Abstract

South China Sea (SCS) conflict starting from the issuance of new maps by People’s Republic of Tiongkok in 1947, mostly claim SCS territory to bring imaginary line called the nine dash line that is based on the historical aspect. Under the UNCLOS, a claim over a territory that is based on stale Historical not justified. The nine-dash line where tensions among countries in the Neighborhood SCS, including Indonesia. There are several peaceful dispute settlement mechanism of UNCLOS including conciliation, binding settlement, arbitration, special arbitration. SCS dispute settlement should use the methods of peaceful settlement that called diplomatic win-win solution. Asymmetric soft power diplomacy that takes into account the interests of both countries and organizations will be able to be an alternative dispute resolution SCS protracted, with a record of win-win solution can be felt directly to their dispute. The method used is using the method with the approach of the Statute Law Research Approach and Conceptual Approach, supported by Legal Materials Primary and Secondary Legal Materials.

Abstract

Reklamasi wilayah pesisir menjadi kian marak dipelbagai daerah, dengan dalih peningkatan investasi dan pendapatan daerah, perizinan untuk melakukan reklamasi seakan mudah, BUMN/BUMD atau swasta dijadikan mitra kerjasama oleh pemerintah sebagai pelaksana proyek reklamasi. Proyek reklamasi yang dilegalkan oleh pemerintah didasarkan atas akan adanya konservasi laut, investasi di wilayah pesisir dan pulau-pulau kecil, dan pembangunan hunian tepi laut. Padahal proyek reklamasi tersebut bersinggungan langsung dengan kehidupan masyarakat sekitar khususnya masyarakat nelayan di wilayah pesisir dan pulau-pulau kecil. Privatisasi dan komodifikasi sumber daya laut yang kemudian menggusur keberadaan masyarakat pesisir dan menghilangkan akses mereka terhadap penghidupannya, hal ini merupakan sebuah pelanggaran terhadap hak asasi manusia. Berdasarkan hal tersebut, masalah hukum yang akan dibahas dalam penelitian ini adalah pertama, kewajiban pemerintah dalam perlindungan hak asasi manusia terhadap masyarakat wilayah pesisir dan pulau-pulau kecil. Kedua, apakah Undang-Undang Nomor 1 Tahun 2014 tentang Perubahan atas Undang-Undang Nomor 27 Tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil dan peraturan dibawahnya telah memberikan akses perlindungan terhadap hak asasi masyarakat pesisir dan pulau-pulau kecil.

Abstract

Product promotion on Instagram by selebgram (celebrity endorser), Instagram users who have voluminous followers, is increasingly popular. It is not uncommon that the promoted products are sometimes not legally registered and possibly violate the law. This study analyses the regulations regarding promotion on social media in Indonesia as well as evaluates whether existing regulations govern business agents’ criminal Responsibility for their carried-out promotions on Instagram, as seen from the fact that such product promotion content made by selebgram has misleading information resulting consumers’ losses. The research method used is a legal research method with a regulatory approach and legal concepts. The result of this study indicates that if a business agent uploads a video which is misleading and potentially disadvantages consumers made by a selebgram, then the business agent is responsible for the upload. On social media, every user is responsible for their own account’s activities.

Abstract

The rejection on ratification of the revision of Indonesian Code Law or known as RKUHP and Corruption Law raises several opinions from various perspectives in social media. Twitter as one of many platforms affected, has more than 19.5 million users in Indonesia. Twitter is one of many social media in Indonesia where people can share their views, arguments, information, and opinions from all points of view. Since Twitter has a great diversity of users, it needs a system which is designed to determine the opinion tendency towards the problems or objects. The purpose of this study is to analyze the sentiment of Twitter users' tweets to reject the revision of the Law whether they have positive or negative sentiments using the Agglomerative Hierarchical Clustering method. The data that being used in this study were obtained from the results of crawling tweets based on hashtag (#) (#ReformasiDikorupsi). The next stage is pre-processing which consists of case folding, tokenizing, cleansing, sanitizing, and stemming. The extraction features Lexicon Based and Term Frequency (TF) which performs the process automatically. In the clustering stage, two clusters use three approaches; single linkage, complete linkage and average linkage. In the accuracy calculation phase, the writer uses the error ratio, confusion matrix, and silhouette coefficient. Therefore, the results are quite good. From 2408 tweets, the highest accuracy results are 61.6%.

Abstract

ABSTRAKKomisi Pemilihan Umum (KPU) membuat Peraturan KPU Nomor 26 Tahun 2018 tentang Perubahan Kedua Atas Peraturan KPU Nomor 14 Tahun 2018 tentang Pencalonan Perseorangan Pemilu Anggota Dewan Perwakilan Daerah yang khususnya diatur dalam Pasal 60A. Akan tetapi ketentuan pada peraturan tersebut diputus telah bertentangan dengan Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan, dan tidak boleh dimaknai berlaku surut oleh Mahkamah Agung dalam Putusan Nomor 65P/ HUM/2018. Atas adanya fakta hukum yang tidak koheren tersebut, diambil isu hukum terkait kepastian hukum dapat atau tidaknya calon anggota Dewan Perwakilan Daerah yang juga merupakan pengurus (fungsionaris) partai. Penelitian ini menggunakan metode penelitian hukum dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Hasil dari penelitian ini, pertama, terdapat kesesatan dalam penalaran hukum pada ratio decidendi Putusan Nomor 65P/HUM/2018. Kedua, putusan Mahkamah Agung tersebut dapat disimpangi oleh KPU, karena sebagaimana dalam kewenangan Mahkamah Konstitusi melakukan pengujian konstitusionalitas terhadap undang-undang yang bersifat erga omnes.Kata kunci: racio decidendi; penalaran hukum; Dewan Perwakilan Daerah.  ABSTRACT The General Election Commission (KPU) has enacted KPU Regulation Number 26 of 2018 concerning the Second Amendment to KPU Regulation Number 14 of 2018 over the Nomination of Individual Election of Regional Representative Council Members. The provisions of this regulation, especially Article 60A, contravene with Law Number 12 of 2011 concerning the Legislation Drafting Process. In the Decision Number 65P/HUM/2018, the Supreme Court should not retroactively interpret the KPU regulation. Due to the incoherent legal facts, legal issues raised in this article is about legal certainty whether a candidate of the Regional Representative Council (DPD) member can also become a political party official. This research uses legal research methods with normative, conceptual, and case approaches. The results of this research are as follows. The results of this research are as follows. First, there are errors in legal reasoning on the ratio decidendi of the Supreme Court Decision Number 65P/ HUM/2018. Second, the Supreme Court Decision can be distorted by the KPU because the court acted like the Constitutional Court reviewing an erga omnes law. Abstract

Purpose: The purpose of this research is to discuss health legal policy and the government responsibiliies in handling pandemic covid 19. Design/methodology/approach: The writing of this article is done in a normative juridical manner. The approach used is a conceptual and statutory approach. In analyzing the problem, it is done by interpreting the laws and regulations and relevant facts. Legal theories are used to analyze existing problems in handling COVID-19 and handling economic recovery. This writing is done by combining legal disciplines concerning administrative law, health law and economic law. Findings: Steps and legal policy have been taken to overcome the Covid-19 pandemic and improve the declining economy. This step requires a very large budget that is charged to the revenue and expenditure budget (APBN/APBD) and other posts that support the financing as regulated in Law No. 2 of 2020 concerning State Financial Policy and Financial System Stability for Handling the Covid -19 Pandemic, and Presidential Regulation No. 99 of 2020 which has been amended by Presidential Decree No. 14 Year 2021. Research limitations/implications: Legally, the use of the budget for handling Covid-19 and maintaining economic stability, as well as policies carried out at the discretion that has been determined, must be accounted for by the authorities. In the study of Administrative Law, the responsible steps of the authorities are always accompanied by supervision and sanctions in the event of a violation. Abstract

This research aims to analyze the legis ration of granting consignment for development in the public interest and to analyze the constitution providing legal protection for owners of land rights who refuse consignment. This research is a normative legal research with a statutory approach. The legal material analysis technique used in this research is to use descriptive techniques. The results showed that the legis ratio of consignment provisions was based on the social function of land rights as regulated in Article 6 of Law Number 5 of 1960 concerning Basic Agrarian Regulations. The consignment itself is regulated in Article 42 of the Land Acquisition Law. The constitution provides legal protection for owners of land rights who refuse consignment because it is the community's right to get the protection enshrined in the 1945 Constitution and Pancasila as the philosophy of life of the nation and as the Ideology of the Unitary State of the Republic of Indonesia. In the 1945 Constitution Article 28H paragraph (4) states that "every person has the right to have private property rights and such property rights may not be taken arbitrarily by anyone".

Abstract

The modern rule of law is a basic concept in every government activity. In the development of state administration, government activities are no longer just implementing laws as described in the trias politica concept, but also attaching the authority to make regulations, a decision that is regulating as a legal forum for policies issued. This study aims to analyze the legal position of the head of service/agency regulations that have been used in the administration of local government. The research method used is legal research with a statue approach, and a conceptual approach. The result of this research is that the regulation of the head of the service/agency does not have a position in the legislation as intended in the Act. This study is a normative juridical study, which is aimed at examining legal principles, legal systematics, research on vertical and horizontal synchronization, legal comparisons, and legal history. The result of this research is that the regulation of the head of the service/agency that administers the regional government does not have a legal position in the hierarchy of laws and regulations as regulated in the Act. Material and formal regulations of the head of service/agency are not legal products that contain rageling material. The regulation issued as a form of discretion by the head of the service/agency should only be in the form of a circular letter.

Abstract

Infrastructure Development is one of Indonesia's visions in 2045. However, Infrastructure development has only occurred in some areas, and implementation often occurs in disputes between authorities and indigenous peoples, especially indigenous peoples ulayat rights. The object of ulayat rights is land of the indigenous peoples where its existence is still recognized in Indonesia based on article 18B paragraph (2) of the 1945 Constitution. The research method used statue approach and conseptual approach. This study aims To find out and analyze the existence of indigenous peoples ulayat rights and To know and analyze infrastructure development in Indonesia in accordance with the principles of indigenous peoples, Infrastructure development has the concept of development with the principles of togetherness, based on justice. The State guarantees that infrastructure development in Indonesia is accordance with the principles of indigenous peoples and the principles of indigenous peoples law including the principle of mutual cooperation, the principle of social function in the community, the principle of agreement or consensus and the principle of representation embodied in Article 18B paragraph (2) of the 1945 Constitution and Article 33 paragraph (3) of the 1945 Constitution.
