Abstract

Jumlah tonase sampah di Desa Daleman, Kecamatan Tulung, Kabupaten Klaten meningkat untuk setiap tahunnya, di mana apabila tidak dikelola dengan komprehensif dipastikan berdampak pada persoalan lingkungan, sosial, dan kesehatan. Artikel ini berusaha menjawab faktor apa saja yang menjadi hambatan dalam penerapan tata kelola sampah berbasis circular economy dan langkah-langkah strategis apa yang ditempuh para pemangku kepentingan di Desa Daleman, Kecamatan Tulung, Kabupaten Klaten guna mendukung keberhasilan tata kelola sampah berbasis circular economy. Artikel ini merupakan hasil kegiatan pengabdian yang ditulis dengan menggunakan pendekatan sosio-legal. Metode kegiatan pengabdian dilakukan dengan observasi, pendampingan, pelatihan secara terstruktur, dan evaluasi. Hasil pengabdian memaparkan bahwa hambatan dalam penerapan tata kelola sampah berbasis konsep circular economy lebih disebabkan keterbatasan lahan untuk penerapan sampling, pola pikir dan perilaku semua pemangku kepentingan, serta perbedaan persepsi tentang penerapan circular economy. Untuk itu langkah-langkah yang diperlu dilakukan adalah penguatan kelembagaan dan penyamaan pemahaman setiap pemangku kepentingan desa, dorongan peran serta masyarakat desa yang lebih aktif dan nyata, serta pengawasan dan evaluasi program.

Abstract

Democracy has faced various challenges over thousands of years, particularly concerning transitions that depend on social and political factors. The role of intelligence in democratic transitions is crucial but can be used to maintain power undemocratically. In Indonesia, post-reform, democracy has not been fully consolidated. The repressiveness of law enforcement and legal bias towards political elites are major factors in the decline of democracy. This research employs a normative legal research method with a prescriptive nature, aiming to analyze the intelligence's involvement in the democratic transition process in Indonesia. The research approach encompasses analytical, historical, comparative, and philosophical dimensions. Primary legal materials such as legislation regulations are utilized as data sources, alongside secondary legal materials like books and journals. Data collection techniques utilize the PRISMA method, and data analysis is conducted deductively using the same method. The findings of this research indicate that the cycle of democratic transition influences both the democratic system and intelligence activities. Subsequently, a case study in Indonesia examines complex intelligence issues, attributable to regime changes and inconsistent political policies. Hence, a comparative study with Brazil, which is institutionally more complex and structured, is deemed necessary.

Abstract

Kajian ini bertujuan mengkaji Analisis Kebijakan Perpajakan dan Refocusing Bahan Bakar Minyak untuk Membuat Jawa Timur Optimis Bangkit. Jenis metode yang digunakan dalam penelitian ini adalah metode penelitian kualitatif dan penelitian kepustakaan (Library Research). Analisis data dilakukan secara deskriptif, data sekunder berdasarkan hasil penelitian tentang Analisis Kebijakan Perpajakan dan Refocusing BBM Membuat Optimisme Jawa Timur Bangkit kemudian dikualifikasikan, dikelompokkan, kemudian dianalisis secara cermat. Hasil kajian menunjukkan bahwa pemerintah pusat melakukan refocusing pajak berupa pengurangan atau pembebasan pajak (relaksasi pajak) terkait masalah perpajakan dan ketersediaan dana dalam negeri untuk membiayai pembangunan dan kenaikan harga BBM yang ditujukan untuk mengantisipasi inflasi yang akan menyebabkan krisis ekonomi nasional. Dalam mewujudkan optimisme Jawa Timur Bangkit, ada beberapa hal yang harus diwujudkan untuk membangun komitmen dan program aksi bersama agar pengendalian inflasi dapat disegarkan dalam berbagai bentuk perlindungan ekonomi dan perlindungan sosial, dapat mengakomodir dampak kenaikan BBM. harga. harga dan kondisi di Provinsi Jawa Timur yang kondusif dan memiliki ketahanan (resilience) terhadap fluktuasi harga bahan pokok, inflasi, dan angka kemiskinan yang meningkat.

Abstract

This study analyzes the legal responsibility of road organizers, legal protection for road users, and public participation in the maintenance of provincial roads in East Java. The background of this research is the significant road damage, covering 154 kilometers, which impacts the safety of road users and the smoothness of socio-economic activities. This research is based on Law Number 22 of 2009 on Traffic and Road Transportation (UU LLAJ) and Law Number 38 of 2004 on Roads, which regulate the obligation of road organizers to ensure safe and adequate infrastructure. The research method used is a juridical normative approach with an analysis of legislation, using primary and secondary legal materials, with data collected through library studies and deductive analysis. The results show that the government is legally obligated to repair damaged roads, place warning signs on roads that have not been repaired, and allocate funds to prevent traffic accidents. However, various challenges such as limited budgets and geographic conditions affect the implementation of these obligations. Additionally, the Citizen Lawsuit mechanism grants the public the right to sue negligent organizers. This study recommends strengthening road maintenance management based on risk, improving transparency and accountability, and empowering the public to ensure safe roads that support regional economic growth.

Abstract

Indonesia memiliki potensi besar untuk kemajuan energi terbarukan karena sumber daya alamnya yang berlimpah. Indonesia telah berkomitmen untuk mengubah sektor energi sesuai dengan tujuan global mencapai emisi nol bersih, setelah ratifikasi Perjanjian Paris. Untuk mempercepat pengurangan pembangkit listrik batu bara dan memfasilitasi transisi energi, pemerintah telah menerapkan Peraturan Presiden Nomor 112 Tahun 2022 (Perpres 112 Tahun 2022) yang yang bertujuan untuk akselerasi penghentian penggunaan PLTU Batu bara. Namun, peraturan tersebut memberikan pengecualian terhadap PLTU Batu bara yang memenuhi syarat sebagaimana disebutkan dalam Pasal 3. Pengecualian ini justru menjadi bumerang bagi Indonesia dalam mencapai emisi nol bersih yang berkeadilan lingkungan. Studi ini bertujuan untuk menganalisis masalah sinkronisasi antara Perpres 112 Tahun 2022 dan kebijakan lainnya, serta mengidentifikasi tantangan yang dihadapi Indonesia karena ketiadaan peraturan terkait pengembangan energi terbarukan yang komprehensif. Studi ini menggunakan metode penelitian hukum normatif, menggunakan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Temuan penelitian menunjukkan terdapat ketidaksinkronan antar kebijakan pemerintah yang satu dengan lainnya tentang transisi energi, dan Indonesia masih memiliki banyak tantangan sebagai akibat dari Perpres 112 Tahun 2022 yang berlaku saat ini tidak cukup komprehensif untuk menjadi dasar pedoman pengembangan EBT sektor ketenagalistrikan di Indonesia

Abstract

This study examines the government's accountability for the collapse of the National Data Center (Pusat Data Nasional, PDN) due to a cyber attack from an Administrative Law perspective. The increasing reliance on digital technology has made e-government systems more vulnerable to cyber threats, as evidenced by the PDN Surabaya incident in June 2024. The objective of this research is to analyze the government's responsibility in safeguarding personal data and ensuring the continuity of public services. This study explores key legal frameworks, including the Personal Data Protection Law, Presidential Regulations on the Electronic-Based Government System (Sistem Pemerintahan Berbasis Elektronik, SPBE), and other relevant regulations governing cybersecurity and administrative responsibility.The research employs a normative legal research method with a statutory approach, analyzing legal provisions and their application in addressing cyber incidents affecting government-operated databases. The findings reveal that the government can be held accountable through various administrative measures, including the imposition of administrative sanctions, mandatory public notifications, and legal proceedings in administrative courts. However, the study also identifies significant challenges in implementing these measures due to the absence of a dedicated supervisory agency responsible for overseeing the security and resilience of e-government infrastructure. The lack of clear mechanisms for enforcement further complicates accountability efforts.Therefore, this study highlights the urgency of strengthening cybersecurity governance, establishing an independent supervisory body, and enhancing legal frameworks to ensure better protection of personal data and the reliability of digital public services. By addressing these gaps, the government can improve public trust and minimize future cyber risks.

Abstract

This study is motivated by the importance of fulfilling the basic rights of honorary teachers as part of efforts to improve the quality of national education. Honorary teachers in private schools, particularly at SD Kasatriyan Surakarta, often face challenges related to welfare and legal protection that are not yet optimal. The study aims to analyze the conformity of the fulfillment of basic rights of honorary teachers at SD Kasatriyan Surakarta with the provisions of Law Number 14 of 2005 concerning Teachers and Lecturers. The research employs normative juridical and empirical juridical methods, with secondary data obtained from literature review and primary data collected through interviews and direct observations at the research site. The findings indicate that most honorary teachers receive salaries far below the Surakarta City Minimum Wage and lack social welfare guarantees, such as health insurance or accident protection. Furthermore, access to training, competency development, as well as recognition and promotion, remains very limited. These findings highlight a gap between legal norms and field practices, necessitating more serious policy interventions from the government and foundations to ensure the rights of honorary teachers are fully met and to enhance the overall quality of education.

Abstract

Indonesia as an achipelagic country has impacts of climate change. To overcome the impacts, Indonesia uses two methods, namely climate change mitigation and adaptation. In accordance with the provisions stipulated in Presidential Regulation No. 98 of 2021 concerning the Implementation of Carbon Economic Values ​​to Achieve Nationally Determined Contribution Targets, the forestry sector is the main sector in controlling emissions to store carbon with a carbon net sink approach from the forestry and land sector in 2030 (Indonesia's FOLU Net Sink 2030) with two targets, namely 29% with own efforts and 41% with international cooperation. This study aims to conduct a legal review of Indonesia’s climate change mitigation strategy by achieving the net sink target in the forestry and land use (FOLU) sector by 2030. This research method use is normative legal research with statue approach. This research use analyse techniques with syllogism method based on deductive. The results indicate that limited specific and integrated regulations, weak law enforcement, implementation of decentralization, to low public awareness of the impact of climate change. However, Indonesia does not have regulations that specifically and comprehensively to regulate climate change. The research concludes that several conditions have impact the achievement of Indonesia’s Forestry and Other Land Use Net Sink target in 2030.

Abstract

Food safety is a crucial aspect of consumer protection and national food security. Registration of Fresh Food from Plants of Domestic Production of Small Businesses (PSAT-PDUK Registration) is regulated as a form of legal instrument to ensure that fresh food in circulation meets quality and safety standards. This article aims to analyze the regulation of PSAT-PDUK registration in Indonesia from a legal perspective and review the effectiveness of its implementation. The method used is normative juridical with the approach of legislation and legal theory of consumer protection. The results of the study show that despite being regulated in the Food Law, Government Regulation No. 86/2019, Government Regulation No. 5-2021, MOA No. 53/2018, and other technical implementing regulations, the implementation of PSAT-PDUK registration still faces a number of obstacles such as low literacy of small business actors, limited supervision, and not optimal synergy between supervisory institutions. Therefore, it is necessary to strengthen the role of the Food Safety Competent Authority (OKKP) and harmonize regulations in order to increase the effectiveness of the implementation of PSAT-PDUK Registration as a legal instrument of the government in guaranteeing and monitoring food safety of Fresh Food of Plant Origin in public circulation.

Abstract

People's daily activities for cooking, bathing, washing, latrines, produce household domestic wastewater which has the potential to cause water pollution, both well water and river water. This is exacerbated by the lack of public awareness of the environment and low public understanding of the Polluter Pays Principle. This research was conducted to identify the understanding of the people of Ciracas District, the provisions and implementation, the alignment of the provisions of the legislation related to the management of domestic wastewater, as well as the obstacles faced in its implementation. It is concluded that the public's understanding of the Polluter Pays Principle is still low. The construction of a domestic wastewater management installation in the Kampung Rambutan Reservoir can be a real step in an effort to increase public awareness in managing domestic wastewater. The alignment of the provisions of laws and regulations regarding the application of the Polluter Pays Principle in domestic household wastewater management still needs to be improved. The obstacle in its implementation is the lack of formal and informal education for the community about domestic wastewater management. The role of the government which is felt to be less than optimal is also an obstacle in growing public awareness in managing domestic wastewater. In addition, plans for the development of a domestic wastewater management system are generally also constrained by the low participation and resistance of the community.
