Abstract

ABSTRAKFungsi utama dari perbankan yaitu sebagai lembaga yang menghimpun dana dari masyarakat dalam bentuk simpanan dan menyalurkannya kembali ke masyarakat dalam bentuk kredit atau pembiayaan (financial intermediary Institution). Mengingat pentingnya fungsi ini, maka upaya menjaga kepercayaan masyarakat terhadap perbankan menjadi bagian yang sangat penting untuk dilakukan. Oleh karena itu, dalam beberapa ketentuan perbankan dijabarkan rambu-rambu penerapan pelaksanaan prinsip kehati-hatian (prudential banking principle) dalam dunia perbankan, yang harus dipatuhi oleh semua bank. Prinsip yang digunakan dalam perbankan syariah adalah prinsip kehati-hatian dan prinsip syariah. Dimana kepatuhan terhadap prinsip- prinsip tersebut berpengaruh terhadap tingkat kesehatan bank syariah itu sendiri. Prinsip kehati-hatian (prudential banking principle) adalah kehati-hatian bank untuk meminimalkan risiko usaha operasional bank dengan berpedoman kepada ketentuan bank sentral dan ketentuan intern bank. Tujuannya, agar bank selalu dalam keadaan sehat, likuid dan solvent. Diabaikannya penerapan prinsip kehati-hatian tersebut oleh bank, baik oleh bank konvensional maupun oleh bank syariah tentu akan berdampak pada kerugian dan risiko terhadap bank itu sendiri. Oleh karena itu, di dalam memberikan fasilitas pembiayaan, setiap bank harus lebih memperhatikan aspek personality yang dapat diketahui dengan menerapkan prinsip 5 C (the five cs of credit analysis). Pihak bank syariah, sebaiknya secara aktif melaksanakan prinsip kehati-hatian (prudential banking principle), untuk menumbuhkan kepercayaan masyarakat pada bank syariah.Kata Kunci: Bank Sayriah, resiko, Prinsip kehati-hatianABSTRACTThe main function of banking is as an institution that collects funds from the public in the form of deposits and channel them back to the community in the form of credit or financing (financial intermediary Institution). Considering the importance of this function, efforts to maintain public trust in banks are a very important part to do. Therefore, in several banking regulations the guidelines for the implementation of prudential banking principles are applied in the banking world, which must be obeyed by all banks. The principles used in Islamic banking are the principle of prudence and sharia principles. Where adherence to these principles affects the soundness of the Islamic bank itself. The prudential banking principle is the prudence of banks to minimize the risk of bank operational business by referring to central bank regulations and bank internal regulations. The goal is that banks are always in a healthy, liquid and solvent condition. Ignoring the application of the precautionary principle by banks, both by conventional banks and by Islamic banks, of course will have an impact on losses and risks to the bank itself. Therefore, in providing financing facilities, each bank must pay more attention to aspects of personality that can be identified by applying the 5 C principle (the five cs of credit analysis). Islamic banks should actively implement the prudential banking principle to foster public confidence in Islamic banks.Keywords: Bank Sayriah, risk, the Principle of prudence

Abstract

The rapid development of information technology has driven the transformation of financial systems into more digital forms through innovations in financial technology (fintech). One of the most popular fintech products in Indonesia is digital wallets, such as the DANA application. However, the convenience of digital transactions also creates vulnerabilities to cybercrime, which can harm users. This study aims to analyze the legal liability for cybercrime in the use of the DANA digital wallet, as well as to evaluate the effectiveness of existing regulations in protecting consumers. The research method used is normative juridical, with a statutory and case study approach. Data were obtained through literature review, documentation, and analysis of cybercrime cases involving the DANA application. The results of the study indicate that perpetrators of cybercrime involving digital wallets can be sanctioned under the Law on Electronic Information and Transactions (ITE Law), the Consumer Protection Law, and other relevant regulations. However, there are still weaknesses in law enforcement, particularly in tracking down perpetrators and providing compensation to victims. In addition, digital wallet providers are also responsible for enhancing their security systems and ensuring transparency in user data protection. In conclusion, legal accountability for cybercrime in digital wallets is not yet fully effective, and synergy between regulators, law enforcement agencies, and fintech industry players is needed to create a secure and trustworthy digital financial ecosystem. Abstract

Green banking regulation in Indonesia remains sectoral and lacks a comprehensive legal framework, relying on instruments like POJK No. 51/2017 and Presidential Regulation No. 59/2017. Key challenges include weak legal enforcement, supervision, inter-agency coordination, and the risk of greenwashing. Nevertheless, green banking holds significant potential to support the transition toward Net Zero Emission by 2060. Strategic steps are needed, including the establishment of specific laws, regulatory strengthening, policy harmonization, provision of incentives, and capacity building to achieve inclusive and sustainable green economic development.

Abstract

The purpose of this research is to provide an in-depth explanation that the development of artificial intelligence technology (AI) has revolutionized the process of creating digital artworks. AI is now able to produce works that resemble, even surpass, human creations. This phenomenon poses significant legal challenges, especially related to copyright recognition. In the context of the post-human era, where the boundaries between humans and machines are increasingly blurred, the fundamental question arises as to who deserves to be called a creator: human, machine, or both. This article examines the current copyright legal framework and examines the extent to which legal norms are able to accommodate the existence of AI as a creative entity. The method used is a normative juridical approach with analysis of national and international regulations, as well as case studies of a number of AI-based digital artworks. The findings show that the current legal system is not fully ready to regulate the protection of copyrights involving AI autonomously. Therefore, regulatory updates are needed that are responsive to technological advances and still ensure justice for creative actors in the digital era.

Abstract

 The aim of this research is to analyze and describe the protection of journalists working in areas of armed conflict from the perspective of International Criminal Law in the case of the shooting of a journalist at the largest news agency in Arabia called Al Jazeera, journalist Shireen Abu Akleh. Shireen Abu Akleh was shot and killed by Israeli soldiers while she and fellow journalists were covering an Israeli army attack on the Jenin City area in the Palestinian West Bank on May 11 2022. Based on this case, the journalist was carrying out his work in an area of armed conflict. is the most dangerous job, because they have to be as close as possible to the conflict area to cover the news. Journalists have an important role in areas of armed conflict, namely conveying the current situation and conditions in areas of armed conflict to the general public. Therefore, journalists who are working in areas of armed conflict must be protected by laws and regulations. In terms of International Criminal Law, the protection of journalists is regulated in International Humanitarian Law which is contained in the 1949 Geneva Convention, the Rome Statute, the 1907 Hague Convention, and Additional Protocol I to the 1977 Geneva Convention. Key Words: International Humanitarian Law, Journalist, Armed Conflict Area AbstrakTujuan Penelitian ini untuk menganalis dan menggambarkan tentang suatu perlindungan jurnalis yang bertugas di daerah konflik bersenjata dari segi Hukum Pidana Internasional terhadap kasus penembakan seorang jurnalis dikantor berita terbesar di arab yang bernama kantor Al Jazeera yang bernama wartawati Shireen Abu Akleh. Shireen Abu Akleh ditembak dan dibunuh oleh tentara Israel pada saat dia dan rekan wartawan sedang meliput serangan tentara Israel di wilayah bagian Kota Jenin di Tepi Barat Palestina pada tanggal 11 Mei 2022. Berdasarkan pada kasus tersebut, wartawan yang sedang melakukan pekerjaan nya di daerah konflik bersenjata merupakan pekerjaan yang paling berbahaya, karena mereka harus sedekat mungkin berada di daerah konflik untuk melakukan peliputan berita. Wartawan memiliki peranan penting di daerah konflik bersenjata, yaitu menyampaikan situasi dan kondisi terkini di daerah konflik bersenjata kepada masyarakat umum. Maka dari itu, wartawan yang sedang bekerja di daerah konflik bersenjata harus dilindungi oleh hukum dan peraturan. Dari segi Hukum Pidana Internasional, perlindungan wartawan diatur dalam Hukum Humaniter Internasional yan termuat dalam Konvensi Jenewa 1949, Statuta Roma, Konvensi Den Haag 1907, dan Protokol Tambahan I Konvensi Jenewa 1977. Key Words: Hukum Humaniter Internasional, Wartawan, Daerah Konflik Bersenjata
