Abstract

Abstract

The implementation of parking at Samarinda City Mall is carried out using the parking model and parking space leases, with variations in standard clauses. Potential disputes between the parties in this legal relationship can occur due to damage or loss caused by the actions of third parties, which have an impact on consumer losses. Variations in the implementation of parking have an impact on legal uncertainty which results in non-optimal legal protection for consumers of parking services. The research method used is empirical juridical supported by factual data obtained from research at the Samarinda City Mall. The results of the study show that the management and arrangement of parking at the Samarinda Mall is constructed as a parking agreement, the manager is responsible for damage and loss of vehicles using parking services. The standard clause on parking tickets is an exoneration clause, while the standard clause on parking space leases is not an exoneration clause. Even though BPSK Kota Samarinda has supervisory authority for standard clauses, its implementation is less effective. Supervision can be carried out by the permit giver for effective guidance and administrative sanctions. The implementation of parking space leases at the Samarinda Mall must be disciplined, because it is an avoidance of the responsibility of business actors, as an effort to optimize consumer protection.

The technique of data analysis was carried out, namely by analyzing statutory regulations that had been inventoried to obtain legal certainty for the implementation of the KIK inventory. Findings: The findings after the discussion were, first, the identification of the KIK potential in East Kalimantan was carried out with an inventory. The inventory of KIK in East Kalimantan as an effort to protect the law of cultural works was carried out on a defensive basis. Second, implementation of KIK potential inventory in East Kalimantan are in two forms, namely, an inventory carried out by the Ministry of Law and Human Rights through the KIK registration mechanism, then entered into the KIK Data Center, and Education and Culture Office through a recording mechanism which was then determined become WBTB. Then, there were still differences in perceptions within the internal government and the lack of public understanding regarding the substance of the KIK inventory, which is the main obstacle in implementing the inventory. Conclusion: Conclusion from the discussion, namely, first, the inventory of potential KIK is still experiencing problems and has an impact on the non-optimal legal protection of cultural works in East Kalimantan. Second, various efforts have been made by the Ministry of Law and Human Rights, the Department of Education and Culture, and the community, but have not been able to synergize the entire system in implementing the inventory. As a recommendation regarding this matter, the first is to share perceptions and synergize between the Ministry of Law and Human Rights and the Education and Culture Office. Second, the inventory system must accommodate all social facts, objective realities, and consider local cultural values. Besides, special treatment is needed for the community by maximizing socialization, education, and assisting in the KIK inventory.

Abstract

This research examines the legal responsibility of PT. ID Express Logistik Indonesia for damaged goods during the delivery process, focusing on the application of Law Number 8 of 1999 concerning Consumer Protection. The methodology employed is normative legal research with a legislative and case study approach. The findings indicate that although consumers have the right to file compensation claims, the claim process is often hindered by reporting deadlines, verification procedures, and compensation limits set by the company. The case of consumer IS, who experienced damage to goods due to improper packaging, highlights an imbalance in legal protection for consumers. PT. ID Express frequently limits its liability through standard clauses in shipping agreements, which can create legal uncertainty. This study emphasizes the importance of balancing the rights and obligations between consumers and companies to establish legal certainty in goods delivery services. It is hoped that the results of this research can contribute positively to the development of consumer protection practices in Indonesia.

Abstract

Halal certification and cosmetic notification are two essential regulatory regimes within Indonesia's product supervision system. However, overlapping authority between the National Agency of Drug and Food Control (BPOM) and the Halal Product Assurance Organizing Agency (BPJPH) under the Ministry of Religious Affairs has led to regulatory disharmony, resulting in inefficient licensing procedures and legal uncertainty. This study examines the implications of regulatory fragmentation on consumer protection and the right to public health. Using a normative juridical approach and supported by the theories of legal certainty, health law, and consumer protection, the findings indicate that the dualism of the licensing system leads to high transaction costs, delays in product distribution, and a decline in consumer trust in the safety and halal status of products. From the perspective of health law, this disharmony contradicts the principle of the right to health as stipulated in Law No. 17 of 2023. This study proposes a digital-based integrated licensing model for halal certification and cosmetic notification through a single-window system, which may enhance regulatory oversight, improve bureaucratic efficiency, and strengthen consumer protection by ensuring both product safety and the fulfillment of religious values.
