Abstract

Keadilan tidak pernah bertemu sejak zaman dahulu hingga saat ini, sebab masalah keadilan merupakan hal yang sangat esensial dalam kehidupan manusia, keadilan terus dibicarakan dan diperjuangkan oleh setiap individu dan masyarakat untuk memperolehnya agar kehidupannya dapat berjalan dengan baik aman dan sentosa. Keadilan adalah kebijakan tertinggi dan selalu ada dalam segala manifestasinya yang beraneka ragam. Keadilan merupakan salah satu tujuan setiap agama yang ada didunia ini, termasuk agama islam yang menempatkan keadilan ditempat yang sangat penting dalam kehidupan berbangsa dan beraneka.

Abstract

Merokok hukumnya berdasarkan makna yang terindikasi dari Zhahir ayat Al-Qur’an dan As-Sunnah serta I’tibar (logika) yang benar. Dalil dr Al-Qur’an firman-Nya Qs. Al-Baqarah 195. Maknanya, janganlah kamu melakukan sebab yang menjadi kebinasaanmu. Wajhud dialah (aspek pendalian) dari ayat tersebut adalah merokok termasuk perbuatan mencampakkan diri sendiri kedalam kebinasaan. Sedangkan dalil dari As-Sunnah adalah Hadits yang berasal dari Rasulullah secara Shahih bahwa beliau melarang menyia-nyiakan harta. Makna menyia-nyiakan harta adalah mengalokasikan kepada hal yang tidak bermanfaat. Sebagaimana dimaklumi bahwa mengalokasikan harta dengan membeli rokok adalah termasuk pengalokasinjya kepada hal yang tidak bermanfaat bahkan pengalokasian kepada hal yang didalamnya terdapat kemudharatan.

Abstract

The judicial process and the meaning of a Judge's belief in carrying out the functions and authority of the judiciary to enforce law and justice, through its verdict it is desirable that the Judge is able to apply the right and fair law, can provide education and lessons to the litigants and the community, give corrections firmly, repressively assert, can fabricate the future society order, and must be able to play a role in reconciling the litigants, who in doing these roles stick to the Code of Conduct and the Judicial Code of Conduct for Judges That Judges may participate in legal, either through the actualization of the existence of self in the midst of society, and by seeing the existence of himself as law enforcement officers. The judge should not take the wrong decision, so the innocent defendant must be sentenced, or the accused is actually guilty but released. However, according to the author, the judge should not hesitate to be convinced in making a decision in a decision and the decision may take the form of free judgment, the independent verdict of all charges, and sentence or punishment for the defendant.

Abstract

This research aims to describe and analyze how the deliberation system in Islamic politics and leadership conducted by the Prophet and his caliphs with the system of deliberation in Islamic politics and leadership conducted by Islamic organizations in North Sulawesi Province. This research is descriptive qualitative research. To get the data, the researcher did interviews with several managers from the three Islamic Organizations: the Muhammadiyah, the Nahdlatul Ulama (NU) and the Syarikat Islam (SI). Documentation data is also carried out to find out the annual work program and management activities. The results showed that Islamic organizations such as Muhammadiyah, NU and SI also conducted deliberations. Muhammadiyah holds deliberations every five years and involves regional managers, branches, and sub-branches. Muhammadiyah's political stance is not affiliated with political parties and focuses on the development of people who are knowledgeable and intelligent. Then, the concept of the NU deliberation is also contained in its household article. The NU conducts regional deliberations involving branch managers and sub-branch managers. The Nu's vision and mission is to become a religious and civic organization. The SI also conducts deliberations, namely annual deliberation, and daily deliberation. In its concept and perspective, the SI will further strengthen the organization's commitment through a populist economy and preaching based on the Qur'an and hadith. Thus, there are differences of views and principle related to the deliberation system of the Islamic politics and leadership from the three Islamic organizations even though the legal basis is the same, namely the Qur'an and Hadith.

Abstract

Gama in the Mongondow Muslim community is considered mandatory to determine a marriage’s validity. Therefore, this study aims to examine in depth the relevance of customary and Islamic law to the tradition of gama in the Muslim community of Mongondow, North Sulawesi. The study was conducted in the Bolaang Mongondow area of North Sulawesi using a juridical-sociological approach. Data were collected using observation, interviews with traditional and religious leaders, as well as document study. The steps in data processing include data collection, presentation, reduction, and verification. Furthermore, analysis was carried out using the concept of urf and receptie a contrario. The results showed that even though the gama tradition predates the arrival of Islam in Bolaang Mongondow area, its implementation has Islamic values, otherwise known as urf shahih. The community upholds the noble values of traditions passed down by their ancestors. Islam teaches that the gama tradition has a symbol of respect for women. This indicates that customary and Islamic law play a joint role in shaping the life of the Bolaang Mongondow people. Conclusively, respect for the existence of women is a noble value in the Customary law of the Mongondow people.

Abstract

Abstract: This study aims to analyze the considerations of judges in deciding two divorce cases due to apostasy claims including Case Number 14/Pdt.G/2019/PA.Bitg and 17/Pdt.G/2019/PA.Bitg at the Bitung Religious Court, Bitung City, North Sulawesi, Indonesia. It was conducted qualitatively through a descriptive-comparative approach with primary data obtained from informants including four judges using observation, in-depth interviews, and documentation techniques, subsequently analyzed using an inductive analysis model. Meanwhile, secondary data were retrieved from decision documents. The results showed that the judge decided Case Number 14/Pdt.G/2019/PA.Bitg in fâsakh and Case Number 17/Pdt.G/2019/PA.Bitg in ṭalâq ba‘in sughra through the consideration of the subsidiary petitum. These decisions were observed to have legal consequences on hadhânah and the right of mutual inheritance between children and parents. Abstrak: Penelitian ini bertujuan untuk menganalisis pertimbangan hakim dalam memutuskan dua perkara perceraian dengan gugatan murtad, yakni Perkara No. 14/Pdt.G/2019/PA.Bitg dan 17/Pdt.G/2019/PA.Bitg di Pengadilan Agama Bitung Pengadilan, Kota Bitung, Sulawesi Utara, Indonesia. Penelitian dilakukan secara kualitatif melalui pendekatan deskriptif-komparatif dengan data primer diperoleh dari informan meliputi empat orang hakim dengan menggunakan teknik observasi, wawancara mendalam, dan dokumentasi, selanjutnya dianalisis menggunakan model analisis induktif. Sedangkan data sekunder diperoleh dari dokumen keputusan. Hasil penelitian menunjukkan bahwa hakim dalam memutuskan dua perkara perceraian dengan gugatan murtad berdasarkan pada alat bukti dimana Perkara No. 14/Pdt.G/2019/PA.Bitg diputuskan secara fâsakh dan Perkara No. 17/Pdt.G/2019/PA.Bitg diputuskan secara ṭalâq ba’in sughra dengan menggunakan pertimbangan petitum subsider. Kedua putusan tersebut berakibat hukum pada hadhânah dan hak saling waris antara anak dan orang tua. Keywords: judge's consideration, divorce, apostasy, marriage fasâkh, ṭalâq ba'in sughra

Abstract

This study aims to describe the response of the Muslim community to the new marriage age regulation. The existence of this new provision reaps pros and cons because the community and the government understand the age of marriage, especially Muslim people, who basically consider the age limit for marriage to be when they have reached puberty. This research was conducted in North Sulawesi with a qualitative-descriptive research type and a sociological approach. Data was collected through interviews with informants starting from the community level, religious leaders and community leaders and then analyzed in a descriptive way. The results obtained are that there is a strong religious doctrine and public ignorance of the issuance of Law no. 16 of 2019. With this rule in place, they hinder many couples who are ready to get married. Most people show an attitude of disapproval of the 19-year age limit for marriage. For society, the law does not look good, especially for those who are not yet 19 years old. The community’s understanding is that both partners have reached puberty, as explained in Islamic teachings. Even so, for religious figures to show the opposite attitude, the 19-year marriage penalty rule is very necessary because it involves emotional and economic stability in living a household life. Actually, the implementation of Law No. 16 of 2019 could be more effective if Perma No. 15 of 2019 was also socialized because they related it to the purpose and reasons for the intended marriage age limit. There is a lack of public understanding of the 19-year age limit for marriage because Law No. 16 of 2019, which is socialized, is only a prohibition which prohibits it. Perma No. 15 of 2019 is the answer to the regulatory age limit for marriage at 19 years, which is always questioned in society.
