Abstract

   Kekerasan dan pelecehan seksual pada anak sudah menjadi fenomena yang sering ditemui. Bentuk perlakuan menyakitkan secara fisik ataupun emosional, penyalahgunaan seksual, penelantaran, komersial yang menyebabkan cedera menjadi contoh bentuk konkret adanya kekerasan seksual yang terjadi pada anak. Mengacu pada Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak, bahwa perlindungan anak adalah segala kegiatan untuk mengacu dan melindungi anak dan hak-haknya agar hidup, tumbuh, berkembang, dan berpartisipasi secara optimal sesuai dengan harkat dan martabat kemanusiaan, serta mendapat perlindungan dari kekerasan dan diskriminasi. Mengutip dari Rape, Abuse Incest National Network contoh perilaku yang termasuk, namun tidak terbatas pada pelecehan seksual salah satunya ialah sentuhan dan kontak fisik yang tidak diinginkan. Sehingga tujuan penelitian kepada masyarakat ini adalah memberikan pengetahuan kepada anak usia dini maupun para orang tua mengenai bahayanya kekerasan dan pelecehan seksual pada anak usia dini, yang nantinya tentu akan berpengaruh terhadap psikologis sang anak. Metode pelaksanaan kegiatan dengan bertatap muka namun tetap mematuhi protokol kesehatan. Selain itu implikasi dari adanya kegiatan pengabdian kepada masyarakat ialah para anak dan orang tua memahami pentingnya upaya pencegahan kekerasan dan pelecehan seksual pada anak. Kata Kunci: Kekerasan, Pelecehan, Perlindungan Anak                                                                                         ABSTRACT Violence and sexual abuse of children has become a common phenomenon. Forms of physically or emotionally painful treatment, sexual abuse, neglect, commercial harm that causes injury are examples of concrete forms of sexual violence that occur in children. Referring to Law Number 23 of 2002 concerning Child Protection, that child protection is all activities to refer to and protect children and their rights so that they live, grow, develop, and participate optimally in accordance with human dignity and protection from violence and discrimination. Quoting from Rape, Abuse Incest National Network examples of behavior that includes, but is not limited to sexual harassment, one of which is unwanted physical touch and contact. So the purpose of this research to the community is to provide knowledge to early childhood and parents about the dangers of violence and sexual harassment in early childhood, which will certainly affect the child's psychology. The method of carrying out activities is face-to-face but still adheres to health protocols. In addition, the implication of community service activities is that children and parents understand the importance of preventing violence and sexual abuse in children. Key words: Violence, Harassment, Child Protection

Abstract

ABSTRAK Penanggulangan korupsi di Indonesia tidak akan berhasil, apabila hanya melakukan penegakan hukum secara represif saja, namun tidak kalah pentingnya adalah melakukan tindakan pencegahan untuk menekan kasus-kasus korupsi. Hal tersebut telah diantisipasi oleh Pemerintah Kota Bogor dengan mengeluarkan Peraturan Wali Kota Bogor Nomor 28 Tahun 2019 tentang Penyelenggaraan Pendidikan Anti Korupsi Pada Satuan Pendidikan. Pendidikan anti korupsi adalah usaha sadar dan terencana untuk mewujudkan proses belajar mengajar yang kritis terhadap nilai-nilai anti korupsi. Dalam proses tersebut, maka pendidikan anti korupsi bukan sekedar media bagi transfer pengalihan pengetahuan (kognitif) namun juga menekankan pada upaya pembentukan karakter (afektif) dan kesadaran moral dalam melakukan perlawanan (psikomotorik) terhadap penyimpangan perilaku. Penyelenggaran Pendidikan Anti Korupsi bertujuan membentuk peserta didik yang beriman, jujur, peduli, mandiri, disiplin, kerja keras, berani, tanggung jawab, dan adil serta mampu beradaptasi dengan lingkungannya, berwawasan luas, dan berbudi pekerti luhur. Melalui Perwali tersebut, diharapkan semangat antikorupsi bisa mengakar khususnya pada satuan pendidikan yang ada di Kota Bogor. Kata kunci: karakter, pendidikan, anti korupsi. ABSTRACT Tackling corruption in Indonesia will not succeed if only repressive law enforcement is carried out, but no less important is taking preventive measures to suppress corruption cases. This has been anticipated by the Bogor City Government by issuing Bogor Mayor Regulation Number 28 of 2019 concerning the Implementation of Anti-Corruption Education in Education Units. Anti-corruption education is a conscious and planned effort to realize a teaching and learning process that is critical of anti-corruption values. In this process, anti-corruption education is not only a medium for the transfer of knowledge transfer (cognitive) but also emphasizes efforts to build character (affective) and moral awareness in resisting (psychomotor) behavior deviations. The implementation of Anti-Corruption Education aims to form students who are faithful, honest, caring, independent, disciplined, hard working, brave, responsible, and fair and able to adapt to their environment, broad-minded, and have noble character. Through the Perwali, it is hoped that the spirit of anti-corruption can take root, especially in educational units in the city of Bogor. Keywords: character, education, anti-corruption.

Abstract

In this writing, the author wants to analyze the crime of genocide committed by China against the Uighurs in the perspective of international criminal law and according to the Rome Statute. one of which was later included in the 1998 Rome Statute. The Chinese government has been accused of crimes against humanity and genocide against ethnic Uighurs in Xinjiang where at least one million Uighurs have been detained in the region and detained in extra-judicial camps or sent to prison. China has deliberately made a systematic, integrated policy with the so-called 'optimizing' population of the Xinjiang population, which is essentially aimed at reducing the Uighur population and the populations of other ethnic minorities in the long term which is achieved by limiting and reducing the birth of ethnic Uighurs.

Abstract

The research aims to explore and analyze facilities in the form of production available to small and medium-sized industries (SMEs) using a qualitative approach through library studies. ICTs play an important role in the economy, especially in developing countries, but they often face challenges in increasing their production and competitiveness due to the limitations of available facilities. This research uses qualitative methods with a focus on the analysis of library studies relevant to the problems of production facilities in IKM. Data is collected through scientific literature, books, journal articles, research reports, and other sources of information related to this topic. The analysis is carried out to identify and analyze key aspects related to production facilities in ICT, such as the types of facilities available, the challenges faced, and the strategies used to overcome such limitations. The results of this study revealed that production facilities in the form of equipment, machines, and physical infrastructure are generally limited to ICTs. These limitations affect the productivity and efficiency of ICTs as well as their ability to meet increasingly complex market requirements. In addition, external factors such as government regulations, access to resources, and the availability of financial support also affect the quality and accessibility of production facilities within ICT. This research provides an in-depth insight into the challenges and complexities associated with production facilities within IKM. In a qualitative context, the research also reveals strategies and initiatives taken by ICT to address facility constraints, such as collaboration with third parties, cross-sector collaboration, and the use of information and communication technologies. These findings provide a better understanding of the ways that ICTs can take to improve their production and competitiveness in limited contexts. This research shows the importance of further research in terms of production facilities in ICT with a qualitative approach and through library studies. It is expected that these findings will provide a strong foundation for the development of policies, best practices, and strategies that can help strengthen production facilities in ICTs and drive sustainable economic growth.

Abstract

Penelitian ini didukung dengan pendekatan doctrinal menggunakan landasan sebagai acuan perjanjian internasional dan konvensi internasional yang bertujuan memberikan pemahaman seputar perang saudara di Suriah yang berkaitan dengan konvensi internasional. Dewan Keamanan PBB menggunakan regulasi demi menghukum pihak yang menggunakan klorin seperti pada perang saudara Suriah sebab aksi tersebut berkaitan dengan pasal VII Piagam PBB. Ketentuan yang mengatur perang saudara dituangkan dalam pasal 3 Konvensi Jenewa 1949. Konvensi jenewa dan protokol tambahan bertujuan melindungi pihak lawan. Suriah bertanggungjawab terhadap perang saudara dengan PBB sebagai organisasi internasional berperan menjamin perdamaian dunia, ICRC melaksanakan perlindungan dan bantuan kemanusiaan, serta mahkamah internasional berperan mengadili kejahatan perang dan kejahatan kemanusiaan tersebut. Berkaitan dengan pasal 146 Konvensi Jenewa IV yang mengandung makna bahwa setiap orang yang telah terbukti melakukan pelanggaran yang dikategorikan sebagai pelanggaran HAM berat harus diadili menggunakan hukum nasional negaranya untuk menjamin kepastian hukum dan memberi keadilan kepada para korban yang terkena imbasnya.

Abstract

Law is a tool for regulating the lives of society, characterized by its coercive and obligatory nature to follow existing rules. Law is created for the benefit of the general public and contains norms of life as a guide for social interaction. The death penalty is the most severe punishment in terms of sanctions for extraordinary criminal offenses such as narcotics, premeditated murder, terrorism, and crimes against national security. However, the implementation of the death penalty in Indonesia has become controversial due to its violation of Human Rights (HR) and the right to life guaranteed by Article 28A, paragraph (1) of the 1945 Constitution. Despite the recent updates in the latest Criminal Code (KUHP) that introduce a probation period of 10 years, pros and cons continue to arise regarding the application of the death penalty. Various perspectives on the death penalty exist, with some considering human rights and principles of justice. Abstract

AbstrakDi Indonesia kasus pelecehan seksual sering kali terjadi, kasus ini terus bertambah setiap tahunnya, mulai dari pelecehan seksual yang berbentuk  verbal, bahkan sampai pelecehan seksual berbentuk  fisik .hal ini mendorong pemerintah untuk dapat membuat regulasi baru guna mencegah terjadinya kekerasan seksual ditengah masyarakat sehingga, diterbitkanlah Undang-Undang NO. 12 Tahun 2022 pada 9 Mei 2022 Tentang tindak pidana kekerasan seksual. Penelitian ini berfokus pada perlindungan hukum terhadap korban kekerasan/pelecehan seksual yang dialami oleh korban, Penelitian ini menggunakan metode Yuridis Normatif . Dengan menggunakan pendekatan perundang-undangan, mengacu pada norma hukum positif yang berlaku diindonesia guna menjawab isu yang di hadapi. Berdasarkan hasil penelitian menunjukkan bahwa dengan adanya Undang-Undang Tindak Pidana Kekerasan  Seksual membawa angin segar bagi masyarakat dalam hal  pencegahan dan penanganan terhadap korban kekerasan seksual dengan cara pemulihan hak-hak korban melalui restitusi, kompensasi, serta  rehabilitasi tanpa  menghentikan  proses  hukum  yang berjalan agar regulasi ini dapat diimplementasikan dan terlaksana dengan efektif perlu adanya pengawasan dari pemerintah guna melaksanakan hak dasar yang harus diperoleh setiap warga negara.Kata Kunci: kekerasan seksual; pelecehan terhadap perampuan; perlindungan hukum. AbstractIn Indonesia, cases of sexual harassment often occur, and these cases continue to increase every year, ranging from sexual harassment in the form of verbal harassment to physical sexual harassment. This encourages the government to be able to make new regulations to prevent sexual violence in society, so it issued Law No. 12 of 2022 on May 9, 2022, concerning crimes of sexual violence. This research focuses on legal protection for victims of sexual violence and harassment. This research uses a normative juridical method. By using a statutory approach, referring to the positive legal norms that apply in Indonesia, we can answer the issues at hand. Based on the results of the research, it shows that the existence of the Sexual Violence Crime Law brings fresh air to the community in terms of prevention and handling of victims of sexual violence by restoring the rights of victims through restitution, compensation, and rehabilitation without stopping the ongoing legal process so that regulations This can be implemented and carried out effectively, but it is necessary to have supervision from the government in order to carry out the basic rights that must be obtained by every citizen.Keywords : Sexual violence; harassment of women ;legal protection

Abstract

Law is a tool for regulating people's lives with a coercive nature and requires people to follow existing rules. Death penalty is a punishment with the most severe sanction scale for perpetrators of extraordinary crimes such as narcotics, premeditated murder, terrorism, and crimes against state security. However, the application of death penalty in Indonesia is controversial because it violates Human Rights (HAM) and the right to life guaranteed by the 1945 Constitution Article 28A paragraph (1). Even though there is an update in the latest Criminal Code (KUHP) which regulates probation for 10 years, pros and cons still occur in the application of death penalty. Various views on capital punishment exist, in which some consider human rights and the principles of justice. However, the death penalty must be applied carefully and pay attention to human rights.

Abstract

Marriage between two people who have different religions is prohibited by almost all religions in Indonesia. Even though efforts have been made to obtain legal marital status, when a marriage is carried out, it is still obligatory to pay attention to Article 2 of Law Number 1 of 1974 concerning Marriage. The existence of an official registration in the form of a marriage certificate cannot be overlooked, because without it, marriages that are valid but not registered will not be recognized by the State. Marriage without legal recognition certainly has legal consequences, especially if it involves partners with different religions. This can create significant legal problems for husbands, wives and third parties, including the inheritance rights of children born in the marriage. The existence of a legal marriage is the basis of rights and obligations between husband and wife. The existence of a legally valid marriage and offspring born from a legal marriage are crucial to protecting the wife's rights regarding joint living and property. This is because, as stipulated in Article 43 Paragraph (1) of the Marriage Law, children born from illegitimate marriages only have legal ties with their mothers.

Abstract

This research aims to examine the problems that occur in the crime of murder and premeditated murder in the charges that will be filed against the perpetrators of these crimes. At the beginning, the background will be about how a criminal law in Indonesia develops and in carrying out its function as a legal rule that contains provisions, prohibitions, and criminal threats for those who commit a criminal case. This research will emphasize the problems that occur with the obstacles experienced by law enforcement in identifying a legal event that occurs in the case of murder with premeditated murder in finding an element of fulfillment, especially against the elements of the offense of premeditated murder. Then after that, the research will continue on legal reconstruction and legal discovery at the court hearing which aims to facilitate the disclosure of a legal event that occurs in order to find the material truth so that the judge can determine the sentence for the perpetrator.
