Abstract

This article aims to examine and analyze the legal rules governing the criminal act of ballpress smuggling, and how the factors that cause ballpress smuggling in the waters of the Malacca Strait in North Sumatra, and how the policies are taken against ballpress smuggling in the waters of the Malacca Strait in Sumatra. North. The problem is focused on how the laws governing the criminal act of ballpress smuggling and the factors causing ballpress smuggling as well as the policies implemented in handling the crime of ballpress smuggling. The research method in this paper is a normative legal research method. The data were collected through primary, secondary and tertiary data sources, then analyzed using qualitative analysis methods. This study concludes that the legal rules regarding the criminal act of ballpress smuggling are as follows: (a) Law Number 17 of 2006 concerning Amendments to Law no. 10 of 1995 concerning Customs. (b) Law Number 8 of 1999 concerning Consumer Protection (UUPK) (c) Regulation of the Minister of Trade of the Republic of Indonesia Number 51/M-DAG/PER/7/2015 of 2015 concerning the Prohibition of the Import of Used Clothing (d) Decree of the Minister of Industry and Trade No.732/MPP/Kep/10/2002 concerning Textile Import Trading System. The factors causing ballpress smuggling in the waters of the Malacca Strait in North Sumatra are: (a) Geographical Factors, (b) Domestic Industry Conditions. (c), Natural Resources (SDA), (d) Excess Production, (e) Transportation, (f) Mentality, (g) Society. The policies taken against ballpress smuggling in the waters of the Malacca Strait in North Sumatra are: (a) The penal route, namely by applying criminal law (criminal law application), (b) The non-penal route.

Abstract

This article or paper aims to review and analyze the legal rules governing the handling of evidence of corruption by the prosecutor's office before being transferred to (Rupbasan), as well as the role of the prosecutor in handling evidence of corruption and policies carried out by the prosecutor in handling evidence of acts of crime. corruption crime. The problem is focused on how the rule of law and the role and policies of the Attorney General's Office in managing evidence. In order to approach this problem, legal systems theory, role theory and policy theory are used as references. The research method in this writing is a normative legal research method. Data were collected through primary, secondary and tertiary data sources, then analyzed using qualitative analysis methods. This study concludes that the legal regulations regarding the handling of evidence of criminal acts of corruption are: Minister of Law and Human Rights Regulation No. 16 of 2014, Regulation of the Chief of the National Police of the Republic of Indonesia No. 8 of 2014, Presidential Instruction No. 2 of 2014, Regulation of the Attorney General of the Republic of Indonesia No: PER-027 / A / JA / 10/2014. The role of the prosecutor in handling evidence, namely: The role of subsection of evidence and the role of subsection of loot. The policies implemented by the prosecutor regarding the handling of evidence include: Policies before being transferred to the state confiscated objects storage house and policies carried out by the Attorney after the court verdict.

Abstract

The purpose of this study was to examine and analyze the legal rules regarding the handling of children who commit criminal acts, the factors that cause narcotics abuse and the policies taken by the Directorate of Drug Investigation of the North Sumatra Regional Police in Handling children who abuse narcotics. This research relies on secondary data sources consisting of positive criminal law legislation in Indonesia, namely the Criminal Code, laws and regulations outside the Criminal Code relating to problems, the 2008 National Criminal Code Concept, the Child Criminal Justice System, various laws and regulations obtained from various countries as material for comparison as well as various opinions of legal experts that are closely related to this research. The results of the research state that the legal rules regarding the handling of children are regulated in the SPPA Law No. 11 of 2012, where in the law that the handling of children must prioritize the protection of children. The factors causing narcotics abuse by children in the Legal Area of the North Sumatra Regional Police are: lack of parental supervision, follow-up factors, intentionally being used by narcotics dealers, narcotics trafficking which is getting out of control until it is very close to the social environment of children. everyday life, as well as the lack of children's understanding of the dangers of narcotics. Policies for handling children who commit criminal acts of narcotics abuse in the North Sumatra Regional Police are guided by the SPPA Law No.11of2012.
