research found that Gadang house, which is preserved from generation to generation, combines Islamic values and the life philosophy of the Minangkabau community. From the architectural aspect of the building, the gadang houses in Sarugo village are arranged in rows like prayer lines, all facing toward the mosque. Besides, various Islamic activities, such as weekly dhikr activities, khatam Qur'an for elementary schoolers, events for the maulid nabi, commemoration of Isra' Mikraj, and active recitation of Surah Yasin (yasinan). Correspondingly, the activities of the Batagak Pangulu, wedding ceremonies, and death funerals are held according to Islamic law and customs. Masyarakat Minangkabau memiliki komitmen yang tinggi dalam melestarikan adat dan budaya yang berlandaskan syariat Islam. Salah satunya dimanifestasikan melalui keberadaan rumah Gadang. Namun, fungsi dan makna rumah Gadang saat ini terus mengalami penyusutan, hal tersebut tentu berdampak pada eksistensi rumah gadang sebagai simbol dan filosofi masyarakat Muslim Minangkabau. Jenis penelitian ini field research dengan metode yang digunakan kualitatif. Sumber data primer diperoleh dari wawancara, observasi dan dokumentasi. Sumber sekunder penelitian ini merujuk kepada buku, jurnal, dan lain sebagainya. Penelitian ini menemukan keberadaan rumah Gadang yang dipelihara secara turun temurun yang memadukan nilai-nilai Islam dan falsafah hidup masyarakat Minangkabau. Pertama, dari aspek arsitektur bangunannya. Rumah Gadang di kampung Sarugo disusun bershaf-shaf seperti shaf dalam shalat yang semuanya menghadap ke arah masjid. Kedua, berbagai kegiatan keislaman seperti kegiatan mingguan wirid pengajian, khatam Qur`an untuk anak-anak tingkat SD, acara maulid nabi, peringatan Isra’ Mikraj, serta yasinan. Demikian juga dengan kegiatan batagak pangulu, pernikahan, serta kematian diselenggarakan sesuai syariat Islam dan adat.

Abstract

This study examines Al-Akhlāq Lilbanāt by Sheikh ‘Umar bin Ahmad Baraja’, a key reference in the moral education curriculum of many Islamic boarding schools in Indonesia. The main problem identified is the use of hadiths presented only in matan form without clear references to primary hadith sources, raising questions about their authenticity and methodological accuracy. The research aims to evaluate the validity of these hadiths through analysis of citation, writing accuracy, and consistency of meaning compared to reputable hadith compilations. Using a comparative thematic analysis, the study finds that Sheikh ‘Umar prioritizes pedagogical and moral dimensions over strict methodological precision in transmission. Although references are often missing, the meanings of the hadiths remain consistent with authoritative sources. The findings suggest that the book’s educational impact is strengthened by its contextual relevance, yet it would benefit from annotated editions that include verified hadith sources to enhance scholarly reliability.

Abstract

The Day of Judgment is a very frightening event for all humans. The events that occurred on that day are very much explained in the Qur'an, but this study will examine the events of the Day of Judgment according to the interpretation of Salman ITB and Tafsir Ilmi Kemenag RI-LIPI. The two books of interpretation have a scientific approach, but in terms of their authors, the background is different, the book of interpretation of Salman ITB is the work of ITB alumni in the field of science, while the book of Tafsir Ilmi Kemenag RI-LIPI has a background of scholars. This study will discuss the interpretation of the events of the Day of Judgment according to the interpretations of Salman ITB and Tafsir Ilmi Kemenag RI-LIPI using an integration approach. The results of this study can be concluded, that the doomsday events that occur on earth (Earth, Mountains and Seas) in the book of Tafsir Salman ITB explain more related to science than the interpretation in the book of Tafsir Ilmi Kemenag RI-LIPI. The integration pattern used by Tafsir Salman ITB tends to be a dialogue pattern. While the interpretation of doomsday events that occur in the sky (sky, sun, moon and stars) the two interpretations look balanced, but in their integration, the interpretation of the book of Tafsir Ilmi Kemenag RI-LIPI tends to see the pattern of integration and the interpretation of Salman ITB looks more using the pattern dialog.

Abstract

This paper discusses the historical approach in Muhammad Arkoun's thinking. It aims to reveal and analyze the historical approach in Muhammad Arkoun's thinking and explain its relevance to the development of contemporary Islamic Civilization History studies. This research stems from concerns about the normative and apologetic tendencies in Islamic historical writing, which necessitate a more contextual and rational critical reading. It uses a qualitative method based on literature study, specifically library research. Data was collected through searching primary and secondary sources in the form of Muhammad Arkoun's works, books, scientific articles, and relevant academic writings. Data analysis was carried out through content analysis in three stages: (1) data reduction, namely selecting and classifying the main concepts in Arkoun's thinking; (2) data presentation, by describing the findings in accordance with the frameworks of historicity, deconstruction, and interdisciplinary approaches; and (3) drawing conclusions, to assess the relevance of Arkoun's thoughts to the study of contemporary Islamic Civilization History. The results of the study show that Arkoun's thinking produced five important findings. First, the concept of textual historicity offers a new paradigm in reading Islam as an evolving socio-cultural construct, rather than a frozen dogma. Second, the deconstruction of classical Islamic historiography opens up space for criticism of ideological historical narratives and opens up opportunities for alternative historical writing from the perspective of marginalized groups. Third, Arkoun integrates the humanities—such as anthropology, linguistics, and philosophy—as the basis for an interdisciplinary approach to the study of Islam. Fourth, his thinking provides a new methodological model for education and research in Islamic Civilization History, namely Islamic history as a reflective discourse that interprets the social and cultural dynamics of the ummah. Fifth, Arkoun's historical approach became an instrument of religious reasoning reform, encouraging a transformation from closed reasoning (la raison close) to open reasoning (la raison ouverte) that is rational, dialogical, and contextual. Thus, the historical approach in Arkoun's thinking is not only a critique of classical Islamic historiography, but also provides a new direction for epistemological, methodological, and paradigmatic renewal in the development of Islamic Civilization History studies in the modern era. Tulisan ini membahas pendekatan sejarah dalam pemikiran Muhammad Arkoun. Tulisan ini bertujuan untuk mengungkap dan menganalisis pendekatan sejarah dalam pemikiran Muhammad Arkoun serta menjelaskan relevansinya bagi pengembangan studi Sejarah Peradaban Islam kontemporer. Penelitian ini berangkat dari kegelisahan atas kecenderungan penulisan sejarah Islam yang normatif dan apologetik, sehingga diperlukan pembacaan kritis yang lebih kontekstual dan rasional. Melalui metode kualitatif berbasis studi literatur, jenis penelitian kepustakaan (library research). Data dikumpulkan melalui penelusuran sumber-sumber primer dan sekunder berupa karya-karya Muhammad Arkoun, buku, artikel ilmiah, dan tulisan-tulisan akademik yang relevan. Analisis data dilakukan melalui analisis isi (content analysis) dengan tiga tahap: (1) reduksi data, yakni memilih dan mengklasifikasi konsep-konsep utama dalam pemikiran Arkoun; (2) penyajian data, dengan menguraikan temuan sesuai kerangka historisitas, dekonstruksi, dan pendekatan interdisipliner; dan (3) penarikan kesimpulan, untuk menilai relevansi pemikiran Arkoun terhadap studi Sejarah Peradaban Islam kontemporer. Hasil kajian menunjukkan bahwa pemikiran Arkoun menghasilkan lima temuan penting. Pertama, konsep historisitas teks menawarkan paradigma baru dalam membaca Islam sebagai konstruksi sosial-budaya yang terus berkembang, bukan dogma yang beku. Kedua, dekonstruksi historiografi Islam klasik membuka ruang kritik terhadap narasi sejarah yang ideologis dan membuka peluang penulisan sejarah alternatif dari perspektif kelompok terpinggirkan. Ketiga, Arkoun mengintegrasikan ilmu-ilmu humaniora—seperti antropologi, linguistik, dan filsafat—sebagai landasan pendekatan interdisipliner dalam studi Islam. Keempat, pemikirannya menyediakan model metodologis baru bagi pendidikan dan riset Sejarah Peradaban Islam, yaitu sejarah Islam sebagai wacana reflektif yang menafsirkan dinamika sosial dan budaya umat. Kelima, pendekatan historis Arkoun menjadi instrumen reformasi nalar keagamaan, mendorong transformasi dari nalar tertutup (la raison close) menuju nalar terbuka (la raison ouverte) yang rasional, dialogis, dan kontekstual. Dengan demikian, pendekatan sejarah dalam pemikiran Arkoun tidak hanya bersifat kritik terhadap historiografi Islam klasik, tetapi juga memberikan arah baru bagi pembaruan epistemologis, metodologis, dan paradigmatik dalam pengembangan studi Sejarah Peradaban Islam di era modern.

Abstract

Penelitian ini menggali peran hadis Nabi Muhammad SAW dalam kehidupan masyarakat Kota Padang, khususnya berkaitan dengan posisi buang air kecil bagi laki-laki. Fasilitas buang air kecil di masjid menjadi fokus utama, dan melalui observasi serta wawancara dengan pengurus masjid, terungkap bahwa ada ketidakseimbangan antara jumlah urinoir dan toilet. Pemahaman pengurus masjid tentang hadis buang air kecil terbatas, yang tercermin dalam kurangnya pengetahuan terkait redaksi dan terjemahan hadis larangan kencing berdiri. Faktor-faktor seperti jumlah jama'ah, keterbatasan lahan, efisiensi pelayanan, dan permintaan langsung dari jamaah memengaruhi keputusan pengurus masjid dalam menyediakan fasilitas kencing berdiri. Penelitian ini menekankan pentingnya kesadaran masyarakat terhadap nilai-nilai agama, khususnya dalam menjalani kehidupan sehari-hari sesuai ajaran hadis dan Al-Quran. Meskipun terdapat perbedaan pandangan di kalangan ulama, penelitian ini menyoroti perlunya memahami dan menerapkan petunjuk dalam hadis sebagai pedoman hidup. Kesadaran ini menjadi kunci dalam mengelola fasilitas di lingkungan masjid, mengingat ajaran agama seharusnya menjadi landasan utama dalam pengambilan keputusan.
