Abstract

Abstrak Perbankan sangat rentan terhadap kemungkinan di gunakan sebagai media pencucian uang dan pendanaan terorisme, karena pada perbankan tersedia banyak pilihan transaksi bagi pelaku pencucian uang dan pendanaan terorisme dalam upaya melancarkan tindak kejahatan. Melalui berbagai pilihan transaksi tersebut, seperti transaksi pengiriman, perbankan menjadi pintu masuk harta kekayaan yang merupakan hasil tindak pidana atau merupakan pendanaan kegiatan terorisme ke dalam sistem keuangan yang selanjutnya dapat dimanfaatkan untuk kepentingan pelaku kejahatan. Dalam rangka pencegahan pencucian uang dan pemberantasan terorisme tersebut, koordinasi, kerjasama dan perhatian dari berbagai pihak nasional dan internasional mutlak diperlukan.Adapaun yang menjadi dasar hukum APU-PPT adalah Undang-Undang No.8 Tahun 2010 tentang pencegahan dan pemberantasan tindak pidana pencucian uang dan Undang-Undang No. 9 Tahun 2013 tentang pencegahan pendanaan terorisme. Oleh Bank Indonesia (BI) di tindak lanjuti  dengan Peraturan Bank Indonesia No.14/27/PBI/2012 tentang Penerapan Anti Pencucian Uanag dan pencegahan pendanaan terorisme dan Surat Edaran Bank Indonesia (SEBI) No.15/21/DDPNP Tahun 2013 tentang Penerapan APU-PPT. Penelitianini untuk mengetahui bagaimana implementasi Peraturan Bank Inddonesia tentang penerapan program APU-PPT, bagaimana hambatan dan upaya implementasi penerapan program anti pencucian uang dan pencegahan pendanaan terorisme. Penelitianini menggunakan metode penelitian kepustakaan dan wawancara. Penelitian kepustakaan dengan mengumpulkan data yang terdiri dari bahan hukum primer dan bahan hukum sekunder yaitu bahan yang erat hubungannya dengan bahan hukum primer. Hasil penelitian menunjukkanbahwa, cabang agar disiplin dalam melaksanakan proses Customer Due Diligence (CDD) dan Enhance Due Diligence (EDD) pada saat penerimaan nasabah, diidentifikasi nasabah dan pemantauan transaksi dengan mengacu pada SPO APU-PPT Tahun 2010. CDD adalah kegiatan berupa identifikasi, verifikasi dan pemantauan yang dilakukan bank untuk memastikan bahwa transaksi nasabah sesuai dengan profil nasabah.EDD adalah proses CDD yang dilakukan lebih mendalam terhadap nasabah.Kata Kunci: Implementasi, penerapan, pencucian uang, pencegahan terorisme.

Abstract

Abstrak Civil society atau masyarakat madani adalah sebuah tatanan masyarakat sipil yang mandiri dan demokratis. sebenarnya di Indonesia konsep civil society sudah ada dari jaman setelah kemerdekaan dapat dilihat dari konsep Piagam Jakarta, Undang-Undang Dasar Republik Indonesia Serikat, Undang-Undang Dasar Sementara 1950, Undang-Undang Dasar 1945, dan hasil amandemen Undang-Undang Dasar 1945, Bisa dilihat dalam pembukaan dan batang tubuh Undang-undang Dasar 1945. Pengaruh perkembangan civil society di Indonesia karena faktor hukum dan politik, mulai bergejolak, faham tersebut sejak masa Orde Baru, lalu kemudian masa transisi, dan era reformasi. Pada masa Orde Baru merupakan masa kekuasaan absolut, sentralistik sehingga Negara menjadi tirani/totaliter, amanat reformasi untuk merubah sistem kearah yang lebih demokratis yang lebih memperhatikan pada hak-hak rakyat atau sistem civil society, lalu kemudian amanat tersebut dijawab oleh hasil amandemen Undang-Undang Dasar Republik Indonesia 1945. Secara spesifikasi penjabaran Undang-Undang Dasar 1945 pasal 28 diatur dalam Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. Identifikasi masalah pertama: bagaimana penguatan civil society dalam konsep Negara hukum Republik Indonesia. Kedua: bagaimana implementasi hak asasi Manusia pasca amandemen Undang-Undang Dasar Negara Republik Indonesia. Metode penelitian dalam penulisan ini menggunakan metode yuridis normatif dengan tipe penelitian deskriptif analitis yaitu dengan memberikan gambaran, menelaah dan menganalisis peraturan perundang-undangan hubungan antara praktek pelaksanaan penguatan civil society dalam Negara hukum berdasarkan Hak Asasi Manusia pasca amandemen Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Penguatan civil society dalam Konsep Negara hukum Republik Indonesia yaitu untuk peningkatan layanan supremasi hukum, keterbukaan publik/pers, demokratisasi, toleransi dan pluralisme, serta keadilan sosial, dan adanya pilar penegak civil society. Sedangkan implementasi Hak Asasi Manusia pasca amandemen di Indonesia sudah terlaksana dengan baik & efektif, diantara Hak Asasi Manusia seperti: Hak Asasi Pribadi (Personal Rights), Hak Asasi Politik (Political Rights), Hak Asasi Hukum (Rights of Legal Equality), Hak Asasi Ekonomi (Property Rights), Hakasasi Peradilan (Procedural Rights), Hak asasi sosial Budaya (Social Culture Rights).Kata Kunci: Civil Society, Hak Asasi Manusia, Negara Hukum, Amandemen

Abstract

The purpose of this study is to find, describe, and analyze the role of local governments to empower MSMEs through the KUR Program in West Java Province. This by the Regional Government is solely for the benefit of the West Java people by empowering existing MSMEs, namely through the People's Business Credit Program, which was launched by the Central Government. This research is qualitative. This research was conducted with a descriptive approach because the results obtained from this study are expected to provide a comprehensive and systematic description of the role of the West Java Regional Government in empowering Micro, Small, and Medium Enterprises. The results of this research can be useful in developing Business Law, especially related to increasing MSME Empowerment and applied in the form of providing People's Business Credit through national banks, with the hope that the Welfare of the People or the West Java Community through MSMEs will be realized soon. So that welfare is not only enjoyed by entrepreneurs who have a large capital, but also the community in general.

Abstract

The process of regional head election cannot be carried out with the wishes of the parties and at will, as a country that upholds the values of democracy and as a rule of law which is reformulated in article 1 paragraph 3 of the 1945 Constitution that the implementation of elections to the regions must be based on the value of justice. strategies in preventing illegal acts committed by election contestants to the regions, especially money politics against the community, the attacking regency election supervisory body needs to carry out socialization methods to the community and also political parties, as well as conduct anti-money politics patrols during the calm period which often occurs by the team. success. The research method that I use in writing this article is to use empirical normative legal research methods. The primary data source is the result of interviews with several members of the Bawaslu of Serang Regency. The data analysis in writing this article is a qualitative way. Abstract

Giving remission to corruptors is an irrelevant policy. The effectiveness of measuring justice against extraordinary crimes (corruption) cannot be interpreted as a tool to reduce punishment or change the sentence that has been determined by the court so that remissions are not immediately given to prisoners in corruption cases. Then, the arrival of Covid-19 impacted economic difficulties for all elements of Indonesian society; however, sadly, in this Covid-19 disaster situation, there were elements of the political elite who smuggled the social assistance funds. So, granting remissions to corruptors should be removed because it affects the community at significant, human rights that are closely related to prisoners, one of which is the provision of remissions, the provisions of Article 14 paragraph (1) of Law Number 12 of 1995 concerning Corrections states that one of the rights of the convict is to get a reduction in the criminal period (remission). The method that will be used is the normative juridical research method and the research materials used in this research by using studies on laws and regulations, books, journals, news, and relevant information that discusses the effectiveness of measuring justice against corruption cases in social assistance during a pandemic. The results of this study are: The concept of justice for officials who have committed corruption Social Assistance Funds (BANSOS) is an extraordinary crime that impacts the sustainability of the community and should not be given remission for officials who misuse the aid funds.

Abstract

A lease is an agreement whereby one party binds himself to give the other party the enjoyment of an item for a certain period and with payment of a price that the latter party is willing to pay. The rights and obligations of the parties in the lease agreement and the rights of the lessor are the rights that the lessor will receive. The party who rents out has the right to pandbeslag, which is a confiscation carried out by the court at the request of the renter, such as the furniture in the house that is being rented if the tenant is in arrears with the rent for the house to be auctioned if the tenant does not pay off the arrears. The lessor has the right to request cancellation of the agreement and compensation. The lessor's right is to hand over the leased to the lessee to maintain the object being leased so that the object can be used for its intended purpose. The lease agreement ends in default before the expiration of the agreement, i.e., the lease agreement can terminate automatically at a particular time after being terminated by taking into account a certain grace period. Although a lease is a consensual agreement, by law, there is a difference between a written lease and an oral lease.
