Abstract

Persoalan yang terjadi saat ini di Indonesia yaitu permasalahan perdagangan internasional yang berkaitan tentang praktik dumping (penjualan barang impor di bawah harga normal produk domestik). Berdasarkan penjabaran permsalahan tersebut, sehingga bisa merumuskan masalahnya yaitu bagaimana regulasi anti dumping dalam perdagangan internasional, bagaimana penerapannya terhadap industri dalam negeri dari produk-produk impor yang berindikasi dumping. Metode penelitian yang digunakan yaitu metode penelitian hukum normatif. Hsil penelitiannya adalah Regulasi tentang Anti Dumping selain mengacu pada ketentuan internasional (Agreement on Implementation of Article VI GATT dan Agreement on Subsidies and Countervailing Duties), juga pada peraturan perundang-undangan nasional, yaitu UU. No. 10 tahun 1995 tetang Kepabeanan. Pengaturan anti dumping sangat diperlukan untuk melindungi industri dalam negeri terhadap praktik yang dapat merugikan industri dalam negeri yang memproduksi barang sejenis. Penerapan yang dapat dilakukan Indonesia mengatasi praktik dumping lebih dulu dilaksanakan penyelidikan oleh KADI dalan mendapatkan bukti mengenai produk impor berindikasi dumping yang akan merugikan industri domestik. Sesuai bukti tersebut maka pemerintah melalui KADI dapat membebankan bea masuk anti damping kepada importer.

Abstract

Abstract: Human Rights are basic rights bestowed by God on human beings, are universal to be protected, respected, maintained, and should not be ignored, reduced or taken away by anyone. It is therefore the responsibility of the State as well as collateral for enforcement against violations of human rights principles. The UN as an international organization in its charter has been put respect and appreciation for human rights into the Charter that dsebut The Universal Declaration of Human Rights were adopted unanimously by the General Assembly of the United Nations General Assembly on December 10, 1948. Human rights violations in North Korea should have been the responsibility of the State concerned, and also it is a shared responsibility of the international community. North Korea as one of the countries with the worst human rights records. North Koreans have been referred to as the "most brutalized people in the world", due to the severe restrictions placed on the top of their political and economic freedoms. The North Korean government has committed human rights violations in the form of crimes against humanity against the civilian population, so in this case the UN acts as a protective shield against the civilian population, so that the perpetrators can not act arbitrarily in treating civilian population. Abstract

This research specifically discusses the human rights of prisoners as prisoners in prison, which in their daily lives must be respected, upheld and protected by the state, the law (in this case the Penitentiary Act to be in line with the Human Rights Act), the government through the apparatus is correctional officers and fellow inmates. Prisoners in their daily life can make mistakes and lives that are in contact with human rights violations. The object of this research is the human rights of inmates as prisoners in prison (WBP). The formulation of the problems in this study are (1) How are the human rights protection arrangements for prisoners in prison according to Law Number 12 of 1995; and (2) How is the implementation of human rights protection for narcotics prisoners in prison in East Tanjung Jabung Regency. This study uses Law Number 12 of 1995 Concerning Corrections and other derivative regulations. The results showed that there were differences in the implementation of human rights protection for prisoners with Law Number 12 of 1995 Concerning Corrections.

Abstract

Information technology impacts social, cultural, and economic progress, creating a world that is not limited by time, geography, or distance. Fintech, short for financial technology, is a phrase used to describe technology that facilitates communication between society and society's financial sector. In Indonesia, protecting personal information is a primary concern. This is due to the increasing volume of digital activity, especially transactions involving the submission of personal data by users. A normative approach was used in carrying out this research. This study focuses on the legal or statutory approach. Qualitative analysis is a type of data analysis used in normative legal studies. The latest legal regulations regarding efforts to safeguard personal data, especially related to criminal acts that occur and are carried out by unauthorized pinjol applications, are Law Number 27 of 2022 concerning Personal Data Protection. The PDP Law serves as a foundation and ensures that everyone's personal information is legally protected, preventing misuse of personal information for purposes that could harm third parties. In addition, the PDP Law provides administrative and criminal sanctions for all crimes related to personal data, including misuse of data and unauthorized access to that data, such as in cases of illegal online loan applications.

Abstract

Introduction: Legislation in Indonesia has provided a place for regulation in emergency situations, both at the constitutional and statutory levels. There are inconsistencies, both conceptually and practically in the use of the emergency clause in emergency regulations. Through this paper, the author would like to emphasize need for projection of revamping the laws and regulations related to emergency situation in Indonesia.Purposes of the Research: This study aims to analyze Indonesia’s emergency regulation according to perspective of emergency contitutional law of in the face of a Pandemic. Emergency situations they are Emergency State Law regime Article 12 of the 1945 Constitution, the use of Article 22 of the 1945 Constitution of the Republic of Indonesia, and the meaning of other emergencies in accordance with law.Methods of the Research: The research methodology used is normative juridical by approaching the laws and regulations (Statute Approach) and conceptual approach. From the approach to legislation, it aims to find out the rules related to emergency regulations. The legal materials were collected by means of a literature study, then the legal materials were analyzed in a qualitative juridical manner.Results of the Research: Results of his research, emergency option based on constitution which is represented by the phrase state of emergency in Article 12 of the 1945 Constitution gives great powers to emergency authorities, can deviate from democratic procedures in constitution and violate human rights, except for non-derogable rights. Activation of state of danger also results in lack of political and legal oversight.

Abstract

This study aims to evaluate the efficiency of implementing the principles of restorative justice for children who are perpetrators of criminal acts by the Women and Children Protection Unit (PPA) of the Jambi Regional Police. It also examines the challenges encountered by investigators and the strategies employed to overcome those obstacles during the investigation process. Using an empirical juridical approach, the study finds that restorative justice is particularly effective in handling minor criminal offenses such as light assault, threats, and group violence. The effectiveness is reflected in three main aspects: informal resolution of cases, active participation of perpetrators, victims, and the community, and prevention of reoffending behavior through reconciliation. Internal obstacles include limited understanding of diversion procedures among investigators and the lack of child-friendly facilities. Externally, prevailing punitive public attitudes and distrust toward non-litigation resolutions hinder the process. To address these issues, investigators distinguish between diversion and restorative justice, enhance internal capabilities through training, and collaborate with external institutions while engaging in public outreach
