Abstract

Bangsa Indonesia adalah masyarakat beragam budaya dengan sifat kemajemukannya.Keragaman mencakup perbedaan budaya, agama, ras, bahasa, suku, tradisi dan sebagainya.Penelitian ini bertujuan untuk mengetahui dan menganalisis mengenai pandangan masyarakat Desa Tebing Tinggi Pangkatan terhadap moderasi beragama serta untuk mengetahui bagaimana masyarakat desa tersebut menyikapi keragaman yang ada dalam umat beragama.Dalam penelitian ini menggunakan metode Wawancara sebagai salah satu teknik pengumpulan data.Kesimpulan kajian ini adalah bahwa dalam kehidupan multikultural diperlukan pemahaman dan kesadaran multibudaya yang menghargai perbedaan, kemajemukan dan kemauan berinteraksi dengan siapapun secara adil. Diperlukan sikap moderasi beragama, memiliki sikap toleran, dan tidak memaksakan kehendak dengan cara kekerasan. Kata Kunci: Multikultural, Moderasi beragama, Wawancara.

Abstract

Marriage is not only about forming a family which occurs because of the union of a man and a woman, but marriage is an inner and outer bond between a man and a woman as husband and wife with the aim of f0orming a happy and eternal family (household) based on the belief in the Almighty God. One of the most important things about marriage is the marriage guardian. This article aims to find out the theory regarding marriage guardians, the rules for marriage guardians, the arguments and origins of the rules, examples of rules and exceptions to the rules. By using juridical-normative legal research methods, this article will review this conflict. The research results show that there are rules that regulate that a marriage guardian should not be a Fudhulli.

Abstract

Marriage is not only about forming a family that occurs because of the union of a man and a woman, but marriage is an innate bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family (household) based on the One Godhead. It is a problem if marriage is the desire of each prospective couple but is hindered due to religious differences, In practice interfaith marriage is not a new thing and has caused many pros and cons in the community. This paper aims to find out the legal postulates of interfaith marriage both in terms of Islamic law and positive law in Indonesia. Using juridical-normative legal research methods, this article will review these contradictions. The results of the study show that interfaith marriage, both in terms of Islamic law and positive law, is prohibited.
