Abstract

The Republic of Indonesia National Police (Polri) as one of the institutions that carry out the public service function is required to be able to provide the best service to the community by displaying professional and reliable unity performance in their fields. The Criminal Procedure Code, gives a role to the National Police of the Republic of Indonesia to carry out the tasks of investigation and investigation of criminal acts (generally) without limitation of the power of the nature as long as it is included in the scope of public law. Based on the descriptions in the background, the problem above, the problems that can be formulated in this study are: How is the Law Enforcement of Polri's Discipline in Realizing Good Governance and Clean Governance, What obstacles are faced by Polri's Discipline Enforcement in realizing Good Governance and clean governance The theory used to analyze the problems of the Law State Theory, Hirarkhi Theory Legal Norms, Authority Theory, Law Enforcement Theorem, Government Concepts and Clean Government This type of research is normative legal research supported by empirical legal research. The approach used by the author is the Law approach (Statute approach), legal concept analysis approach (analytical conseptual approach), comparative approach. Sources of Primary Legal Materials and secondary legal materials, namely materials that provide an explanation of primary legal materials, such as the results of seminars or other scientific meetings, Secondary legal material is the Legal Material Collection Technique carried out by a card system (collecting system) material both legislation, documents, library materials and other research results related to the subject matter. Processing techniques and legal material analysis, carried out qualitatively, legal materials are collected and analyzed descriptively (in parallel and coherently) in the form of description. Conceptual law enforcement and law enforcement as a process is realized with an indicator that the factors that influence the implementation of disciplinary law enforcement by Polri are guided by: Law enforcement / personal rules, infrastructure facilities that need to be held for disciplinary law enforcement processes for police members in cultural factors, Constraints - constraints faced by Polri Discipline Enforcement in realizing Good Governance and Clean Governance. The police are expected to behave and behave in a consistent manner with the vision, mission, code of ethics built by the Indonesian National Police. In its implementation there is still the interference of state officials, the political elite towards the implementation of Polri's duties so as to influence the disciplinary members of the National Police.

Abstract

Kredit Usaha Rakyat merupakan tindak lanjut dari ditandatanganinya Nota Kesepahaman tanggal 9 Oktober 2007 tentang Pembiayaan kepada UMKM dan Koperasi antara Pemerintah, Perusahaan Penjamin, dan Perbankan. Kredit ini dijamin oleh pemerintah melalui Askrindo dan Jamkrindo. BPD Bali Cabang Negara juga menyalurkan Kredit Usaha Rakyat, dari Kredit usaha rakyat yang disalurkan ada beberapa kredit yang mengalami kredit macet yang ditaksir sekitar 6-7 nasabah. Permasalahan dalam penelitian ini adalah apakah faktor-faktor penyebab kredit macet pada KUR di BPD Cabang Negara dan Penyelesaian Kredit Macet pada KUR di BPD Cabang Negara. Jenis penelitian yang digunakan adalah penelitian hukum empiris yaitu penelitian dilakukan karena adanya kesenjangan antara das sollen dengan das sein, dalam hal ini bahwa Kredit Usaha Rakyat yang diberikan kepada masyarakat diharapkan tidak bermasalah tetapi ternyata ada yang mengalami permasalahan khusunya dalam pengangsuran kredit. Hasil penelitian dalam skripsi ini adalah faktor penyebab kredit Usaha Rakyat macet adalah 1. Usaha yang dijalankan mengalami penurunan omzet karena beberapa hal seperti pengelolaan usaha yang kurang baik, pesaing usaha. 2. Usaha mengalami kebangkrutan atau sudah tidak berjalan lagi. 3. Dan nasabah perusahaannya mengalami force majeure. Penyelesian kredit macet dilakukan dengan beberapa cara yakni : 1) Rescheduling (penjadwalan ulang), 2) Reconditioning (persyaratan ulang), 3) Restructuring (rekstrukturisasi).

Abstract

The application of the National Health Insurance (JKN) membership requirement in the process of issuing a Certificate of Good Conduct (SKCK) has resulted in various problems, especially for those who are not registered as members. The purpose of this study was to evaluate the impact of the JKN membership requirement in the SKCK issuance process and identify the obstacles faced by the community. This study used a normative research method with legal analysis based on applicable regulations. The data used includes primary and secondary legal materials. The results showed that the regulation requiring JKN membership is contrary to the applicable law, namely Law Number 25 of 2009 concerning Public Services. This requirement creates obstacles in accessing public services that should be inclusive. This study examines the various challenges faced by the community in meeting these requirements and assesses their compliance with the principles of good public service. Policies that require JKN membership as a condition for issuing a Certificate of Good Conduct (SKCK) should be reviewed because they create barriers to accessing public services. Recommendations are made to remove these requirements in order to improve the inclusiveness and efficiency of public services.
