Abstract

The Islamic inheritance system is founded on principles aimed at ensuring justice, balance, and sustainability in the distribution of inheritance assets. However, in the modern context, the application of Sharia values in inheritance systems faces various challenges, including social dynamics, changes in family structures, and legal regulations in different countries. This study aims to examine the opportunities and challenges in harmonizing Sharia values with modern inheritance systems and explore strategies for their sustainability. The research method employed is a literature review using normative and comparative approaches, analyzing various inheritance models implemented in both Muslim and non-Muslim countries. The findings indicate that despite obstacles in implementing Islamic inheritance law, there are opportunities through flexible regulations, strengthening Islamic legal literacy, and contextual fatwa adaptations. On the other hand, major challenges include conflicts with positive law, differences in scholars' interpretations, and social resistance to inheritance distribution based on Islamic law. For sustainable implementation, it is essential to develop an inheritance model that not only adheres to Sharia principles but also adapts to modern legal and social realities. Therefore, harmonizing Sharia values within the modern inheritance system requires an inclusive and solution-oriented approach that holistically considers legal, social, and economic aspects. Abstract

This study aims to analyze the understanding of Islamic law regarding polygamy from a gender perspective, focusing on the comparison between classical jurisprudence (fiqh) teachings and contemporary interpretations. Polygamy is a complex issue in Islamic law, often sparking debates about gender justice, women's rights, and its relevance in modern social contexts.The research employs a qualitative approach with a critical analysis of classical fiqh texts and contemporary scholars' views. The findings reveal that classical fiqh teachings tend to position women in subordinate roles, emphasizing obedience to husbands. However, contemporary perspectives influenced by gender equality principles and maqasid al-shariah offer new insights that prioritize justice and the protection of women's rights.The study concludes that a gender-based approach can provide more relevant and equitable interpretations of Islamic law on polygamy for modern societies. It also identifies challenges in integrating gender equality principles into Islamic legal understanding, particularly amidst cultural resistance and conservative interpretations.

Abstract

This study is grounded in the recognition that educational supervision plays a strategic role in improving instructional quality and teacher professionalism, as effective learning processes depend not only on curriculum and facilities but also on the continuous development of educators’ competencies. This research aims to describe the role, scope, principles, and contributions of educational supervision in enhancing teaching quality and supporting teacher development. The study employed a literature review method by analyzing relevant books, academic journals, and scientific articles related to educational supervision. The findings indicate that planned, democratic, and continuous supervision effectively identifies instructional weaknesses, provides constructive feedback, motivates teachers, and encourages innovation and professional growth. Academic supervision contributes to improving instructional practices, while managerial supervision strengthens administrative effectiveness within schools. Furthermore, the application of scientific, cooperative, and creative principles makes supervision more humanistic and productive for teachers. In conclusion, educational supervision serves as a systematic and collaborative developmental mechanism that significantly enhances learning quality while reinforcing teacher performance and professionalism.

Abstract

Abstract: Debates on Bay’ al-Istijrār often revolve around permissibility of take now pay later arrangements, yet the decisive tension lies in the method of istiḥsān and the limits of gharar, especially regarding price certainty and the moment a contract is formed. A normative Islamic law inquiry at the level of doctrine applies conceptual, historical, and philosophical approaches, using document study based on Radd al-Muḥtār ʿalā al Durr al Muḥtār Sharḥ Tanwīr al-Abṣār as the primary source for bayʿ al-istijrār and Nasamāt al Ashār as a supporting source for istiḥsān. Ibn ʿĀbidīn’s argument frames the permissibility of Bay’ al-Istijrār not as an unregulated appeal to habit, but as istiḥsān that operates after naṣ, ijmā’, and qiyās are examined. Contract formation is understood to occur with each act of taking the goods, so the subject matter exists at the moment of sale and defined price must be knowable at the time of taking. End of period calculation functions as a settlement record, not as a device to postpone price certainty. ‘Urf serves to clarify practical standards when it qualifies as ‘urf ṣaḥīḥ and does not conflict with naṣ, while ‘urf fāsid is rejected because it expands uncertainty. Recontextualisation to contemporary muʿāmalah is directed toward technical tests of price standards, proof of delivery, rules on unilateral price changes, and accessible dispute resolution, so istiḥsān supports facilitation without sacrificing certainty. Abstrak: Perdebatan bai’ al-istijrār sering berkutat pada status kebolehan akad ambil dulu bayar kemudian, padahal titik perdebatan yang lebih menentukan berada pada metode istiḥsān dan batas gharar, terutama pada kepastian harga dan momen terbentuknya akad. Artikel ini mengkaji hal tersebut dari sisi hukum Islam normatif pada ranah doktrin menggunakan pendekatan konseptual, dengan teknik studi dokumen atas Radd al Mukhtār ʿalā al Durr al Mukhtār Sharḥ Tanwīr al Abṣār sebagai sumber utama baiʿ al istijrār dan Nasamāt al Ashār sebagai penguat pembahasan istiḥsān. Argumentasi Ibnu ʿĀbidīn menegaskan bahwa kebolehan baiʿ al-istijrār tidak disandarkan pada kebiasaan tanpa kontrol, melainkan pada istiḥsān yang bekerja setelah jalur naṣ, ijmā’, dan qiyās diperiksa. Akad dipahami lahir setiap kali pengambilan barang terjadi, sehingga objek hadir pada saat akad dan kepastian harga wajib dapat diketahui pada momen pengambilan barang. Perhitungan pada akhir periode diposisikan sebagai rekap pelunasan, bukan ruang untuk menunda kepastian harga. ‘Urf berperan sebagai penjelas standar praktik selama berstatus ‘urf ṣaḥīḥ dan tidak menabrak naṣ, sementara ‘urf fāsid ditolak karena memperluas ketidakpastian. Rekontekstualisasi dalam muamalah kontemporer diarahkan pada uji teknis atas standar harga, bukti serah terima, aturan perubahan harga, dan mekanisme penyelesaian sengketa, sehingga istiḥsān menjaga kemudahan tanpa mengorbankan kepastian.

Abstract

In Indonesian legal practice, the granting of assets to adopted children through testamentary grants often causes debate due to differences in views between Islamic law and civil law. Adopted children are not considered as heirs in the perspective of sharia, but positive law allows such granting through a testamentary grant deed made by a notary. This study is conducted with a normative legal research method using statutory and conceptual approaches. The aim is to understand the extent to which a deed of testamentary grant to an adopted child can be considered valid under national law as well as in accordance with sharia principles. The results of the analysis show that the testamentary grant deed made by a notary is formally valid according to the Civil Code and the Notary Office Law because it fulfills the elements of an authentic deed and has perfect evidentiary power. However, in the Islamic inheritance law system formulated in the Compilation of Islamic Law (KHI), gifts to adopted children are limited through the mechanism of compulsory testament, which is a maximum of only one third of the inheritance and must not harm the absolute rights of legal heirs. If the gift exceeds this limit or is made without the consent of the heirs, the religious court has the authority to cancel the deed. This disharmony creates a conflict of norms that results in legal uncertainty. Therefore, normative integration is needed to ensure that the testamentary grant deed is legally, socially and shar'i acceptable.

Abstract

This study aims to analyze the role of religious leaders in promoting religious moderation among communities, particularly in the context of a pluralistic and diverse social life. Religious moderation is a religious approach that emphasizes tolerance, fairness, balance, and the avoidance of extreme attitudes in practicing religion. Religious leaders hold a strategic position as role models and communicators of religious values who can influence the attitudes and behaviors of the community. The method used in this study is a descriptive qualitative method, with data collection techniques including in-depth interviews with religious leaders from various faiths (Islam, Christianity, Hinduism, and Buddhism), participatory observation of religious and social activities, and documentation studies from literature and policies related to religious moderation. The research location is focused on areas with a high degree of religious diversity, allowing for the direct exploration of moderation practices. The results of the study indicate that religious leaders play a significant role in conveying messages of moderation through sermons, lectures, interfaith dialogues, and religious social activities. The main findings show that religious leaders who are active in interfaith forums and tolerance- strengthening programs tend to be more effective in instilling the values of moderation in their congregations. On the other hand, there are still challenges such as the lack of training, the influence of identity politics, and resistance from conservative groups that hinder the optimal role of religious leaders. The conclusion of this study is that religious leaders are key actors in grounding religious moderation within a diverse society. They can serve as agents of change who bridge differences and prevent conflicts based on religion. The implementation of this research's findings can be carried out through strengthening the capacity of religious leaders in terms of religious moderation literacy, government policy support in mainstreaming tolerant preaching, and collaboration among religious and educational institutions to create constructive dialogue spaces.

Abstract

The main objective of this study is to understand to what extent the values of religious moderation such as tolerance, balance, justice, and respect for diversity can strengthen social relations and prevent the emergence of religion-based conflicts in Indonesia’s plural society. This study examines how the implementation of religious moderation can play a role in fostering interreligious harmony and reducing the potential for social conflict within a pluralistic society. The method used is qualitative research with a descriptive approach, conducted through literature studies, interviews with religious leaders, and observations of interfaith activities in several regions with high levels of diversity. The results show that the practice of religious moderation, implemented through education, interfaith dialogue, and the active involvement of religious figures and institutions, has proven effective in strengthening mutual trust among religious communities. The values of religious moderation also contribute to building collective awareness to reject violence, prioritize deliberation, and uphold humanity above differences in belief. This study concludes that religious moderation is an effective approach to building harmony and preventing social conflict. Through the application of moderation values, society can live together peacefully, appreciate diversity, and reinforce social and national integration. The implications of this research emphasize the importance of strengthening religious moderation programs through public policy, character education, and interfaith social activities. The government, religious institutions, and society need to work together to instill the values of moderation as the main foundation for creating a harmonious and just national life.

Abstract

This study aims to examine in depth the concept of wasathiyah in Islam as the foundation of religious moderation in Indonesia. The main focus of this research is to analyze the core values of wasathiyah such as justice, balance, tolerance, and deliberation, and to explore how these values are implemented within the socio-religious context of Indonesia’s plural society. The objective of this study is to understand the relevance of wasathiyah teachings in strengthening interreligious harmony and contributing to the establishment of a peaceful and inclusive religious life amidst challenges of radicalism and intolerance. The research employs a qualitative descriptive approach using a library research method. Data were collected from scientific journals, books, previous research findings, and official documents from the Ministry of Religious Affairs of the Republic of Indonesia discussing religious moderation and wasathiyah. Data analysis was conducted through content analysis to identify main themes and correlations between the normative concept of wasathiyah and socio-religious practices in Indonesia. The findings reveal that wasathiyah is not merely a theological concept but also a social paradigm emphasizing balance between creed, worship, and social relations (muamalah). The values of wasathiyah are reflected in various national policies and programs such as strengthening religious moderation, multicultural education, and interfaith dialogue. The application of wasathiyah values has proven effective in preventing social polarization and reinforcing interreligious cohesion in Indonesia. The study concludes that the concept of wasathiyah serves as a fundamental basis for religious moderation in Indonesia. The internalization of wasathiyah values should be systematically implemented through religious education, public policy, and the exemplary leadership of community figures. Consistent implementation will strengthen the nation’s character as tolerant, just, and civilized. The implications of this study highlight the importance of synergy among educational institutions, government bodies, and religious leaders in mainstreaming wasathiyah as a religious culture. This research also serves as an academic reference for developing religious moderation curricula and deradicalization strategies based on the Islamic values of rahmatan lil ‘alamin (mercy to all creation).

Abstract

This study aims to analyze the concepts and principles of religious moderation, examine its role in fostering tolerance and interreligious harmony, and identify the challenges and opportunities in implementing religious moderation within Indonesia’s multicultural society. Religious moderation is viewed as a strategic approach to maintaining social harmony amid the country’s religious, cultural, and ideological diversity. The research employs a qualitative approach using a library research method. Data were collected through a critical review and analysis of scholarly literature, including peer-reviewed national journals published after 2022, academic books, and relevant policy documents related to religious moderation. Data analysis was conducted through data reduction, thematic categorization, and descriptive-analytical interpretation to achieve a comprehensive understanding of the research focus. The findings indicate that religious moderation plays a crucial role in strengthening tolerance and interreligious harmony in Indonesia by promoting balance, justice, inclusivity, and respect for diversity. The study reveals that religious moderation is effectively implemented through education, interfaith dialogue, the involvement of religious leaders, and supportive public policies that encourage harmonious religious life. However, its implementation continues to face several challenges, such as exclusive religious interpretations, the spread of extremism in the digital era, uneven public understanding of religious moderation, and the politicization of religion. On the other hand, significant opportunities exist, including strong governmental support, the integration of religious moderation into educational curricula, the use of digital media to disseminate moderate values, and the development of community-based religious moderation initiatives. In conclusion, religious moderation is an essential and relevant approach for maintaining tolerance and interreligious harmony in Indonesia. The success of its implementation depends largely on the synergy between government institutions, educational establishments, religious leaders, and civil society. The implications of this study emphasize the importance of strengthening policies, education, and socio-religious literacy based on religious moderation in a sustainable manner to ensure that the values of tolerance and harmony become deeply embedded in Indonesian society.
