Abstract

Abstrak - Hasil penelitian menunjukkan bahwa perbandingan pengaturan pemberantasan human trafficking di Indonesia dan Malaysia dapat dilihat dari subjek hukum, objek hukum, penjara minimum dan maksimum, serta perlindungan pelapor, saksi dan korban serta hal-hal yang dilarang. Perbedaannya terletak di lamanya masa ancaman penjara maksimum, banyaknya jenis ancaman pidana di masing-masing perundang-undangan. Kelebihan pengaturan tindak pidana perdagangan orang di Indonesia adalah lebih konkritnya tentang siapa itu subjek hukum dalam tindak pidana perdagangan orang, penjara maksimum lebih tegas, semua pasal ancaman pidana terdapat ancaman pidana minimum, jenis ancaman pidana lebih banyak, terdapat ancaman pidana pokok dan pidana tambahan untuk badan hukum. Sedangkan kekurangannya ialah, tidak mengatur wilayah perpanjangan, serta tidak mengatur tentang adanya Dewan Anti Perdagangan Orang.Kata Kunci : Indonesia, Komparatif, Malaysia, Perdagangan. Abstract - The research shows that the similar norms on the elimination of human trafficking in Indonesia and Malaysia legally, minimum existence and maximum prisons, and also the protection of whistleblowers, witnesses and victims and prohibited items. The difference lies in the duration of the maximum prison threat, the number of criminal threats in each legislation. The advantages of setting up trafficking in persons are more concrete about who is the subject of the law in the crime of trafficking in persons, the maximum prison more firmly, all articles of criminal penalty there is a minimum criminal threat, more types of criminal penalties, there are additional criminal and criminal penalties for the legal entity. While the drawbacks are, do not regulate the extension area, and does not regulate the existence of the Anti-Trafficking Council of Persons. Abstract

The rapid development of information and communication technology (ICT) has increased the risk of cybercrime in Indonesia. Law enforcement against this crime faces various obstacles and challenges, both in terms of regulations, the capacity of law enforcement officials, and public awareness. This study aims to analyze the obstacles and challenges in law enforcement against violent crime in Indonesia and provide recommendations to improve its effectiveness. Through a qualitative approach with a case study method, this study uses primary data from interviews with law enforcement officials, academics, and cybersecurity practitioners, as well as secondary data from laws and regulations and related reports. The results of the study show that existing regulations, such as the Electronic Information and Transaction Law (ITE Law), still have weaknesses in accommodating the development of cybercrime. In addition, limited human and technological resources in law enforcement institutions, as well as low public awareness of cybersecurity, also hinder the effectiveness of law enforcement. To address these challenges, the study recommends more adaptive regulatory revisions, capacity building of law enforcement officials through more advanced training and technology, and public education campaigns to increase public awareness of cybersecurity. In addition, international cooperation needs to be strengthened to deal with transboundary crimes.
