Abstract

Abstract- In Indonesia, the state has a state basis, namely Pancasila, Pancasila is also a source of law and basic norms for organizing government administration. Pancasila can also be interpreted as the ideals of the Indonesian nation. In realizing regional autonomy in the government administration system, basic norms are needed to achieve it. There is a need for harmony between Law Number 23 of 2014 concerning Regional Government and the 1945 Constitution as mandated by Pancasila. In Indonesia, the highest power holder is the central government, but the location of the Indonesian state is very wide and consists of large and small regions so that in carrying out its authority, the central government is obliged to provide the competent authority. The method used in this journal is normative juridical. To manage their respective regions is called decentralization or regional autonomy. The principle of the Unitary State of the Republic of Indonesia cannot be separated from the principle of Regional Autonomy Article 18 of the 1945 Constitution, therefore Regional Autonomy is a subsystem of the power system of the Unitary State of the Republic of Indonesia. then in aggregate it will contribute to national welfare. Meanwhile, one dimension of the decentralization policy is improving the quality of public services. The estuary of these characteristics is realizing the constitutional mandate, namely realizing general welfare and educating the nation's life.

Abstract

The purpose of this Community Service is to provide understanding and legal awareness for the community in using social media. Legal counselling was conducted in Keraswetan village, Geneng sub-district, Ngawi district and other legal issues related to the conditions of each village. The use of social media must be realised by the community in order to have a positive impact on the progress of society. In this almost digital age, there are still many violations of social media. The method used in this activity is in the form of a directed discussion which begins with counselling/lecture then continued with direct questions and answers. The participants were community members, especially women and local community leaders. The community does not fully understand the use of social media. Through this legal counselling activity, every citizen is expected to be able to utilise existing social media for positive and beneficial interests, and to be wise in social media. By understanding the law, it is expected that there will be an increase in public legal awareness.

Abstract

Pengabdian masyarakat memiliki tujuan untuk meningkatkan pemahaman kepada masyarakat mengenai pentingnya perizinan PIRT Dan sertifikasi halal pada produk UMKM di Desa Ngujung, Kecamatan Maospati, Kabupaten. Sosialisasi tentang perizinan PIRT dan sertifikasi halal Di Desa Ngujung diadakan pada tanggal 19 Desember 2023. Pelaksanaan Pengabdian masyarakat ini dilakukan dengan metode ceramah, tutorial, dan diskusi dalam hal ini peningkatan pemahaman peserta tentang manfaat mengurus PIRT dan sertifikat halal, persyaratan dan prosedur mengurus PIRT, sertifikat halal, Adapun indikator keberhasilan materi  yaitu peningkatan pemahaman peserta tentang manfaat sertifikasi halal, prosedur sertifikasi halal, dan kewajiban yang harus dilakukan setelah tersertifikasi halal. Hasil dari program pengabdian masyarakat ini adalah memahami pentingnya perizinan PIRT dan sertifikasi halal, dan termotivasi untuk melanjutkannya, memahami prosedur perizinan PIRT, dan memahami prosedur sertifikasi halal. dengan demikian, minat beli konsumen dan kepercayaan konsumen diharapkan meningkat dengan adanya nomor PIRT dan label halal. Selain itu juga diharapkan dapat meningkatkan penjualan produk dan kesejahteraan masyarakat di desa Ngujung, Kecamatan Maospati, Kabupaten Magetan

Abstract

Elections in Indonesia continue to evolve to enhance the quality of democracy and administrative effectiveness. The Constitutional Court Decision Number 135/PUU-XXII/2024 establishes the separation of national and regional elections, driven by organizer fatigue and the risk of declining political representation quality due to simultaneous elections, and demands adjustments to Law Number 7 of 2017 and Law Number 6 of 2020. This research uses a normative juridical method with legislative, conceptual, and case approaches. The research results show that the separation of elections strengthens administrative effectiveness, the quality of political representation, and government stability, while simultaneously creating two different funding cycles between the national and regional levels. The main findings emphasize the need for regulatory harmonization, cross-level fiscal coordination, and transparent oversight mechanisms to maintain fiscal legitimacy and the quality of democracy, as well as to demonstrate the structural implications of constitutional decisions on the legal system and electoral budget management.

Abstract

ABSTRACT Purpose of the Study: This research aims to analyze the legal consideration that influence differences in a Supreme Court Decision and a Constitutional Court Decision in the Regional Head Election process in 2024, and these decisions’ implications on the age limit for regional head candidates in the 2024 regional general election in creating checks and balances in the government. Methodology: This research utilizes the normative legal research method with the jurisprudential approach, statute approach, conceptual approach, and analytical approach. The data were descriptively analyzed to obtain the research results on the interpretation of age limits for regional head candidates in the 2024 regional general election in the two decisions, namely the Decision of the Supreme Court No. 23P/HUM/2024 and the Decision of the Constitutional Court No. 70/PUU-XXII/2024. These differences led to a lack of legal certainty and a misalignment with the general principle of good governance that is in line with the checks and balances principle in the government. Results: The Decision of the Supreme Court No. 23P/HUM/2024 determines that the age limit for regional head candidates is calculated since the inauguration, while the Decision of the Constitutional Court No. 70/PUU-XXII/2024 regulates that it is calculated since the determination of candidate pairs. Such differences led to a lack of legal certainty, which impacts the implementation of the 2024 Regional Head Election. The legal implications are that these differences may potentially disturb the democratic and political participation processes, especially for the younger generation. The 2024 Regional Head Election applied the Decision of the Constitutional Court No. 70/PUU-XXII/2024, which regulates that the minimum age of regional head candidates is 30 years old for candidate governors and candidate vice governors, and a minimum of 25 years old for candidate regents, candidate vice regents, candidate mayors, and candidate vice mayors. This is calculated since the determination of candidate pairs, as they have passed the stages of the 2024 Regional Head Election.                                                                   Applications of this Study: The state institution and the government are expected to be more careful when issuing interpretations through decisions that equally have final, binding, and erga ormes characteristics to prevent the occurrence of a lack of legal certainty. There should be efforts to align regulations to prevent legal dualism, which may lead to conflicts and issues in society. Novelty/Originality of this Study: It provides an analysis of the Decision of the Supreme Court No. 23P/HUM/2024 and the Decision of the Constitutional Court No. 70/PUU-XXII/2024 on the age limit for regional head candidates and the implications of these decisions in creating governmental checks and balances. Keywords: Decision, age limit, regional head election, checks and balances.   ABSTRAK Tujuan Penelitian: Penelitian ini bertujuan untuk mengetahui perbandingan pertimbangan hukum yang mempengaruhi perbedaan dalam putusan Mahkamah Agung dan Mahkamah Konstitusi dalam proses Pemilihan Kepala Daerah tahun 2024 dan implikasi putusan Mahkamah Agung dan Mahkamah Konstitusi dalam ambang batas usia calon kepala daerah pada Pemilihan Kepala Daerah tahun 2024 dalam menciptakan checks and balances di pemerintahan. Metode: Penelitian ini menggunakan metode penelitian hukum normatif dengan menggunakan pendekatan yurisprudensi, pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan analisis. Data dianalisis secara deskriptif hingga diperoleh hasil penelitian bahwa perbedaan pada kedua putusan, baik Putusan Mahkamah Agung Nomor 23P/HUM/2024 dan Putusan Mahkamah Konstitusi Nomor 70/PUU-XXII/2024, dalam penafsiran ambang batas usia calon kepala daerah tahun 2024 berakibat pada ketidakpastian hukum dan ketidaksesuaian dengan asas umum pemerintahan yang baik yang sejalan dengan prinsip checks and balances pemerintahan. Hasil penelitian: Putusan Mahkamah Agung Nomor 23 P/HUM/2024 menetapkan bahwa usia calon kepala daerah dihitung sejak pelantikan, sedangkan Putusan Mahkamah Konstitusi Nomor 70/PUU-XXII/2024 menyatakan bahwa usia dihitung sejak penetapan pasangan calon. Perbedaan ini menciptakan ketidakpastian hukum yang berdampak pada pelaksanaan Pilkada 2024. Kedua lembaga memiliki argumen hukum dan ada implikasi dari putusan tersebut terhadap sistem checks and balances dalam pemerintahan. Perbedaan pandangan antara Mahkamah Agung dan Mahkamah Kosntitusi tidak hanya mencerminkan ketidakpastian hukum, tetapi juga berpotensi mengganggu proses demokrasi dan partisipasi politik, terutama bagi generasi muda. Pelaksanaan Pilkada tahun 2024 menggunakan Putusan Mahkamah Konstitusi Nomor 70/PUU-XXII/2024, yang mengatur bahwa usia calon kepala daerah yaitu paling rendah 30 tahun untuk calon gubernur dan wakil gubernur, dan usia paling rendah 25 tahun untuk calon bupati dan wakil bupati serta calon walikota dan wakil walikota, yang dalam hal ini dihitung sejak penetapan pasangan calon karena telah melewati tahapan-tahapan Pilkada 2024. Penerapan Penelitian: Lembaga Negara dan Pemerintah diharapkan lebih teliti dalam menerbitkan penafsiran melalui putusan yang sama-sama bersifat final, mengikat, dan erga ormes, sehingga tidak terjadi adanya ketidakpastian hukum. Diharapkan adanya upaya harmonisasi peraturan untuk mencegah adanya dualism hukum, yang dapat menimbulkan konflik dan merugikan masyarakat. Kebaruan/Orisinalitas: Penelitian ini menelaah Putusan Mahkamah Agung Nomor 23P/HUM/2024 dan Putusan Mahkamah Konstitusi Nomor 70/PUU-XXII/2024 terkait ambang batas usia calon kepala daerah dan implikasi dari Putusan Mahkamah Agung Nomor 23P/HUM/2024 dan Putusan Mahkamah Konstitusi Nomor 70/PUU-XXII/2024 dalam menciptakan checks and balances di pemerintahan. Abstract

This study shows that the implementation of Regional Regulation of Ngawi Regency, Indonesia, Number 13 of 2012 concerning Waste Management has been carried out fairly well, although it still faces various obstacles. This study aimed to analyze the implementation of waste management policies and identify the supporting and inhibiting factors in Ngawi Regency, Indonesia. The method used was empirical legal research with a qualitative descriptive approach. Data were obtained through interviews with the Ngawi Regency Environmental Agency and literature studies consisting of laws and regulations, scientific journals, and official local government documents. Policy implementation was carried out through direct and indirect socialization, the establishment of 86 waste banks and 12 Tempat Pengolahan Sampah Reduce, Reuse, Recycle (TPS3R), the provision of supporting facilities, and the strengthening of derivative regulations related to restrictions on the use of single-use plastics. Supporting factors included increased public awareness, the commitment of regional leaders, and the involvement of external partners, such as schools, micro, small, and medium enterprises (MSMEs), companies, and communities. Meanwhile, inhibiting factors included low awareness among some members of the community, budget limitations, uneven waste transportation services, and high investment costs for modern waste processing technology. This study concludes that the effectiveness of policy implementation still requires stronger resources, equitable distribution of waste services, increased institutional capacity, and sustainable community education to realize integrated and sustainable waste management.

Abstract

The construction industry plays a strategic role in national infrastructure development, yet service providers often face legal vulnerabilities due to imbalanced contractual relationships with project owners. This study aims to analyze the forms of legal protection afforded to construction service providers and to identify the determinants of default (wanprestasi) in construction work contracts, with PT. Dash Lebang Perkasa as the case study. Employing an empirical legal research design (normative-empirical), this study utilizes a statute approach and a conceptual approach, drawing on primary legal materials, secondary literature, and empirical field data spanning from 2019 to 2025. The findings reveal that legal protection operates through three interconnected dimensions: regulatory-substantive protection grounded in the Indonesian Civil Code and Law Number 2 of 2017 on Construction Services; contractual protection through meticulously drafted clauses on payment mechanisms, variation orders, force majeure, and retention funds; and procedural protection fortified by the company's legal transformation from a partnership (CV) to a Limited Liability Company (PT) in 2023. Meanwhile, default determinants are multi-causal, encompassing internal factors (time management, human resource limitations, insufficient capital buffers, and logistics weaknesses) and dominant external factors, particularly delayed milestone payments by project owners that paralyze operational cash flow. This study contributes to construction law literature by offering a comprehensive framework for equitable contractual risk management.
