Abstract

The Qur’an, the holy scripture of the Muslims, never changes since its  revelation. However, qur’anic exegesis, as the results of brilliant thoughts of the interpreter can only differ from one another. The difference of qur’anic exegesis may be brought about by methods of interpreting the qur’anic verses. Generally speaking, there are method of interpreting the qur’anic verses; textual interpretation and contextual interpretation. These two methods of interpretation have been employed from the time of the Prophet Muhammad to the present time.Kata Kunci: Alquran, pemahaman tekstual, pemahaman kontekstual

Abstract

In Iran, woman emancipation does not undergo fundamental change compared with that in other Islamic worlds. In Iran, woman are still in subordinate position. It is within this context that conservative theological thought of  Shi’i ulamas (Islamic scholars), especially Khomeni  gave a great contribution to the subordinating of  status of woman in Iran. This article tries to discuss  status of woman in Iran from Shi’i  ulama’s perspective. Kata Kunci: Kedudukan wanita, ulama Syi’ah

Abstract

Abstract

Determination of auspicious days is a discourse that still causes polemics and is often considered to be contrary to Islamic law. This study aims to discuss the determination of auspicious days in the Mandar wedding traditions in the context of Islamic law. This empirical legal study used a multiapproach framework that included the theory of social change and the theory of Islamic law, especially al-'urf (social tradition) and al-maslahah (public interest). Data were collected by means of in-depth interviews and literature reviews of scientific articles, textbooks, and books on Islamic law. The data were then analyzed through data display using the aforementioned theories. The results of the study revealed that determining auspicious days, practiced by the majority of the Mandar people prior to organizing a marriage, has been considered a custom and in accordance with Islamic law. Further, the Qur’an and hadith, as the sources of Islamic law, have also indicated that there are auspicious times and days e.g., Friday, known as sayyid al-ayyām (leader of the days). The determination of auspicious days in marriage has been adjusted to follow social changes, government policies, and Islamic laws, especially ‘urf and maslahah. Such a custom can be categorized as ‘urf shahih (good) and not 'urf fasid(deviating), with the values of public interest being for safety and blessing. The argument of this study is that in the context of Islamic law if the determination of the auspicious day does not deviate from the provisions of Islamic law, it can be accommodated as a legal consideration; yet, if it deviates from Islamic law, guidance is necessary. This is in accordance with the rules of fiqh: “preserving old things that bring benefits, and accommodating new things that are more beneficial.”

Abstract

This research examines sibaliparri in terms of fiqh and the culture of Mandar people. It applies qualitative descriptive research which is obtained based on the result of interview of some leaders and Mandar people from various professions and relevant sources. The result of this research states that sibaliparri is one concept of Mandar cultural values which is firmly intimate on society. This image means the concept of togetherness, mutual cooperation also equality in all fields including household life at a time. The implementation of sibaliparri values in household life of Mandar people can be in the picture of understanding, loving each other, mutual cooperation, and sincerity for example when a wife gives a birth then a husband takes over the household matters. Sibaliparri values related to family welfare are reflected in various fields, namely education, home economics, decision making, religious life, and health. Al-Qur’an is a principle and guide about justice which covers various recommendations to enforce economic justice, cultural politic and gender. In general, Al-Qur’an desires women not to be complementary creature and be the second position compared to men. Al-Qur’an provides guide clearly that all humans are equal and not different in terms of gender instead of the level of loyalty and piety.  Other hadiths give women more respect than men and argue that women are domestic creatures but their position is fair and proportional, meaning that in certain circumstances men and women have different roles according to their needs and suitability.

Abstract

Child marriage remains a pressing issue in West Sulawesi, where its prevalence is notably high in Indonesia. This study aims to identify the root causes of child marriage and boost legal awareness through the role of Islamic institutions. We also seek to explore the relevance of contingency and power relation theories in understanding the factors contributing to child marriage. This study uses a juridical-sociological approach, integrating primary and secondary data sources. Data collection involved in-depth interviews with key informants, direct observation, and analysis of relevant documents. Two villages in Majene with the highest cases in West Sulawesi were selected. Data triangulation was employed to increase the validity and reliability of the findings. Our finding demonstrates that, based on contingency theory, the root causes of child marriage depend on stigmas rooted in parental attitudes, prevailing social norms, and individual characteristics. Understanding the driving causes of child marriage in West Sulawesi leads this study to propose a conceptual model for action. A wide range of root causes of child marriage calls for a power relation theory that links policy to its implementation. We advocate for collaborative initiatives through the introduction of village regulations and the involvement of Islamic institutions. To further explore this, we invoke the theory of power relations to enhance public awareness. It helps our scheme of collaborative initiatives for enforcing village regulations by connecting law to social norms, enabling people in the village to respect and comply with the rules.
