Abstract

Every marriage will give birth the union of assets that can be obtained by husband and wife during the marriage if not excluded by the marriage agreement. However, the Marriage Law explicitly and clearly stipulates that the marriage agreement must be made before the marriage takes place or at the time the marriage takes place. The existence of these legal provisions, in fact, is not entirely known by every prospective husband and wife and raises new problems related to land law that limits ownership rights to land and buildings for Indonesian citizens who marry other citizens without marriage agreements. This is the reason for the birth of a material test suit against the provisions of the Marriage Law contained in the Decision of the Constitutional Court No. 69 / PUU-XII / 2015. This decision forms the basis and legal basis for new arrangements as a source of legal renewal on the procedures for marriage agreements and their legal consequences for joint assets acquired in marriage. The born of legal renewal is the marriage agreement that can be made any time during the marriage in the form of an authentic deed at the notary and can be retroactive from the date the marriage takes place as long as the husband and wife agree and bind as a law to the parties. For this reason, the legal consequences of the legal status of joint assets acquired during marriage are the personal property of each husband and wife and their contents are binding on third parties as long as the third party has an interest.

Abstract

Stunting masih menjadi permasalahan kesehatan masyarakat yang berdampak serius terhadap kualitas tumbuh kembang anak dan pembangunan sumber daya manusia di Indonesia. Salah satu faktor yang berkontribusi terhadap tingginya angka stunting adalah praktik pernikahan dini yang masih terjadi di banyak wilayah, termasuk di Desa Talang Mulya, Kecamatan Teluk Pandan, Kabupaten Pesawaran. Pernikahan dini menyebabkan kehamilan berisiko pada usia yang belum matang secara biologis dan psikologis, yang pada akhirnya meningkatkan risiko terjadinya stunting pada anak. Rendahnya literasi hukum dan kesehatan masyarakat menjadi faktor utama yang memperkuat praktik tersebut. Kegiatan pengabdian kepada masyarakat ini dilaksanakan melalui metode sosialisasi, edukasi, diskusi, dan pendampingan, dengan melibatkan perangkat desa, tokoh masyarakat, serta remaja dan keluarga di desa tersebut. Materi yang disampaikan meliputi aspek hukum pernikahan dini berdasarkan Undang-Undang Nomor 16 Tahun 2019, hubungan antara pernikahan dini dan risiko stunting, serta pentingnya kesehatan reproduksi remaja. Hasil kegiatan menunjukkan adanya peningkatan pemahaman peserta mengenai dampak pernikahan dini terhadap kesehatan ibu dan anak, serta tumbuhnya kesadaran masyarakat untuk mendukung penundaan pernikahan dini sebagai upaya pencegahan stunting. Dengan pendekatan yang partisipatif dan berbasis masyarakat, diharapkan kegiatan ini dapat mendorong perubahan perilaku yang berkelanjutan dan meningkatkan kualitas sumber daya manusia di Desa Talang Mulya.

Abstract

The bankruptcy estate constitutes the entirety of the debtor’s assets that serves as the source for the repayment of debts to creditors. In bankruptcy practice, the integrity of the bankruptcy estate is often threatened by the debtor’s legal acts that transfer assets to third parties before a declaration of bankruptcy is pronounced in order to avoid general attachment by the curator. This problem becomes increasingly complex when the debtor is in the form of a Limited Liability Company, because the directors, as the company’s organ, have authority over asset management and are therefore in a position that allows asset transfers to be carried out through seemingly lawful legal acts. This study aims to analyze the application of the actio pauliana lawsuit as a legal instrument in protecting the bankruptcy estate from the legal acts of directors and its legal consequences. This study is normative legal research employing a normative-applied approach through a judicial case study. Data were obtained through library research and document study in the form of statutory regulations and court decisions, which were analyzed qualitatively. The results show that the actio pauliana lawsuit is an effective legal instrument for protecting the bankruptcy estate from the debtor’s legal acts that are detrimental to creditors. All assets transferred by the directors to PT Sinar Mas with the approval of Bank ICBC were declared to be returned to the bankruptcy estate and must be handed over to the curator for the repayment of creditors’ claims. These findings affirm the importance of actio pauliana as a legal protection mechanism for the bankruptcy estate and reinforce the role of the curator in ensuring the recovery of the debtor’s assets for the benefit of creditors.
