Abstract

Introduction to the Problem: The development of information and communication technology has brought significant changes to journalistic practices in Indonesia, particularly through the utilization of digital media and cyberspace in press activities. On the other hand, such developments have also given rise to various cyber threats against journalists, including account hacking, digital intimidation, doxing, dissemination of personal data, and criminalization through electronic media. These conditions create legal issues concerning the protection of press freedom and the digital security of journalists in carrying out their journalistic functions. Purpose/Study Objectives: This study aims to analyze the forms of legal protection afforded to journalists against cyber threats based on Law Number 40 of 1999 concerning the Press and Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 on Electronic Information and Transactions (ITE Law), as well as to examine the legal certainty of journalist protection within the digital sphere. Design/Methodology/Approach: This study employs a normative legal research method using statutory, conceptual, and case approaches. The legal materials consist of primary, secondary, and tertiary legal sources obtained through library research, which are subsequently analyzed qualitatively through methods of legal interpretation. Findings: The results of the study indicate that the Press Law and the ITE Law have normatively provided legal protection for journalists, both through guarantees of press freedom and regulations concerning cybercrime. However, such protection has not yet fully ensured legal certainty, as there remain overlapping regulations and the application of multi-interpretative provisions within the ITE Law that have the potential to criminalize journalists. Therefore, regulatory harmonization and the strengthening of digital security protection for journalists are necessary in order to safeguard press freedom and the protection of human rights in the digital era.

Abstract

ABSTRACT Purpose of the Study: This research aims to analyze the legal consideration that influence differences in a Supreme Court Decision and a Constitutional Court Decision in the Regional Head Election process in 2024, and these decisions’ implications on the age limit for regional head candidates in the 2024 regional general election in creating checks and balances in the government. Methodology: This research utilizes the normative legal research method with the jurisprudential approach, statute approach, conceptual approach, and analytical approach. The data were descriptively analyzed to obtain the research results on the interpretation of age limits for regional head candidates in the 2024 regional general election in the two decisions, namely the Decision of the Supreme Court No. 23P/HUM/2024 and the Decision of the Constitutional Court No. 70/PUU-XXII/2024. These differences led to a lack of legal certainty and a misalignment with the general principle of good governance that is in line with the checks and balances principle in the government. Results: The Decision of the Supreme Court No. 23P/HUM/2024 determines that the age limit for regional head candidates is calculated since the inauguration, while the Decision of the Constitutional Court No. 70/PUU-XXII/2024 regulates that it is calculated since the determination of candidate pairs. Such differences led to a lack of legal certainty, which impacts the implementation of the 2024 Regional Head Election. The legal implications are that these differences may potentially disturb the democratic and political participation processes, especially for the younger generation. The 2024 Regional Head Election applied the Decision of the Constitutional Court No. 70/PUU-XXII/2024, which regulates that the minimum age of regional head candidates is 30 years old for candidate governors and candidate vice governors, and a minimum of 25 years old for candidate regents, candidate vice regents, candidate mayors, and candidate vice mayors. This is calculated since the determination of candidate pairs, as they have passed the stages of the 2024 Regional Head Election.                                                                   Applications of this Study: The state institution and the government are expected to be more careful when issuing interpretations through decisions that equally have final, binding, and erga ormes characteristics to prevent the occurrence of a lack of legal certainty. There should be efforts to align regulations to prevent legal dualism, which may lead to conflicts and issues in society. Novelty/Originality of this Study: It provides an analysis of the Decision of the Supreme Court No. 23P/HUM/2024 and the Decision of the Constitutional Court No. 70/PUU-XXII/2024 on the age limit for regional head candidates and the implications of these decisions in creating governmental checks and balances. Keywords: Decision, age limit, regional head election, checks and balances. Abstract

This study aims to analyze the form of legal protection for communities around river areas affected by pollution caused by the tofu manufacturing industry and the factors that hinder its implementation. This study (Legal Protection For The Community of Kedungputri Village, Paron Subdistrict, Ngawi Regency Against River Pollution Caused By Tofu Industry Waste) uses a normative legal method with a statutory approach and a conceptual approach. The legal materials used include primary, secondary, and tertiary legal materials obtained through literature study. The analysis of legal materials was conducted qualitatively using a prescriptive analytical method. The results of the study indicate that legal protection for the community can be provided through preventive and repressive measures. Preventive protection is carried out through obligations to manage waste, the provision of Wastewater Treatment Plant (WWTP) facilities, as well as supervision and guidance by the authorized regional government. Repressive protection is carried out through the application of administrative sanctions against perpetrators of pollution and the obligation to restore the environment in accordance with applicable laws and regulations. Obstacles in the implementation of legal protection include low levels of compliance by business actors with environmental regulations, limited waste treatment facilities, low public awareness, cultural factors that prioritize deliberation, and suboptimal enforcement of sanctions against environmental violations in the area.

Abstract

The implementation of Law Number 12 of 2022 concerning Sexual Violence Crimes (TPKS Law) and the Law on the Protection of Witnesses and Victims in addressing the practice of victim blaming. This study employs a normative legal method with statutory, conceptual and case approaches. The results show that, normatively, the TPKS Law and the Law on the Protection of Witnesses and Victims have provided a victim-oriented framework of protection. However, in practice, there are still obstacles in the form of social stigma, victim blaming practices and limited institutional capacity, which result in low case reporting and suboptimal legal protection for victims of sexual violence in Indonesia.

Abstract

This study aims to comprehensively analyze the forms of legal protection for debtors regarding the imposition of late payment penalties in non-performing vehicle financing cases at the Madiun Branch of Kreditplus Finance. Using empirical legal research with a descriptive qualitative approach, the study reveals that legal protection is realized through preventive mechanisms, such as contract clause transparency, due date notifications, and credit restructuring, as well as repressive mechanisms via internal complaints, Financial Services Authority (OJK) mediation, and litigation. However, the implementation of this protection faces significant obstacles in the field. These obstacles include low debtor legal awareness, the dominance of unbalanced standard contracts, vulnerable economic conditions of the community, and technical banking operational constraints. In conclusion, although consumer protection regulations are available, the debtor's bargaining position in practice remains weak due to information asymmetry. Therefore, simplifying contract information and enhancing substantive oversight by the OJK are necessary to achieve justice and a sustainable balance of rights and obligations between creditors and debtors in the financial services sector.
