Abstract

Research with the theme of cancellation of freehold title in sale and purchase of land due to default aims to find out (1) How the procedure to cancel freehold title in sale and purchase of land due to default, and (2) How the legal consequence toward the cancellation of freehold title in sale and purchase of land due to default. This type of research used normative legal research which studying applicable laws and regulations in Indonesia. The source of legal materials were in the form of primary legal material, secondary legal material, and tertiary legal material and analysis was using hermeneutics analysis technique by interpreting legislation and studying more clearly the meaning contained in each article. The result of research shows that (1) the procedure to cancel freehold title in sale and purchase of land due to default is that the injured party may file a lawsuit in district court and PTUN (State Administrative Court), (2) legal consequence toward cancellation of freehold title in sale and purchase of land due to default is that the injured party has the rights to get legal protection and acquiring compensation from the default party.

Abstract

The protection of workers and workers gets special attention in the concept of the rule of law relating to human rights. The issue of termination of employment has received an additional burden since the entry of the Covid-19 pandemic. Protection for workers and workers in the current pandemic situation can be linked to the concept of the rule of law related to the context of Human Rights. The COVID-19 pandemic has had a negative impact on the national economy. This of course can trigger companies to terminate their employment, because some companies are no longer able to pay the salaries of their workers. The termination of employment is considered to be a path that must be used by employers to avoid significant losses. This will certainly have an impact on increasing the number of unemployed in Indonesia.

Abstract

Development of taxation should be increased, if not fostered community members resulted inthe taxpayer less responsible and less participate in bearing the burden of the state and in maintainingthe continuity of the national development program. To further enhance the role of the taxpayer inreceipt of state sector of taxes necessary to have a law reform national tax, with the aim of furtherconfirm the independence of the nation to finance national development with the road more on the bestof our ability through increased state revenue through taxation, simplifying the tax system that includesthe type tax, tax calculation of tax payment and tax records, fix the taxation apparatus both concerningthe work procedures, work discipline and mental tax officials, tax burden more fair and reasonable, sothat on the one hand to encourage taxpayers consciousness paying taxes and on the other hand shallThe new tax increases. Law - Tax Law has encountered several improvements and is currently in useAct 16 of 2009 which is to amend Law No. 6 of 1983. Law No.36 of 2008 is an amendment to Law No.7 of 1983 on Income Tax, and Law 42 of 2009 is the change in the Act 8 of 1983 on Value Added Taxand the Goods and Services Sales Tax on luxury goods. In practice, if done auction, items auctionedprice could be lower than the normal price. This could result in losses for taxpayers because the nutrientobject sold at below market prices. Moreover, a thing that is impossible to do by the taxpayer is toreclaim the goods that have been auctioned off, because it belongs to the auction winner based on theminutes of the auction. For that we need a legal protection for the taxpayer / undertaking Taxes on theimplementation of the seizure and auction. Taxpayer / Tax Insurers have the right remedy for the implementation of seizure and auction in question.

Abstract

Kredit Usaha Rakyat merupakan tindak lanjut dari ditandatanganinya Nota Kesepahaman tanggal 9 Oktober 2007 tentang Pembiayaan kepada UMKM dan Koperasi antara Pemerintah, Perusahaan Penjamin, dan Perbankan. Kredit ini dijamin oleh pemerintah melalui Askrindo dan Jamkrindo. BPD Bali Cabang Negara juga menyalurkan Kredit Usaha Rakyat, dari Kredit usaha rakyat yang disalurkan ada beberapa kredit yang mengalami kredit macet yang ditaksir sekitar 6-7 nasabah. Permasalahan dalam penelitian ini adalah apakah faktor-faktor penyebab kredit macet pada KUR di BPD Cabang Negara dan Penyelesaian Kredit Macet pada KUR di BPD Cabang Negara. Jenis penelitian yang digunakan adalah penelitian hukum empiris yaitu penelitian dilakukan karena adanya kesenjangan antara das sollen dengan das sein, dalam hal ini bahwa Kredit Usaha Rakyat yang diberikan kepada masyarakat diharapkan tidak bermasalah tetapi ternyata ada yang mengalami permasalahan khusunya dalam pengangsuran kredit. Hasil penelitian dalam skripsi ini adalah faktor penyebab kredit Usaha Rakyat macet adalah 1. Usaha yang dijalankan mengalami penurunan omzet karena beberapa hal seperti pengelolaan usaha yang kurang baik, pesaing usaha. 2. Usaha mengalami kebangkrutan atau sudah tidak berjalan lagi. 3. Dan nasabah perusahaannya mengalami force majeure. Penyelesian kredit macet dilakukan dengan beberapa cara yakni : 1) Rescheduling (penjadwalan ulang), 2) Reconditioning (persyaratan ulang), 3) Restructuring (rekstrukturisasi).

Abstract

Di Indonesia peraturan mengenai pertanahan diatur dalam Undang-undang Pkok Agraria yakni Undang-Undang Nomor 5 tahun 1960. Pada prinsipnya, Undang-Undang Pokok Agraria yakni Undang-Undang Nomor 5 Tahun 1960 telah mengatur tentang larangan kepemilikan tanah oleh Warga Negara Asing. Hal tersebut merupakan cerminan dari asas nasionalisme sebagaimana diatur dalam Pasal 21 Ayat (1), yang menyatakan hanya warga-negara Indonesia dapat mempunyai hak milik. Semangat nasionalisme yang ditegaskan dalam Pasal 21 Ayat (1) tersebut telah memberikan hak penuh bagi Warga Negara Indonesia untuk mengelola bumi dan ruang angkasa dengan tidak membedakan antara laki-laki dengan wanita serta sesama Warga Negara Indonesia baik asli maupun keturunan yang dihasilkan dari suatu perkawinan yang sah. Selanjutnya, apabila dikaji lebih mendalam mengenai hal tersebut di atas maka esensi Pasal 21 Ayat (1) dalam Undang-Undang Pokok Agraria tersebut bertujuan untuk menjaga agar tanah tetap menjadi hak milik negara atau Warga Negara Indonesia, karena apabila tanah tersebut dikuasai oleh Orang Asing secara penuh atau dengan waktu yang cenderung lama, maka akan dikhawatirkan kesejahteraan rakyat akan berkurang dalam pengelolaan atas tanah.

Abstract

This study discussed the implementation of prison admission during the transitional period towards endemic at Class II A Kerobokan Women's Prison. The situation in different elements of the world community's life, particularly in Indonesia, is gradually improving because the country has entered a transitional stage into endemic status. This condition is one of the factors considered by the government when enacting new policies, such as the Adjustment of Correctional Services by the Ministry of Law and Human Rights of the Republic of Indonesia. The purpose of this study was to examine how prison admission was implemented at Class II A Kerobokan Women's Prison during the transitioning period to endemic. The empirical legal research method was adopted, with a direct approach to the field. In this study, the authors found out that the implementation of prison admission during the transition to endemic period still referred to the Decree of the Director General of Corrections Ministry of Law and Human Rights of the Republic of Indonesia Number: PAS-170.PK.01.01.02 of 2015 concerning Standards for Registration and Classification of Prisoners and Detainees. The prison admission remained in accordance with the Standard Operating Procedures (SOP) contained in the regulation. However, there are several adjustments due to the transition period which has been listed in the Decree of the Director General of Corrections of the Ministry of Law and Human Rights of the Republic of Indonesia Number PAS-04.OT.02.02 of 2023 concerning Adjustments to the Implementation of Correctional Services During the Transitional Period Towards Endemic. Several additional provisions that apply include admission carried out in stages considering the occupancy capacity equipped with rapid or swab letters with non-reactive results, carrying out health screening according to procedures, and continuing to carry out intensive coordination with Law Enforcement Officials, the local Covid-19 Task Force, and stakeholders.

Abstract

The integration of electronic systems into the judicial process represents a significant advancement in legal practice. The advent of e-Court and electronic mediation represent a broader trend towards integrating technology to improve the efficiency and reach of judicial processes. This study aims to find out the stages of implementation of Supreme Court Regulation Number 3 of 2022 concerning Electronic Mediation in the jurisdiction of the Denpasar District Court, and the inhibiting factors of the implementation of the regulation in this jurisdiction. The study provides valuable insights into the practical application of electronic mediation, highlights challenges faced in the field, and offers recommendations for improving the regulatory process and overcoming obstacles. This research could evaluate how legal representatives support parties in fulfilling their rights and obligations during electronic mediation. Additionally, investigating the specific obstacles related to software and human resources could provide insights into how these challenges impact the mediation process.

Abstract

The implementation of electronic trials (e-Litigation) at the Denpasar District Court is a significant step forward in the modernization of the judicial system. This study aims to find out the implementation of the electronic trial and the obstacles encountered during its implementation. The research contributes by providing insights into the practical challenges of adopting electronic trials in a specific judicial context, potentially offering recommendations for overcoming these obstacles. The findings could be valuable for policymakers, legal practitioners, and other courts looking to optimize their own implementation of e-Court.

Abstract

Wiretapping, the act of intercepting conversations, is often viewed as a violation of human rights, particularly within law enforcement contexts. This research investigates the stages involved in implementing wiretapping as a means to uncover criminal offenses, while also identifying the challenges faced by the Bali Police in this process. Employing a normative research method complemented by empirical analysis, the study gathers data from various primary and secondary legal sources. This research aims to determine the stages of wiretapping implementation in uncovering criminal offenses and identify the obstacles faced by Bali Police in the process. The study reveals that while legal frameworks governing wiretapping exist, their practical application remains hindered by these obstacles. The mastery of advanced technology is essential for effective wiretapping, yet many investigators lack adequate training and resources. Additionally, external constraints, such as outdated equipment or insufficient legal support, further complicate the implementation process. In conclusion, this research highlights the dual nature of wiretapping as both a valuable tool for law enforcement and a potential infringement on individual privacy rights. Addressing the identified challenges is crucial for enhancing the effectiveness of law enforcement while ensuring the protection of citizens' rights. By improving technological proficiency and overcoming external limitations, Bali Police can better utilize wiretapping in their efforts to combat crime while respecting the principles of privacy and human rights.

Abstract

This research discusses the legal protection of protected animals under the Law on Conservation of Living Natural Resources and Ecosystems in Indonesia. The existence of protected animals is increasingly threatened, so an understanding of the applicable law is important to prevent violations. The objectives of this study are to (1) determine the legal protection of protected animals, and (2) evaluate the legal consequences of Decision Number 809/PID.SUS/2024/PN DPS on the protection of protected animals. The research method used is normative legal research with a statutory approach, case approach, and conceptual approach. Data collection was conducted through a literature study that involved reading, reviewing, and recording relevant legal sources. The results showed that the legislative framework in Indonesia for the protection of protected animals is regulated in Law No. 5 of 1990, which has been amended into Law No. 32 of 2024. Decision number 809/PID.SUS/2024/PN DPS shows that there are positive and negative impacts on animal protection, where although there are considerations of justice, there is potential for future law violations. This research concludes that the legal protection of protected animals in Indonesia requires strengthening in law enforcement and increasing public awareness. Recommendations are proposed to increase socialization on the types of protected animals and the sanctions that apply to violations.
