Abstract

Di Gampingan terdapat suatu spot panjat tebing yang unik dan sangat menarik untuk dijadikan destinasi wisata alam yang cocok untuk dikunjungi yaitu “Lembah Kera”. Selain “Lembah Kera” juga terdapat tempat wisata lainnya di desa Gampingan yang menawarkan aneka masakan ikan air tawar segar yaitu Mahonian. Tetapi tempat destinasi wisata di desa Gampingan tersebut masih awam didengar oleh masyarakat atau wisatawan di luar Malang dan sekitarnya. Karena problem tersebut maka perlu dibuat suatu media promosi secara elektronik yang bisa menjangkau masyarakat lebih luas agar destinasi wisata desa Gampingan bisa terkenal dan makin banyak pengunjung yang mengunjungi tempat wisata di desa Gampingan. Media promosi yang lagi berkembang sekarang ini adalah melalui media social (facebook, twitter, instagram dan whatsapp) tetapi selain menggunakan social media seharusnya desa harus memiliki portal sendiri yang berisi informasi tentang wisata desa tersebut. Oleh karena itu perlu di generate sebuah website desa yang nama domain sudah mengikuti peraturan kominfo tentang penataan nama domain instansi penyelenggara negara, yang mengharuskan desa memiliki domain website sendiri yaitu desa.id. Dengan domain desa.id diharapkan agar nama domain lebih mudah diakses oleh publik dengan lebih singkat dan jelas. Selain itu juga menjadi bukti nyata, bahwa desa dapat maju, mandiri, dan unggul.

Abstract

This study intends to review whether the right to choose a spouse for the guardian of marriage is still relevant to be applied in this era. This research is a field study that uses a social approach through the process of observation, interview, and document study. The populations and samples that have been obtained are then analyzed using deductive and inductive methods. The results of this study are the right of ijbar (the right to choose a partner for marriage guardians) is no longer relevant to be applied, this is because in Indonesia there is already a marriage law in which there is a clause that marriage must be carried out based on the approval of the two prospective brides, while on the other hand the unilateral coercion is very contrary to the concept of gender equality and justice and is a form of accumulation of gender discrimination. Forced marriage is heavily fraught with marginalization, subordination, stereotypes, violence and will increase the potential for the workload

Abstract

Amid the advancement of technology and the digital economy, cryptocurrency has begun to attract attention as an alternative form of dowry (mahr). However, its use remains controversial. The Indonesian Ulema Council (MUI) prohibits cryptocurrency as a means of payment due to elements of garar (uncertainty), ḍarar (harm), and qimār (speculation/gambling). On the other hand, the Commodity Futures Trading Regulatory Agency (Bappebti) and the Financial Services Authority (OJK) recognize cryptocurrency as a legal commodity for trading. This research aims to describe the legitimacy of using cryptocurrency as dowry in marriage in Indonesia and analyze it based on maqāṣid al-syarī‘ah according to Jasser Auda. This is a normative legal research using a conceptual approach. Data was collected through literature studies, including primary, secondary, and tertiary legal materials, as well as relevant non-legal sources. The analysis is conducted qualitatively by interpreting the legal materials obtained.The research findings show: First, from the perspective of positive law, cryptocurrency is recognized as a legitimate commodity, although not a legal tender. In Islamic law, cryptocurrency can be used as dowry as long as it has clear value, is mutually agreed upon, and is free from prohibited elements. To overcome volatility, asset-backed crypto or conversion to official currency can be used. Second, based on Jasser Auda’s systems theory, cryptocurrency can be accepted as dowry if it meets the principles of maqāṣid al-syarī‘ah, such as justice, public benefit, and mutual agreement, and is conducted transparently through regulated platforms.
