Abstract

Badan Penyelesaian Sengketa Konsumen (BPSK) Kota Samarinda telah terbentuk sejak tahun 2010, yang bertugas menyelesaikan sengketa konsumen yang berada di wilayah Kota Samarinda. Sebagai lembaga penyelesaian sengketa di luar pengadilan, BPSK memiliki kelebihan yaitu konsumen tidak dipungut biaya dan dalam menyelesaikan sengketa konsumen mengedepankan win-win solution. Meskipun telah tersedia BPSK, namun belum semua konsumen di Kota Samarinda belum memanfaatkan lembaga tersebut untuk mengadu dan menyelesaikan sengketa konsumen. Beberapa permasalahan yang menyebabkan konsumen belum memanfaatkan lembaga tersebut, karena tingkat keberdayaan konsumen masih rendah juga dikarenakan belum tersosialisasikannya BPSK kepada konsumen dengan maksimal. Karenanya sangat penting untuk dilakukan edukasi kepada konsumen tentang BPSK tersebut. Adapun metode yang digunakan yaitu melakukan edukasi melalui media online. Sasaran edukasi secara khusus adalah konsumen Kota Samarinda dan secara umum konsumen di Kalimnatan timur. Tujuannya konsumen akan mengetahui dan memahami terkait kewenangan BPSK dan selanjutnya konsumen yang memiliki permasalahan konsumen dapat memanfaatkan BPSK tersebut. Hasil kegiatan, yaitu telah terselenggara webinar secara online melalui zoom meeting. Jumlah peserta webinar sebanyak 85 orang dengan komposisi masyarakat di Kota samarinda dan mahasiswa di Kalimantan Timur.

Abstract

Dinamika layanan jasa klinik kecantikan estetika belum didukung dengan pengaturan hak pasien yang memadai, hal tersebut berdampak terhadap ketidakpastian hukum dalam layanan jasa kecantikan estetika, dan berakibat hak pasien belum terlindungi. Tujuan penelitian ini, mengidentifikasi pengaturan hak pasien, menganalisis karakter hubungan dokter dan pasien, serta menggali  bentuk pengaturan yang memberikan perlindungan kepada pasien. Jenis penelitian ini yuridis, menggunakan pendekatan perundang-undangan dan teori kepastian hukum. Teknik pengumpulan data sekunder: studi pustaka dan teknis analisis data menggunakan analisis yuridis kualitatf. Simpulan pertama, pengaturan penyelenggaraan klinik kecantikan estetika masih bersifat internal pedoman dokter, sehingga pasien belum terlindungi haknya. Kedua, pada penyelenggaraan layanan jasa klinik kecantikan, terdapat hubungan hukum antara pasien dan dokter, berakibat adanya hak serta kewajiban. Ketiga, pengaturan penyelenggaraan klinik kecantikan estetika yang memberikan perlindungan bagi pasien yaitu, tidak hanya bersifat internal tetapi juga harus bersifat eksternal yang mengatur hak maupun kewajiban para pihak. Rekomendasi pertama, harus ada pengaturan secara khusus hubungan hukum dokter maupun pasien pada sector jasa klinik kecantikan estetika. Kedua, pengaturan hubungan hukum dokter dan pasien tidak berupa pedoman internal dokter, tetapi secara eksternal yang mengatur  hak dokter dan pasien. Bentuk pengaturan yang bersifat eksternal harus memberikan perlindungan dengan mengakomudir hak-hak pasien.

Abstract

The implementation of parking at Samarinda City Mall is carried out using the parking model and parking space leases, with variations in standard clauses. Potential disputes between the parties in this legal relationship can occur due to damage or loss caused by the actions of third parties, which have an impact on consumer losses. Variations in the implementation of parking have an impact on legal uncertainty which results in non-optimal legal protection for consumers of parking services. The research method used is empirical juridical supported by factual data obtained from research at the Samarinda City Mall. The results of the study show that the management and arrangement of parking at the Samarinda Mall is constructed as a parking agreement, the manager is responsible for damage and loss of vehicles using parking services. The standard clause on parking tickets is an exoneration clause, while the standard clause on parking space leases is not an exoneration clause. Even though BPSK Kota Samarinda has supervisory authority for standard clauses, its implementation is less effective. Supervision can be carried out by the permit giver for effective guidance and administrative sanctions. The implementation of parking space leases at the Samarinda Mall must be disciplined, because it is an avoidance of the responsibility of business actors, as an effort to optimize consumer protection.

Abstract

Background: Communal Intellectual Property (KIK) as a wealth of Indonesian cultural heritage must be protected, preserved, developed, and/or utilized through an inventory, which will then be collected into the KIK Data Center in Indonesia. For the regions with KIK protection is not only a form of legal protection but also aims to encourage the economy of the community in an area and as an effort to protect cultural heritage as the identity of a region. The purpose of this study was to identify the potential and constraints in the KIK inventory in East Kalimantan Province and explore the efforts of the East Kalimantan local government in implementing the KIK inventory. Research Methods: The type of research used was socio-legal with a statutory approach and a social approach to get the maximum form of inventory implementation. The technique of data analysis was carried out, namely by analyzing statutory regulations that had been inventoried to obtain legal certainty for the implementation of the KIK inventory. Furthermore, analyzing factual data in the implementation of KIK protection and problems in the community, and offering strategic steps in organizing KIK inventory in providing legal protection for KIK in East Kalimantan. Findings: The findings after the discussion were, first, the identification of the KIK potential in East Kalimantan was carried out with an inventory. The inventory of KIK in East Kalimantan as an effort to protect the law of cultural works was carried out on a defensive basis. Second, implementation of KIK potential inventory in East Kalimantan are in two forms, namely, an inventory carried out by the Ministry of Law and Human Rights through the KIK registration mechanism, then entered into the KIK Data Center, and Education and Culture Office through a recording mechanism which was then determined become WBTB. Then, there were still differences in perceptions within the internal government and the lack of public understanding regarding the substance of the KIK inventory, which is the main obstacle in implementing the inventory. Conclusion: Conclusion from the discussion, namely, first, the inventory of potential KIK is still experiencing problems and has an impact on the non-optimal legal protection of cultural works in East Kalimantan. Second, various efforts have been made by the Ministry of Law and Human Rights, the Department of Education and Culture, and the community, but have not been able to synergize the entire system in implementing the inventory. As a recommendation regarding this matter, the first is to share perceptions and synergize between the Ministry of Law and Human Rights and the Education and Culture Office. Second, the inventory system must accommodate all social facts, objective realities, and consider local cultural values. Besides, special treatment is needed for the community by maximizing socialization, education, and assisting in the KIK inventory.

Abstract

This study aims to determine the implementation of Mayor Regulation Number 02 of 2019 concerning the system and procedures for implementing local tax collection related to swallow's nest tax in Samarinda City. This research is an Empirical legal research sourced from primary and secondary data. The results showed that the tax collection carried out by the City Revenue Agency in its implementation and implementation was constrained by several factors. So it is advisable to implement a local government tax collection of bird's nest as well since the issuance of the regulations after the mayor and the local government or the province should consider to help Regional Revenue Agency Samarinda carry out tasks that have been mentioned in the regulations of the mayor.

Abstract

Edukasi KIK di Desa Kutai Lama dilakukan karena adanya potensi adanya Kekayaan Intelektual Komunal yang belum terlindungi. Upaya inventarisasi KIK sebagai langkah defensive, dalam pelaksanaannya masih terdapat beberapa kendala, diantaranya belum optimalnya peranan dari masyarakat dan sinergi institusi. Tujuan edukasi ini untuk memberikan pemahaman kepada masyarakat tentang pentingnya upaya identifikasi dan inventarisasi KIK sebagai upaya melindungi warisan budaya di Desa Kutai lama, dengan harapan dapat mencegah terjadinya penyalahgunaan melawan hukum terhadap warisan budaya dan masyarakat juga dapat memanfaatkan KIK sebagai sarana peningkatan nilai ekonomis di Desa Kutai Lama. Edukasi dilaksanakan di Kantor Desa Kutai Lama pada tanggal, 20 Mei 2024 dihadiri 27 peserta. Tahapan edukasi yang dilaksanakan: 1) Kunjungan awal memperkenalkan kepada jajaran Kelurahan tentang KIK; 2) menyampaikan materi terkait KIK kepada masyarakat; 3) melakukan identifikasi dengan memberikan formulir tentang kegiatan usaha masyarakat. Kegiatan secara keseluruhan berjalan sesuai target. Kegiatan awal dalam pengenalan edukasi ini, diperlukan tindaklanjut pendampingan identifikasi KIK pada kegiatan abdimas berikutnya.
