Abstract

This research aimed to analyze the meaning of state finance loss in corruption and provide prescriptions the expansion of concept the state economic loss in Corruption Eradication Acts in Indonesia. This research was a normative-legal approach with the approaches of statute, case, comparative and conceptual. Legal materials were analyzed by syllogism of induction, deduction and interpretation. The research indicates that, first, the meaning of state economic in corruption is a life of economic that structured as a joint venture based on kinship principles, in this case is a cooperative, or other entity that has the principles and spirit of mutual cooperation, kinship and joint ventures, so if there are irregularities in cooperatives or other business entities principled and cooperative spirit that resulted in losses, it can be applied to corruption. But this has never happened in the practice of corruption law enforcement. Secondly, the need for expansion the concept of state economy in corruption crime, thus acts in state economy loss, among others: the implementation of construction without indepth study (feasibility study) so it does not have the value of benefits, contractor is unable to finish the government’s work in accordance with employment contracts so that work is not finish and not function, basic materials stockpiling and public’s needs (stockpiling of food, fuel, fertilizer, etc.), import policies that harm the public’s production and acts that damage the ecological of environment (forestry, mining and fisheries conducted unlawfully). Abstract

Supanto, Kualitas  Pelayanan  Kesehatan di UPT. Puskesmas  di Kecamatan Linggang Bigung  Kabupaten Kutai Barat. Dalam Undang-Undang Nomor 36 Tahun 2009 menjelaskan bahwa kesehatan adalah keadaan sehat, baik secara fisik, mental, spritual maupun sosial yang memungkinkan setiap orang untuk hidup produktif secara sosial dan ekonomis. Dan juga telah ditetapkan bahwa setiap orang berhak memperoleh pelayanan kesehatan. Oleh karena itu, setiap elemen masyarakat baik individu, keluarga, berhak memperoleh pelayanan atas kesehatannya dan pemerintah bertanggung jawab mencanangkan, mengatur menyelenggarakan dan mengawasi penyelenggaraan kesehatan secara merata dan terjangkau oleh masyarakat. Tujuan dari penelitian ini adalah untuk mengetahu tingkat kualitas pelayanan  di UPT. Puskesmas Linggang Bigung  Kecamatan   Linggang Bigung   Kabupaten   Kutai Barat.   pendekatan penelitian yang digunakan adalah kuantitatif, unit analisis dalam penelitian ini adalah individu. Dengan metode kuantitatif  yang bersifat deskriptif dengan teknik pengumpulan data melalui kuesioner kepada pasien dan survey langsung untuk memperoleh data-data yang diperlukan tentang bagaimana kualitas pelayanan kesehatan di Puskesmas. Hasil   Penelitian   terhadap   kualitas   pelayanan   kesehatan di UPT. Puskesmas  Linggang Bigung di Kecamatan   Linggang Bigung   Kabupaten   Kutai Barat diukur dengan menggunakan 5 dimensi kualitas pelayanan publik yakni Bukti Langsung (Tangibles), Kehandalan (Reliability), Daya Tanggap (ResponsivEness), Jaminan (Assurance), dan Empati (Empaty). Pelayanan yang dilakukan oleh Puskesmas telah efektif karena telah mendapatkan penilaian yang baik oleh masyarakat berdasarkan kelima indikator peniaian yang digunakan, hal ini ditunjukan dengan rekapitulasi kelima indikator kualitas pelayanan sudah berada diatas 60%,   hal   ini   menunjukan   bahwa kualitas pelayanan  kesehatan yang diberikan sudah baik.

Abstract

The threat of sexual violence in Indonesia, which is getting worse day by day, has become an urgency for all levels of society in Indonesia. Inappropriate legal interpretations in society often raise big question marks about the protection of victims of sexual violence. Therefore, how is forced defense (noodwear) implemented as a reason for abolition of criminal penalties in Indonesia? At the same time, how is Article 49 paragraph (1) of the Criminal Code applied to crimes of morality? To solve this problem, it is not only the government that must intervene. However, people must also have self-defense, for example through practical self-defense movements that can protect themselves, but do not kill the perpetrator so that the victim does not go too far in defending himself. How to implement practical self-defense movements in an effort to protect victims of sexual violence? This is the problem we will examine to provide a solution. In this way, it is hoped that this effort will be able to produce an in-depth study regarding the protection of victims of sexual violence and how to apply practical self-defense to protect themselves when victims experience an act of sexual violence.

Abstract

Taxes are mandatory levies imposed on citizens to be used as public investment to boost the country's economic growth. However, Indonesia is estimated to experience tax losses of US$601 per year due to tax avoidance. One of the most commonly used schemes is profit shifting through transfer pricing. The author using normative juridical research method will answer about how the general scheme of profit shifting using transfer pricing method and how effective the current tax laws and regulations work to overcome the problem.

Abstract

This research aims to analyze the implementation of legal protection for citizenship rights of former transnational terrorist Indonesian citizens within Indonesia's legal system. Using normative juridical method with statutory and conceptual approaches, this study examines secondary data from primary, secondary, and tertiary legal materials. The results show that Indonesia's legal system has an adequate legal framework to protect the citizenship rights of former transnational terrorists, although its implementation faces various challenges. The deradicalization program and status verification mechanism implemented by the government have not been fully effective due to inter-institutional coordination constraints and community resistance. Additionally, the study identifies that citizenship status cannot be automatically revoked without proper legal process according to Law No. 12 of 2006 on Citizenship, as terrorist groups cannot be categorized as "foreign military" as specified in the law. This research contributes significantly to the development of returnee handling policies by balancing aspects of national security and human rights protection.

Abstract

Criminal Law plays a crucial role in regulating the daily behavior of society, identifying actions that violate ethics and morals, and asserting that such actions can be considered crimes potentially harmful to others as legal subjects. Although assault is generally regulated in the Criminal Code as a violation of bodily integrity, there are differences in interpretation among legal experts regarding the meaning and concept of assault. The use of the judicial system to resolve cases does not always meet the expectations of perpetrators, victims, or the community in achieving justice. The emergence of the concept of Restorative Justice brings a new paradigm to the law enforcement system in Indonesia, aiming to be a holistic solution that considers the rights of both victims and perpetrators. Restorative Justice aims to restore the situation to its state before the criminal act, eliminate negative stigma, and avoid revenge. Thus, it is expected that the perpetrators can honestly admit their actions, take responsibility for their mistakes, and commit to improving themselves to avoid repeating their actions.
