Abstract

The Function Of Isbath in Religions ourt Of Jambi Legal Everview From The Point Of Islsmic Law Compilation The marriage is somehting that have to be notarized and legalited according to Indonesian law Number 1 year 1974 about marriage at article 2 and also according to islamic law compilation article 5. The need that the marriage is to be legalized n notarized. Is according to law no. 22 year 1946 and law no. 32 year 1954 about the obligation of people to legalized and notrized his/her marriages, devorce and reverence. The Legitimation of marriage and the notarization of marriages with proof marriage, certificate for every parties involved, it the marriages notarized than eforts of the parties solve the problems usually law. If there is something that prevent the certificate of marriage, one of ther perties or both parties can also ask for what is called at “itsbat nikah” in order for both of them or one of the parties to recaived their rights in the constitions of marriage, the notatorion of isbath is according to KHI article 7 verse 2. Perkawinan merupakan ikatan resmi yang perlu dicatat dan disahkan sebagaimana diatur dalam Undang-undang no.1 tahun 1974 tentang perkawinan pada Pasal  ayat  dan Kompilasi Hukum Islam pada pasal 5. Pencatatan perkawinan ini juga diatur oleh UU No. 22 tahun 1946 jo.UU No.32 tahun 1954 tentang penetapan pencatatan nikah, talaq dan rujuk. Pencatatan ini penting, sebagai bukti keabsahan suatu perkawinan yang dibuktikan dengan akta nikah, apabila terjadi suatu hal dalam perkawinan maka dapatlah dilakukan upaya hukum guna mempertahankan atau memperoleh hak-hak masing-masing suami isteri karena dengan akta nikah tersebut suami isteri memiliki bukti otentik atas perbuatan hukum yang telah mereka lakukan. Karena perkawinan hanya dapat dibuktikan dengan akta nikah yang dibuat oleh pegawai pencatat nikah. Suatu perkawinan yang tidak memiliki akta nikah karena suatu hal maka bagi pasangan suami isteri ataupun pihak-pihak yang berkepentingan dengan perkawinan, apabila sangat membutuhkan alat bukti atas perkawinan yang telah dilangsungkan dapat mengajukan permohanan kepengadilan agama agar dibuatkan penetapan itsbat nikah yang dapat membuktikan dan mengesahkan suatu perkawinan yang telah terjadi. Dalam pasal 7 ayat 2 KHI menyebutkan dalam hal perkawinan tidak dibuktikan dengan akta nikah dapat diajukan itsbat nikah di pengadilan agama. Itsbat nikah merupakan penetapan tentang kebenaran (keabsahan) nikah.

Abstract

The management and utilization of waqf is regulated in the waqf law. However, the majority of Nazirs did not carry it out. This was caused by the Nazirs' doubts that the state legal norms governing waqf were not in accordance with Islamic legal norms. This research aims to analyze the application of state legal norms in managing and utilizing waqf assets. The research method uses empirical juridical with a qualitative approach combined with statutory and conceptual approaches. The research location is in East Tanjung Jabung Regency, Jambi. The research results show that Nadir's low knowledge and understanding of state legal norms governing waqf management, including their low experience and professionalism in managing waqf, causes doubts for Nadir in developing management and productive use of waqf. Even though state legal norms governing the management and use of waqf do not conflict with Islamic law, madhab scholars view the use of waqf assets as permissible, although some scholars have differing opinions regarding the limits of such use. Therefore, increasing Nadir's understanding of state legal norms and Islamic legal norms that regulate the management and utilization of waqf is an urgent agenda in order to improve the welfare of the people.

Abstract

This study aims to analyze Legal Protection for Consumers in Sharia E-Commerce Transactions in the Era of Economic Digitalization. The research explores issues related to consumer legal protection within Sharia-based e-commerce transactions amidst the digital economic transformation. This study employs a qualitative research method with an exploratory approach. The researcher utilizes secondary data from online media, social media, and relevant journals by examining materials related to consumer legal protection in Sharia e-commerce transactions in the era of digitalization. The data analysis technique employs the NVivo 12 Plus software, a computer-assisted qualitative document analysis tool. This user-friendly software can process words, exploring word frequency, attributes, and cases derived from large datasets. Research findings indicate that Sharia e-commerce has significant potential to grow in Indonesia. The realization of this potential largely depends on the ability to address existing consumer protection issues. If the recommendations of this study are implemented, a safe and fair digital transaction environment, fully aligned with Islamic values and principles, can be established. Despite its rapid growth, Sharia e-commerce still requires substantial improvements to ensure consumer protection. To create a secure, just, and Sharia-compliant transaction environment, a holistic approach supported by the collective commitment of stakeholders is necessary. The ability to periodically address literacy, regulation, and technology issues, conduct regular audits, apply blockchain and AI for halal certification, and detect non-Sharia practices are key factors for success. The government, industry, and academia must collaborate to build an ideal ecosystem.
