Abstract

Pengambil alihan lembaga perbankan mengakibatkan peralihan pengendalian perusahaan. Implikasi peralihan jenis Bank Konvensional menjadi Bank Syariah akan mengubah seluruh peraturan dan mekanisme perusahaan yang akan disesuaikan dengan ketentuan Undang-Undang Perbankan Syariah dan Peraturan Otoritas Jasa Keuangan yang mengatur tentang kegiatan usaha Bank Syariah. Atas perubahan jenis tersebut, Bank harus menyelesaikan seluruh komponennya salah satunya adalah yang menyangkut hak dan kewajiban Bank Umum Konvensional ke sistem Bank Syariah dalam jangka waktu 1 (satu) tahun sejak memperoleh persetujuan dari Otoritas Jasa Keuangan. Penyelesaian hak dan kewajiban tersebut termasuk melaksanakan perubahan terhadap Perjanjian Kredit pada seluruh debitur karena Perjanjian Kredit antara debitur dengan Bank selaku kreditur merupakan dasar pelaksanaan penyelesaian pelelangan atas jaminan debitur apabila terjadi sengketa kredit macet di kemudian hari.

Abstract

PT MPAM as an Investment Manager who trades one of the instruments in the form of mutual funds in the form of KIK and shares. In this case PT MPAM did not carry out its obligations in terms of making phase II refund payments to approximately 6,000 customers as a result of the dissolution of 6 (six) mutual fund products. For this reason, PT MPAM did not fulfil the statutory provisions, namely Article 27 of Law No. 8 of 1955 in conjunction with Article 47 letter b, Article 61 letter b and Article 63 letter g of OJK Regulation Number 23/POJK.04/2016, which resulted in a default . PT MPAM does not comply with the statutory provisions as mentioned above, which does not carry out its obligations as an Investment Manager to make payment of refunds for phase II dissolution of 6 (six) mutual fund products which causes Customers to suffer losses of approximately 6 (six) Trillion. The second stage payment was promised to be made in an in-kind scheme on 18 May 2020 but for 2 years PT MPAM did not carry out its obligations or achievements, so in this case PT MPAM must be responsible for the losses of customers as regulated in Article 111 of Law No. 8 1955 in conjunction with Article 29 of OJK Regulation No. 1/POJK.07/2013. In addition, PT MPAM is also liable on the basis of default in accordance with Article 1243 of the Civil Code, where all elements of the default have been fulfilled. Abstract

The Financial Services Authority (Otoritas Jasa Keuangan/OJK) has made efforts to promote inclusive financial services for persons with disabilities through Regulation No. 6/POJK.07/2022 concerning Consumer and Community Protection in the Financial Services Sector, along with the OJK Operational Technical Guidelines (PTO) for providing services to persons with disabilities. However, in practice, several barriers remain, particularly for persons with visual disabilities when opening savings accounts at banks, due to difficulties related to the use of fingerprints in banking documentation. This study aims to critically examine the effectiveness of POJK No. 6/POJK.07/2022 and the PTO OJK in ensuring inclusive financial services for persons with disabilities in the banking sector. This research employs a normative-empirical legal method. Fieldwork was conducted in Surabaya through interviews with informants from Kedaibilitas and HWDI Surabaya. The findings reveal that the implementation of OJK regulations and guidelines in the banking sector has not been fully realized. Adopting an equality-based approach and human rights-based policy formulation is crucial in developing inclusive banking services. Otoritas Jasa Keuangan (OJK) berupaya mengakomodasi hadirnya layanan jasa keuangan yang inklusif bagi penyandang disabilitas melalui POJK Nomor 6/POJK.07/2022 tentang Perlindungan Konsumen dan Masyarakat di Sektor Jasa Keuangan beserta Petunjuk Teknis Operasional (PTO) OJK untuk pelayanan keuangan kepada penyandang disabilitas. Namun demikian, di lapangan masih terdapat sejumlah hambatan bagi penyandang disabilitas, khususnya disabilitas netra dalam membuka rekening tabungan di bank, karena hambatan penggunaan sidik jari dalam dokumen perbankan. Penelitian ini bertujuan untuk mengkaji secara kritis efektivitas POJK No.6/POJK.07/2022 dan PTO OJK untuk pelayanan keuangan kepada penyandang disabilitas di sektor perbankan. Penelitian dilakukan menggunakan metode penelitian normatif-empiris. Studi lapangan dilakukan di kota Surabaya dengan melakukan wawancara kepada informan di Kedaibilitas dan HWDI kota Surabaya. Hasil penelitian menunjukkan penerapan aturan dan pedoman OJK di sektor perbankan masih belum diterapkan sepenuhnya. Pendekatan prinsip kesetaraan dan formulasi kebijakan berlandaskan HAM penting digunakan dalam menyusun kebijakan layanan perbankan yang inklusif.
