Abstract

Marriage is one of the laws that apply to all the creatures of Allah are dead. Sirit is carry off a woman by force, deceit sense, even violence to marry. Problematic is that Sirit is not in accordance with the concept of marriage in Islam is that her marriage was valid if it meets the requirements of marriage is one of the conditions is the willingness between two potential partner, which may mean that that marriage should not be forced to either party. The formulation of the problem are (1) the factors behind the occurrence of Sirit?, (2) How is the operational / implementation and impact Sirit ?, and (3) How Sirit Lampung ethnic communities in the Perspective of Islamic Family Law. Objective: (1) Knowing the factors that cause Sirit in Lampung ethnic society, (2) Explain the operational/ implementation Sirit and the impact Sirit, (3) Analyze Sirit Lampung ethnic society in the perspective of the Islamic Family Law. Data collection methods used was interviews and documentation. Data analysis method used is qualitative method. Based on the analysisof, it was concluded that the factors that caused the most dominant Sirit is a lack of awareness of self or less of its sturdywalls of faith to comply with religious law and customary law, economic factors, and self-controlfactor(liver). Sirit is done by means of deceit, coercion and even violence and some aresexually abused. Sirit can not be justified because Islam does not teachsuch things, as explained in Firman of Allah and the Hadis is the Hadis is more concerned with the right of a woman to decide a case which is about the marriage of their own. If viewed from the eyes of urf' the tradition Sirit is customary imperfect, that is not in accordance with the texts of Personality 'so that this tradition must be rejected or abandoned. Perkawinan merupakan salah satu sunnatullah yang berlaku untuk semua makhluk Allah SWT yang bernyawa. Sirit adalah membawa lari perempuan dengan cara paksa, akal tipu daya, bahkan kekerasan untuk dinikahi. Problematika nya, bahwa sirit tidak sesuai dengan konsep perkawinan dalam Islam menyebutkan sahnya pernikahan jika memenuhi syarat-syarat perkawinan yaitu adanya kerelaan antara dua calon pasangan. Permasalahan yang dibahas yaitu tradisi sirit masyarakat suku Lampung Perspektif Hukum Keluarga Islam. Tujuan (1) Mengetahui faktor-faktor yang menyebabkan terjadinya sirit masyarakat suku Lampung, (2) Menjelaskan operasional/pelaksanaan sirit dan dampak sirit, (3)Menganalisis sirit masyarakat suku Lampung dalam perspektif Hukum Keluarga Islam. Metode pengumpulan data berupa wawancara dan dokumentasi. Metode analisis data menggunakan metode kualitatif. Berdasarkan hasil analisis disimpulkan Faktor-faktor yang menyebabkan terjadinya sirit yaitu kurangnya kesadaran diri atau kurang kokoh nya tembok keimanan untuk mentaati hukum agama dan hukum adat, faktor ekonomi, dan faktor pengendalian diri (hati). Sirit dilakukan dengan cara tipu daya, paksaan bahkan dengan kekerasan serta ada juga yang mengalami pelecehan seksual. Sirit tidak dibenarkan dalam Islam, sebagaimana diterangkan dalam Firman Allah SWT dan hadis yaitu dalam hadis lebih mementingkan hak seorang perempuan dalam memutuskan sesuatu yaitu mengenai pernikahan mereka sendiri. Jika dilihat dari urf’, tradisi sirit merupakan adat yang fasid, tidak sesuai dengan nash-nash syara’ sehingga tradisi ini wajib ditolak atau ditinggalkan.

Abstract

Keadilan dalam pernikahan poligami diharuskan ada dan terlaksana berdasarkan firman Allah swt dalam Q.S An Nissa ayat 3, keadilan yang dituntut dalam poligami ialah memberikan hak yang sama pada semua istrinya,baik dalam hal membagi waktu,nafkah baik lahir maupun batin, tempat tinggal, pakaian, kebutuhan dan perlakuan suami terhadap istrinya tanpa ada kecondongan pada salah satunya. Seperti yang terjadi di desa Sumbergede yang menjadi lokasi penelitian ditemukan bahwa ada 3 keluarga dimana terindentifikasi kurangnya penerapan keadilan didalam keluarga poligami. Allah swt membolehkan poligami sampai 4 orang istri dengan syarat berlaku adil kepada mereka. Adil merupakan prinsip dimana memberikan kepada setiap orang hak dan kesempatan yang sama. Adil diartikan sikap tidak berat sebelah dan tidak memihak salah satu. Dasar hukum poligami terdapat dalam Q.S An Nisa ayat 3 dan 129 kemudian dalam KHI pasal 55 sampai 59. Jenis penelitian yang digunakan yaitu penelitian kualitatif dimana objeknya merupakan peristiwa faktual dilingkungan masyarakat ataupun individu. Sifat penelitian ialah deskriptif kualitatif dimana dengan cara mendeskripsikan suatu kejadian yang terjadi dimasyarakat. Sumber data yang digunakan dalam penelitian ini ada 2 yaitu sumber data primer dan sekunder. Teknik ananlisis data dengan menggunakan metode Deduktif yaitu menggali informasi secara umum kemudian di khususkan menjadi konsep keadilan dalam keluarga poligami.

Abstract

This study examines the phenomenon of tajdid nikah (renewal of the marriage contract) among Muslim couples in Giriklopomulyo Village, Sekampung District, East Lampung Regency, with a focus on cases involving pregnancy prior to the official marriage. Although both Islamic law and the Compilation of Islamic Law (KHI) Article 53 confirm that such marriages are valid without requiring re-contracting, tajdid nikah remains prevalent due to societal pressure, cultural norms, and insufficient legal literacy. Using a qualitative case study approach with data from interviews, documentation, and field observations, this research systematically analyzes five key dimensions: the definition of tajdid nikah, local chronology of its practice, its legal interpretation under KHI, contemporary ulama perspectives, and its relevance within the framework of maslahah mursalah. The findings show that tajdid nikah is often pursued not for legal necessity but to achieve psychological relief, family acceptance, and perceived social legitimacy. While some scholars tolerate the practice as a form of precaution (ihtiyat), most ulama assert that it is unnecessary if the first marriage contract was valid. In terms of maslahah mursalah, tajdid nikah can be viewed as beneficial when it reduces stigma and promotes harmony but may be harmful if it reinforces public misconceptions about Islamic legal norms. Therefore, tajdid nikah should not be institutionalized as a religious obligation, and broader legal education is needed to align community practices with sharia principles and Indonesian legal standards.

Abstract

The rise of divorce among the elderly, especially among Muslim communities in East Lampung Regency in recent years, is currently having an impact on increasing divorce rates in Indonesia. This research aims to understand the extent of the potential for divorce, and what are the causes behind divorce in the elderly, as well as what implications the parties receive after divorce. In its solution, this research uses a qualitative descriptive method. The results of this study show that the risk of divorce among the elderly is caused by ignoring problems that have occurred before, then driven by the desire to maintain a household that has existed for decades and tends to postpone divorce because it is a pity to end a relationship that has been established for a long time, also because of the existence of divorce. child. Apart from that, the causes of divorce that are often found are due to third parties, continuous fighting, lack of responsibility, family factors, economic factors, domestic violence, lack of communication, lack of fulfillment of inner income, and not the first marriage. The implications felt after divorce by the parties include disturbed psychological impacts, trauma, declining health, difficulty in establishing new relationships, and social impacts due to bad views from the surrounding environment.

Abstract

This research discusses the gap between regulations and practices in providing children's rights in the context of divorce. This research aims to identify specifically where there are discrepancies between regulations and practices that occur in the field in efforts to fulfill children's rights after divorce. Apart from that, this research also aims to understand the impact or impact of this gap on the welfare and rights of children after divorce. This includes various risks faced by children who are victims of divorce, both in terms of physical, mental and social welfare. The research method used is a qualitative approach with data collection through semi-structured interviews and documentation. The research results show that the main problems include uncommitted parents, lack of family support, quality time, negative societal stigma, and children not being given a proper education. Factors causing this gap include economic conditions, responsibility, communication, intervention from other parties, the double burden carried and the low level of parental education. The implications of this exception between regulations and practice alleviate the child's condition. These implications include promiscuity, bad behavior, lack of affection, and also not having a role model in their life, which in the end can hinder a child's development.
