Abstract

Globalization has now penetrated various sectors, including the Tourism Business Sector. One of the characteristics is the process of digitization in all fields, which in turn brings about changes in the implementation of the law. This paper will discuss the issue of optimizing consumer protection in the context of the emergence of new contract forms, namely standard digital contracts in the business world and the presence of a new cross-borderless market mechanism, known as the Digital Global Market or Marketplace. This research will formulate two issues related to how to regulate consumer protection policies for users of the global digital market platform services about dispute resolution? Then about how to model digital contract arrangements as an effort to optimize consumer protection? Where the writing uses a normative research method, either through the approach of legislation, cases, comparisons, and comparisons, which are presented descriptively, evaluatively, and presenting arguments that are expected to be able to contribute ideas for legal development in the world of tourism business.

Abstract

Seperti kita ketahui level pemerintahan desa, kekuasaan dipegang oleh Kepala Desa bersamaperangkat desa yang berada dibawah kepemimpinan seorang Bupati sebagai pemegang kekuasaanpemerintahan tertinggi di Kabupaten dan/atau Walikota di tingkatan Kota. Penyelenggaraanpemerintahan desa baik juga dalam hal pembangunan, pembinaaan masyarakat desa harusdidasari atas Pancasila sebagai Staaffundamentalnorm, UUD 1945, konsep Negara KesatuanRepublik Indonesia dan juga Bhineka Tunggal Ika. Pedoman mutlak dalam penyelenggaraanpemerintahan desa tersebut diatur dalam Pasal 2 Undang-Undang Nomor 6 Tahun 2014 TentangDesa. menjalankan pemerintahan, pemegang kekuasaan pemerintahan baik pusat maupun didaerah berwenang untuk mengeluarkan suatu kebijakan terkait diskresi dalam jabatannya.Walaupun demikian, kebijakan tersebut tetaplah harus berlandasakan pada hukum positifyang berlaku. Dalam pembentukan peraturan pemerintah baik pusat maupun daerah tetap wajibberpedoman pada ketentuan dalam Undang-Undang Nomor 12 Tahun 2011 Tentang PembentukanPeraturan Perundang-Undangan (selanjutnya disebut “UU 12/2011”). Dalam kaitannya denganpemerintahan desa, terdapat bentuk peraturan yang dikenal dengan Peraturan Desa atau Perdes.Hal ini diatur dalam Pasal 26 UU Desa sebagai landasan yuridis. Namun, dalam Pasal 7 UU12/2011 tidak ditemukan bentuk peraturan tersebut dalam hierarki peraturan perundang-undangandi Indonesia. Perdes merupakan bentuk diskresi aparatur pemerintahan di level desa, berdasarkanFreies Ermessen. Kendatipun demikian, pelaksanaannya bukanlah tanpa batasan. Hukum bertugasuntuk mengambil peranan mencegah dan mengantisipasi kesewenang-wenangan.

Abstract

Dibentuk pada Tahun 1999 lalu yang membawa tujuan mulia dan bersahabat bagi antar negara anggota untuk mewujudkan stabilitas perekonomian internasional. G20 mengadakan KTT pertamanya pada November 2008 guna membahas krisis keuangan global yg merupakan dampak dari krisis keuangan di AS pada masa itu. Pertemuan rutin yang diadakan setiap tahun ini memiliki tuan rumah atau Presidensi yang ditentukan secara konsensus yang akan bergiliran setiap tahunnya. Tahun 2022 ini adalah kesempatan milik Indonesia. Negara-negara dalam G20 adalah negara yang punya peranan besar dalam perekonomian. Negara-negara dimaksud diantaranya adalah Argentina, Australia, Brazil, Kanada, Cina, Uni Eropa, Jerman, Prancis, India, Indonesia, Italia, Jepang, Meksiko, Rusia, Arab Saudi, Afrika Selatan, Korea Selatan, Turki, Britania Raya/Inggris, Amerika Serikat. Tujuan dalam penelitian ini adalah untuk mengetahui Bagaimanakah sistem lalu lintas devisa dan sistem nilai tukar di Indonesia dalam mendukung Indonesia menarik penanam modal asing. Metode penelitian ini adalah metode penelitian yuridis normatif yaitu dalam penelitian hukum ini, hukum dikonsepkan sebagai apa yang ditulis dalam peraturan perundang-undangan (law in books) atau hukum dikonsepkan sebagai kaidah atau norma yang merupakan patokan berperilaku manusia yang dianggap pantas. Berdasarkan hasil penelitian dahulu G20 telah membahas mengenai isu bangkitnya dari krisis global. Kini perkembangan dan kemajuan iptek telah membuat perubahan signifikan khususnya di jalur lalu lintas devisa. Telah tercipta dunia tanpa batas negara atau disebut sebagai dunia digital. Segala perubahan tentunya membawa pengaruh buruk dan baik sekaligus. Maka penting untuk mengkaji, meneliti dan menganalisis Optimalisasi model kebijakan yang seharusnya dibentuk dalam pertemuan ini agar sesuai dengan kebutuhan dan perkembangan masyarakat global dan mengkaji, meneliti dan menganalisis langkah preventif untuk dapat mencegah kerugian negara akibat adanya lalu lintas devisa yang crossborderless.

Abstract

The determination of a public policy is of course always faced with the problem of budget constraints which often puts the government in a trade-off situation which is defined as a dilemma condition that makes it difficult to make choices in determining priorities. This is what makes many policies that are not effectively implemented. The neglect of community expectations has resulted in negative reactions ranging from acts of violation even to anarchy that leads to crime. For this reason, it is deemed very important for the government to have a strategy in setting a priority scale so that a policy is more beneficial to people's lives, not just focusing on legal certainty. For this reason, the main problem is related to the efforts of the Regional Government in determining the priority scale so that an implementation of public policy is truly on target.

Abstract

The rule of law is obliged to uphold the enforcement and protection of human rights (HAM), related to the survival of mankind, so this issue is very important. Indonesia in its capacity as a subject of international law has made an agreement on the Declaration of Human Rights, this is evidenced by the stipulation of the 1999 Human Rights Law. Optimization steps related to efforts to uphold and protect human rights are continued by focusing attention on environmental issues (LH) and sustainability through sustainable development. Development Goals (SDGs), specifically regarding environmental issues, agreed on the Rio Declaration which established 27 principles regarding the protection and management of the environment which are very closely related to human rights. One of the efforts in this regard is to look at the actors that contribute to pollution and the biggest pollution, namely the industrial sector, especially corporations. The solution to this is the establishment of corporate responsibility or CSR. However, these programs are often done for nothing. Fulfill the formal requirements regulated in positive law. This is what is interesting to study, research and analyze further through two issues, namely related to the nature of CSR implementation and also arrangements for setting certain CSR criteria or standards for companies in certain fields in Indonesia in the context of fulfilling human rights to enjoy a clean and healthy environment and evaluating on the constraints of implementing CSR in the context of implementing its arrangements for MNCs.

Abstract

The different legal systems of countries in the world make many international conventions available, such as UNIDROIT, UNCITRAL, CISG, COMECON, and so forth. Despite this, the conventions have not been able to fully accommodate the interests of the parties in conducting international relations. The intended international relations can be in the form of political relations and also commercial business. Many conventions at the UN, but do not necessarily require all members to follow and submit to the contents of these conventions. One of the requirements to legitimize a convention in the national domain is to ratify the convention. Then practice it in his national legal culture. Lex Mercatoria exists as a flexible international law both for adherents of the Civil Law System, Anglo Saxon and the Socialist legal system. One organization that specifically regulates world trade is the WTO or World Trade Organization, which also regulates ways of international dispute resolution. The methods practiced by the WTO were later gradually used as international customs for various countries in the world, moreover for Indonesia which officially became a member of this organization. Indonesia also hereby issues national regulations in order to adapt to international customs in the world, one of which is the issue of transnational dispute resolution. So that in this case will be further studied and analyzed regarding: a). How is the implementation of the lex mercatoria principle in carrying out international business contracts implemented in cross-country relations between UN member states? and b). What is the mechanism for resolving business disputes in the event of default or unlawful conduct across the United Nations member states?
