Abstract

One of the national goals of the State of Indonesia is to improve people's living standards, including in the health sector which is closely related to medicine. The management and distribution of drugs is strictly monitored by the government and can only be done at Pharmaceutical Service Facilities, one of which is a pharmacy. In The Minister of Health Regulation Number 14 of 2021 it is regulated that pharmacies can be operated by individual or non-individual business actors in the form of legal entities. This study wants to examine the implementation of The Minister of Health Regulation Number 14 of 2021 on the extension of pharmacy licenses. This study uses a legal research method with a statutory and conceptual approach. From the results of the study, it was found that the rules regarding the licensing of these pharmacies have been specifically regulated and the existing laws and regulations are coherent, but has not provided legal certainty for pharmacy business actors. The Minister of Health Regulation Number 14 of 2021 causes difficulties for business actors and the current OSS system is still unable to accommodate the needs of business actors.

Abstract

In the formation of regulations in Indonesia, it cannot be separated from the name of the principle of law because it includes the fundamental in forming a regulation so that it does not conflict with existing regulations, or with terms that are in the law, namely truth coherence. The principle of law is an important element of a rule of law, it can even be said to be the 'heart' of the rule of law. The principle of law will remain and will give birth to further regulations. Ultimately, the principle of law has a dual function, namely as the foundation of a positive legal system and as a critical test stone to the prevailing positive legal system. How does the binding force of the validity of the legal principle and what if there is the principle of law that is contrary to the principle of law. The research method used in this study is normative juridical, with two approaches namely; statute approach and conceptual approach, as for the formulation of the problem in this research is what should be done if the principle is contrary to the principle? The results of this study are that even though the principle contradicts the principle, the solution is to use the principle as a basis in a regulation that is made and see also the conflicting rules for what are the contradictions.

Abstract

Penelitian ini adalah untuk menganalisis dan memahami kesesuaian kekuasaan legislatif presiden setelah amandemen UUD 1945 terhadap prinsip-prinsip sistem presidensial. Penelitian hukum ini menggunakan pendekatan statuta, konseptual, komparatif, dan historis. Bahan hukum primer dan sekunder yang digunakan dalam penelitian ini dikumpulkan melalui literatur yang menyelidiki dan menginventarisir bahan hukum dengan dokumen, buku literatur, jurnal hukum, dan undang-undang yang terkait dengan objek penelitian. Bahan hukum yang telah diperoleh dijelaskan dan disajikan secara deskriptif dan analitik dengan menggunakan metode deduktif. Hasil penelitian menunjukkan bahwa kekuasaan legislatif presiden setelah amandemen UUD 1945 tidak sesuai dengan prinsip sistem presidensial pemerintahan secara eksplisit memisahkan kekuasaan eksekutif dan legislatif dalam sistem kekuasaan sebagai implementasi dari gagasan pembatasan negara kekuatan dan prinsip kedaulatan rakyat. Kekuasaan legislatif presiden setelah amandemen UUD 1945 cenderung melemahkan fungsi legislatif, menciptakan ketidakseimbangan antara eksekutif dan legislatif, dan menghambat realisasi legislasi sesuai dengan kehendak rakyat. Abstract

Abstract- In Indonesia, the state has a state basis, namely Pancasila, Pancasila is also a source of law and basic norms for organizing government administration. Pancasila can also be interpreted as the ideals of the Indonesian nation. In realizing regional autonomy in the government administration system, basic norms are needed to achieve it. There is a need for harmony between Law Number 23 of 2014 concerning Regional Government and the 1945 Constitution as mandated by Pancasila. In Indonesia, the highest power holder is the central government, but the location of the Indonesian state is very wide and consists of large and small regions so that in carrying out its authority, the central government is obliged to provide the competent authority. The method used in this journal is normative juridical. To manage their respective regions is called decentralization or regional autonomy. The principle of the Unitary State of the Republic of Indonesia cannot be separated from the principle of Regional Autonomy Article 18 of the 1945 Constitution, therefore Regional Autonomy is a subsystem of the power system of the Unitary State of the Republic of Indonesia. then in aggregate it will contribute to national welfare. Meanwhile, one dimension of the decentralization policy is improving the quality of public services. The estuary of these characteristics is realizing the constitutional mandate, namely realizing general welfare and educating the nation's life.

Abstract

Kesadaran masyarakat terhadap peraturan atau hukum sangatlah penting, selain untuk menjaga kepentingan individu atau kelompok juga menjamin terwujudanya kehidupan masyarakat yang adil dan makmur sesuai sila ke lima Pancasila. Termasuk kesadaran hukum masyarakat terhadap sertifikasi hak milik atas tanah hendaknya tidak hanya dipahami semata, akan tetapi juga sangatlah perlu dilaksanakan atau dijalankan oleh masyarakat secara umum dengan tujuan untuk menjaga hak-hak mereka terhadap tanah yang ia miliki atau kuasai. Kegiatan Pengabdian ini menggunakan metode pendekatan sosiologis dengan mendekatkan kepada masyarakat. Bahan materi diambil dari peraturan perundang-undangan, buku-buku, makalah-makalah dan dokumen-dokumen lain yang berkaitan dengan penelitian. Permasalahan yang diambil dari penelitian ini adalah bagaimana mendorong agar hak kepemilikan sertifikat tanah merupakan alat bukti yang kuat sehingga mema hami pentingnya pengurusan sertifikat tanah yang dimiliki menjadi sangat penting untuk dipahami bagi masyarakat RT 05-RW 05 Gayung Kebonsari Timur Kec. Ketintang Kota Surabaya.

Abstract

This study aims to analyze the role and responsibilities of notaries in drafting deeds relating to the renunciation or transfer of inheritance rights, and to examine their implications for creditor protection under civil and Islamic law. A normative juridical method was employed, utilizing statutory, conceptual, case-based, comparative, and fiqh mawaris approaches. The findings establish a fundamental distinction between renunciation of inheritance (verwerping van erfenis) under Article 1057 of the Indonesian Civil Code—which falls within the court's jurisdiction—and the transfer of inheritance rights formalized through notarial deeds under contractual freedom. Within Islamic inheritance law, the relevant concepts are not renunciation of inheritance but rather takharuj (التخارج) and tashaluh (التصالح), which are mechanisms for the consensual transfer of inheritance rights after such rights have vested, pursuant to the principle of ijbari. With respect to creditor protection, Islamic law explicitly prioritizes the settlement of debts over the distribution of inheritance, as stipulated in Surah An-Nisa verses 11–12, so that no agreement among heirs may lawfully prejudice the rights of legitimate creditors. Indonesian civil law, by contrast, continues to rely on repressive mechanisms such as actio pauliana under Article 1341 of the Civil Code and Article 1061, which have not provided adequate preventive protection. Comparative analysis with Dutch law (beneficiaire aanvaarding) and French law (renonciation à succession) underscores the need for comprehensive reform of Indonesian inheritance law. This study recommends strengthening notarial professional standards, developing more comprehensive regulations, and harmonizing Islamic inheritance principles with civil law within Indonesian notarial practice.   Keywords: Notary; Inheritance Renunciation; Takharuj; Creditor Protection; Islamic Inheritance Law

Abstract

This study examines the legal and professional practice of the role of notaries in regulating capital markets in Indonesia, focusing on the functions and responsibilities of notaries as public officials who play a role in ensuring legal certainty over documents and agreements that form the basis of capital market activities. In a regulatory context, the role of notaries is regulated by Law Number 2 of 2014 concerning the Office of Notaries, Law Number 8 of 1995 concerning Capital Markets, and various implementing regulations from the Financial Services Authority (OJK). Using a normative juridical approach, this study examines the involvement of notaries in the process of registering securities issuances, drafting deeds of establishment and amendments to issuers' articles of association, as well as ratifying underwriting agreements and information disclosure in the capital market. The results indicate that notaries play a strategic role in maintaining transparency, legality, and accountability in capital market activities, while also acting as a bridge between legal interests between issuers, investors, and regulators. However, field practice still presents challenges, such as a lack of understanding of capital market instruments among notaries and the potential for conflicts of interest in carrying out their duties. Therefore, it is necessary to improve the professional competence of notaries and align their professional code of ethics with the principles of good corporate governance to strengthen the integrity and effectiveness of legal oversight in the Indonesian capital market sector.

Abstract

Abstract Introduction to the Problem: The main problem in this study is the urgency of the moratorium policy for the establishment of the Regulation of the Ministry of Agrarian and Spatial Planning/National Land Agency (ATR/BPN) Number 2 of 2024 concerning Protected Rice Fields (LSD) and the moratorium policy is reviewed from the perspective of Utilization.  Purpose/Study Objectives: This study aims to analyze the urgency of the moratorium policy for the stipulation of the Regulation of the Ministry of Agrarian and Spatial Planning/National Land Agency (ATR/BPN) Number 2 of 2024 concerning Protected Rice Fields (LSD) and the moratorium policy from the perspective of Utilization. Design/Methodology/Approach: This study uses normative legal research methods with a statutory approach (Statue approach) and a conceptual approach (Conceptual approach). Legal materials consist of primary legal materials, secondary and tertiary legal materials and qualitative descriptive analysis is carried out. Findings: The urgency of the moratorium policy on Protected Rice Fields (LSD) as stipulated in the Regulation of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency Number 2 of 2024 is not just an administrative instrument, but a manifestation of progressive legal policies that also provide preventive legal protection against the threat of land degradation, which in turn makes a real contribution to national food sovereignty. From the point of view of legal benefits, the policy of suspending Protected Agricultural Land can be seen as an action of state intervention to achieve a balance between development interests and the protection of agrarian resources. Abstract

Abstract Introduction to the Problem: This study aims to determine the statute of limitations on the distribution of joint assets after divorce and the factors that hinder the implementation of the statute of limitations on joint assets after divorce. Purpose/Study Objectives: The application of the statute of limitations on the distribution of joint property after divorce based on the principle of legal certainty, and factors inhibiting the application of the statute of limitations on joint property after divorce. Design/Methodology/Approach: The research method used in this research is normative juridical by taking an approach to the Law. Law (statute approach) and conceptual approach (conceptual approach). Findings: There is a limitation on the period for filing a lawsuit for joint property acquired between husband or wife during the marriage to ensure legal certainty. The obstacles experienced regarding the application of the statute of limitations for joint property lawsuits can occur due to strong local customs, strong cultural influences between communities in each region, and a lack of understanding in the community regarding joint property. Therefore, the way to overcome this is by frequently socializing to provide an understanding to the community regarding what the statute of limitations and joint property are. Abstract

Introduction to the Problem: The problem arises from court rulings that disregard the rights of the husband and grant all of the marital property to the heir’s full siblings. This could potentially conflict with Article 852 of the Civil Code and the final draft of the regulations. Purpose/Study Objectives: To analyze the legal certainty regarding the division of inheritance from marital property in cases of marriages between people of different religions, as stipulated in the Civil Code (KUHPerdata), particularly in situations where there are no children and the husband serves as the heir. Design/Methodology/Approach: This study employs a normative legal approach, using both legislative and case-based analysis. The analysis is based on the Supreme Court’s ruling No. 1120 PK/Pdt/2025. Findings: The research findings show that, as a matter of principle, the husband is considered the first in line to inherit property. He also retains the right to his wife’s dowry, even in the absence of any children. Decisions that ignore these rights reflect a disconnect between legal norms and actual judicial practice, thereby creating legal uncertainty. Therefore, it is necessary for judges to apply the provisions of the Civil Code consistently, in order to ensure legal certainty, fairness, and protection of all parties involved in inheritance matters.
