Abstract

Registering and protecting Beras Pandanwangi CIANJUR aims to avoid counterfeit product. Protected Geographical Indications are a relevant and effective tool to showcase the quality of the products, protect their names and reputations, and develop profitable market. A Book of Specification of Geographical Indications as the main requirement of registration decribes the good and the production methods. the registration system is first to file. Inter professional organization of Beras Pandanwangi CIANJUR which bring together all kind of operators such farmers, processors and traders contribute all the information into the book, submit and manage the registration.  The result revealed that the Geographical Existing rules (Peraturan Pemerintah Nomor 51 Tahun 2007 Tentang Indikasi Geografis) only determine standards of information. Due to technical constrains and lack of cultural documentation, it is need to set up a technical  standardization how to fiil in the information. The effort shall begin with strategic planning by local government by forming the Inter Professional organization (MPIG) of Beras Pandanwangi Cianjur and distributing task according to their competencies.Keyword: Book, Specification, Geographical Indications, Pandanwangi. ABSTRAKBelum terdaftarnya Beras Pandanwangi Cianjur di Dirjen HKI sebagai produk yang berkarakteristik Indikasi Geografis, mengakibatkan penegakkan hukum terhadap praktik-praktik pemalsuan produk tersebut sulit dilakukan. Kendala teknis dan kurangnya budaya pendokumentasian menyebabkan terhambatnya penyusunan Buku Persyaratan yang merupakan prasyarat Pendaftaran Hak Indikasi Geografis. Untuk itu, perlu ditemukan langkah-langkah penyusunan Buku Persyaratan melalui permasalahan apakah terdapat standarisasi dalam penyusunan Buku Persyaratan dan bagaimana langkah penyusunan Buku Persyaratan Beras Pandanwangi Cianjur. Penelitian ini menggunakan metode yuridis normatif dengan spesifikasi deskriptif analitis. Hasil penelitian mengungkapkan bahwa Peraturan Pemerintah Nomor 51 Tahun 2007 Tentang Indikasi Geografis baru mengatur standarisasi uraian yang harus dimuat dalam Buku Persyaratan sementara standarisasi teknisnya belum diatur. Langkah penyusunan Buku Persyaratan Indikasi Geografis diawali dengan penyusunan renstra oleh Pemerintah Kabupaten Cianjur dan dinas terkait untuk membentuk lembaga Masyarakat Perwakilan Indikasi Geografis (MPIG) dan distribusi tugas untuk mengisi uraian Buku Persyaratan sesuai kompetensinya.Kata Kunci: Buku, Persyaratan, Indikasi Geografis, Pandanwangi.

Abstract

The Medical Checkup (MCU) service that includes a treadmill test facility is a routine health examination designed to identify potential cardiovascular diseases, implemented using the Bruce Protocol method as Standard Operating Procedures (SOP) and Hospital Practice Guidelines to conduct the treadmill test. The legal basis for this medical service outlined in Indonesian Ministry of Health Decree Number 772/Menkes/SK/VI/2002 and Indonesian Ministry of Health Regulation Number 512/Menkes/PER/IV/2007. The treadmill test has risks and contraindications, which means that not all patients may be able to undergo the treadmill test procedure in the MCU package. This study will explore the legal implications of incomplete information during medical checkups in cases of MCU package services which treadmill test facilities cannot be carried out due to patient's medical condition. Consumer Protection Law Number 8 of 1999 and Article 1320 of the Civil Code will serve as the foundation for analyzing therapeutic contracts. The research method which used in this study is normative juridical approach which is supported by interveiw data. The Results of this study found that when a treadmill test cannot be performed due to patients' medical condition, the patient unable to undergo the procedure, , resulting in legal consequences in form of financial loss which may causes potential disputes if not handled properly. This incident cannot be considered as as breach of contract because the hospital has fulfilled its obligations by providing information and asking for approval through informed consent, so the hospital is not required to reimburse the patient. Abstract

Law No. 11, 2020 concerning Job Creation was enacted with the objectives to increase the business climate and to open as many as possible job opportunity. In the regulation, it is recognized a new form of company that is individual company of micro and small business. This business can be founded by an individual who owns the company’s shares. It certainly raised questions considering that limited company and the small business are two different things. This writing will discuss about the potential conflict of interest and violation of the principle of accountability in managing an individual company. The method used in this research was juridical normative with statute and conceptual approaches. The research specification was descriptive analytical. The research found that the Job Creation Act stipulation on the establishment of individual small business as an individual company is incorrect. When a particular company can be established by an individual who owns all the shares, it can create a huge conflict of interest. It surely can make the company so untransparent that the decisions made by the organ of the company to be subjective. In addition, it can make the organ of the company difficult in carrying out its duties in accordance with its duties and responsibilities. Keywords: Omnibus Law, Individual Company
