Abstract

Tahun 1968, Gubernur DKI Jakarta dijabat oleh Ali Sadikin dan mengeluarkan SK No. 1. 1b / 322/1968 mengambil alih pengelolaan Perusahaan Daerah Air Minum Jakarta dari Biro Pekerjaan Umum. Panel review publik dari hakim menilai privatisasi air di Ibu Kota melangar peraturan peundang-undangan dan hairus dinatakan tidak sah sesuai dengan undang-undang. Elizabeth Siundari, Basuki Reiskso Wibowo, I Dewa Gede Palguina, Biviitri Susan Lima panitia peninjau berlatar belakang hukum, Bevitri Susanti dan Eryanto Nugroho, mengungkapkan hal tersbut dalam piutusan peninjauan piublik atas piutusan privatisasi air. Mengingat pertimbangan mereka untuk beralih ke badan hukum swassta sebagai pihask mengilangkan ciri-ciri gugaan warga, maka tidak tepat untuk memutuskan Niet Ontvankelijke Verklaard (NO) dalam kasus ini. Langkah ini dimaksudkan untuk menunjukkan bahwa litigasi yang diputuskan oleh Niet Ontvankelijke Verklaard (NO) didasarkan pada pertimbangan formal, dan Indonesia saat ini tidak memiliki dasar hukum formal untuk mempertimbangkan apakah dapat dikatakan bahwa litigasi warga memenuhi karakteristiknya.

Abstract

A lease is an agreement whereby one party binds himself to give the other party the enjoyment of an item for a certain period and with payment of a price that the latter party is willing to pay. The rights and obligations of the parties in the lease agreement and the rights of the lessor are the rights that the lessor will receive. The party who rents out has the right to pandbeslag, which is a confiscation carried out by the court at the request of the renter, such as the furniture in the house that is being rented if the tenant is in arrears with the rent for the house to be auctioned if the tenant does not pay off the arrears. The lessor has the right to request cancellation of the agreement and compensation. The lessor's right is to hand over the leased to the lessee to maintain the object being leased so that the object can be used for its intended purpose. The lease agreement ends in default before the expiration of the agreement, i.e., the lease agreement can terminate automatically at a particular time after being terminated by taking into account a certain grace period. Although a lease is a consensual agreement, by law, there is a difference between a written lease and an oral lease.

Abstract

Criminal responsibility leads to the prosecution of the perpetrator who has committed a criminal act and fulfills its elements as stipulated in the law. Viewed from the perspective of the occurrence of a prohibited act (obligation), an individual will be criminally accountable for such actions if they are against the law. To hold someone criminally accountable, one must consider the culpability of the perpetrator. However, it is not sufficient to consider only the culpability; one must also consider the reasons and circumstances that eliminate the penalty as outlined in Articles 44, 48, 49, 50, and 51 of the Indonesian Penal Code (KUHP). In cases where the perpetrator has met the provisions of those articles, they are exempted from the threat of criminal charges. The research method used is normative juridical, which involves legal research on primary and secondary legal materials, especially those related to the discussed subject matter. This study aims to determine how criminal responsibility is imposed on perpetrators of negligent crimes resulting in the death of others in traffic accidents. From the research findings, it is concluded that the defendant Mariyanto, based on the trial facts, did not meet the criteria set forth in Articles 44, 48, 49, 50, and 51 of the KUHP that would eliminate the penalty. Therefore, Mariyanto can be held responsible and subject to criminal accountability. Considering that the victim also bears some responsibility contributing to the commission of the offense and that the defendant had no malicious intent, posing no danger, the writer suggests that the defendant should be appropriately sentenced to probation, as proposed by Mariyanto's Legal Counsel in their plea, taking into account humanitarian and justice considerations.

Abstract

Hak Angket dalam pasal 79 ayat (3) Undang-undang Nomor 17 tahun 2014 tentang MPR, DPR, DPD dan DPRD (MD3) merupakan hak penyelidikan DPR sebagai bentuk pengawasan terhadap pelaksanaan suatu undang-undang. Pasal 3 UU No 19 Tahun 2019 dikatakan bahwa Komisi Pemberantasan Korupsi adalah lembaga negara yang dalam melaksanakan tugas dan wewenangnya bersifat independen dan masuk kedalam rumpun eksekutif. Adapun permasalahan dalam skripsi ini adalah Bagaimana Legalitas Hak Angket Dewan Perwakilan Rakyat terhadap Komisi Pemberantasan Korupsi. Bagaimana Relevansi Hak Angket DPR yang ditujukan kepada KPK ditinjau dari ketentuan UU MD3. Metode penelitian yang digunakan adalah penelitian hukum yuridis normatif untuk meneliti, meninjau, serta menulis pembahasan skripsi ini. Penggunaan metode penelitian yuridis normatif dalam penelitian dan penulisan skripsi ini di latar belakangi oleh kesesuaian teori dan isu hukum yang diangkat sebagai topik pembahasan yang hasilnya bahwa Legalitas Hak Angket DPR sangat tepat ditujukan kepada KPK karena berkekuatan hukum yang kuat. Abstract

The number of banks closing is a phenomenon considering the role of banking in economic growth. GCG is the main requirement for banking existence in carrying out its intermediary function. This research aims to examine the relationship between contract balance and banking health and uses a normative juridical research form with a statutory regulation approach and a multidisciplinary approach involving the theory of economic analysis of laws and civil law and governance. The analysis emphasizes non-juridical research. The research results show that implementation of good corporate governance by prioritizing balanced contracts between the parties. The position of banking institutions can continue to be maintained if supervision from the OJK institution and the implementation of good governance based on applicable regulations run as they should. So far, many banks have gone bankrupt due to fraud and mismanagement, especially in corporate governance, even though the OJK has tried to restore banking health. Imbalance in contracts is also a form of bank non-transparency in contracts with customers, resulting in high NPLs that can affect the liquidity risk of bank financial institutions
