Abstract

This research aims to grasp to an understanding the influence of conflict of the Southern Tiongkok Sea and Transnational Organized Crime (TOC) to ASEAN peaceful and security region, as well as to the National Resilience of the Republic of Indonesia. Research method use a normative by examining relevant legal rules. Meanwhile, it is used analysis of substantive legal rules and the functioning of institutional government. The research findings are included as a follow (1) the Tiongkok government’s claim on the nine-dash lines over territory has no international legal basis. (2) The Indonesian government considers Transnational Organized Crimes, such as drug and narcotic trafficking, etc can therefore be categorized as more serious treath to the National Resilience of RI. The Indonesian government needs to take a countermeasure against Transnational Organized Crimes rather than the conflict of the Southern Tiongkok Sea. It is therefore the Indonesian government expected to take strictly control Transnational Organized Crimes over the entire territory.

Abstract

This study intends to analyze the relationship between Law Number 13 of 2012 concerning the Privileges of Jogyakarta to the conditions of social and economic welfare of the Jogyakartan communities. The problem that will be analyzed is why does Act Number 13 of 2012 not yet function effectively in improving the welfare of the Jogyakartan communities. This study uses the socio-legal method. The results of this study indicate that even though the existence of Law Number 13 of 2012 received a positive response from the Jogkartan communities, it has also been implemented in a number of Jogjakarta Special Regional Regulations such as the appointment of public offices, civil service and cultural civilization, but in its failed to improve the Jogyakartan communities welfare because of the availability of factors in the local representative people considering the conflict of interest between members of the Palace families.

Abstract

Penguasaan kepemilikan atas suatu wilayah merupakan salah satu tujuan suatu negara. Permasalahan terkait wilayah perbatasan Indonesia ? Malaysia kerap terjadi semenjak kemerdekaan masing-masing negara. Persengketaaan wilayah perbatasan umumnya timbul karena perbedaan pandangan tentang garis batas antara suatu Negara atas garis batas yang terletak dalam gambar. Hukum internasional telah sejak lama mengatur dengan jelas dan memberikan kepastian hukum tentang wilayah perbatasan suatu negara. Penentuan batas-batas suatu negara tersebut ditentukan oleh proses-proses hukum internasional, baik mempergunakan konsep self determination, asas uti possidetis, dan perjanjian batas negara. Sehingga penentuan batas-batas suatu negara diharapkan tidak lagi menimbulkan konflik. Perjanjian bilateral antara Inggris dan Belanda pada masa sebelum kemerdekaan Indonesia dan Malaysia, telah memberikan kepastian hukum tentang batas-batas antara kedua negara. Sehingga, dasar hukum pemerintahan kolonial tersebut sudah sepantasnya dijadikan bahan acuan bagi Indonesia dan Malaysia untuk menentukan luas wilayahnya masing-masing. Kerjasama pengelolaan wilayah perbatasan antara Indonesia dan Malaysia perlu untuk semakin ditingkatkan. Hal ini tentu saja memandang bahwa wilayah perbatasan di Pulau Kalimantan sungguh mengalami ketimpangan, baik sarana dan prasarana diantara kedua negara.Peningkatan kualitas sumber daya masyarakat lokal melalui capacity building programe, diharapkan dapat meningkatkan peran penegakan hukum yang berasaskan pada kearifan lokal masyarakat wilayah perbatasan

Abstract

This articles reveals that Sabah is legally recognized as a part of Malaysian integrated territory. This fact is not only found due to historical and legal basis on uti posidetis juris principle, but also because the UNO confirmed it by conducting referendum in Sabah and Sarawak 1963. Eventhough arm conflict in Sabah is not categorized as international conflict, the Geneva Convention 1949, Protocol II 1977, and International Human Rights Convention can be applicable to examine the arm conflict in Sabah. The inclusion of combatants, weapon used, victims and causalities, have been contributed in significant to identify the arm conflict. As a result, this arm conflict in Sabah has open an opportunity for the involved parties, not only the Malaysian Government can be brought in International Court of Justice for the violent of Geneva Convention and Human Rights, but also the Sultan Sulu followers could also be brought into national court, for the imigration infringement, and ISA as well Terrorist Act. Nonetheless, there  will be an opportunity for the Sultan Sulu to sue the government of Malaysia to claim the rights of private property.Keywords: International Arm Conflict; Territorial integrity; Legal ResponsibilityABSTRAKTulisan ini menunjukan bahwa Sabah secara hukum diakui sebagai bagian dari wilayah kedaulatan Malaysia. Fakta tersebut tidak hanya ditemukan dalam sejarah dan dasar hukum, serta prinsip uti posidetis juris. Tetapi juga Perserikatan Bangsa-bangsa menguatkannya melalui penyelenggaraan referendum di Sabah dan Sarawak tahun 1963. Konflik bersenjata di Sabah tidak dapat dikategorikan dalam konflik internasional dan konflik non-internasional. Namun, Konvensi Jenewa 1949, Protokol Tambahan II 1977, dan Konvensi Internasional tentang Hak Asasi Manusia dapat diterapkan dalam peristiwa konflik bersenjata di Sabah. Adanya Kombatan, penggunaan senjata, dan korban jiwa, secara signifikan dapat diidentifikasi sebagai konflik bersenjata. Konsekuensi hukumnya, konflik bersenjata di Sabah dapat membuka peluang bagi beberapa pihak terlibat dimintai pertanggungjawaban hukum. Tidak hanya Pemerintah Malaysia yang dapat dibawa ke hadapan Mahkamah Internasional atas pelanggaran Konvensi Jenewa dan Hak Asasi Manusia. Tetapi juga, pihak pengikut Kesultanan Sulu dapat dibawa ke peradilan nasional atas tindakan pelanggaran keimigrasian, dan juga pelanggaran atas Undang-undang Keamanan Nasional (Internal Security Act) sebagaimana halnya dengan Undang-undang Terorisme. Meskipun demikian, tidak menutup kemungkinan pihak Kesultanan Sulu dapat menuntut Pemerintahan Malaysia atas sengketa hak peralihan keuntungan bersifat keperdataan yang menjadi klaim dalam konflik bersenjata.Kata kunci : Konflik bersenjata internasional; kedaulatan wilayah; pertanggungjawaban hukum

Abstract

Abstrak Persaudaraan dalam Islam (ukhuwah Islamiyah) adalah ajaran yang ideal berdasarkan prinsip syariah. Hal ini terkait dengan konsep solidaritas Islam yang efektif digunakan untuk perlawanan dan perlindungan diri terhadap agresi non muslim. Ketika Negara Islam Irak dan Suriah (ISIS) menyatakan kendali mereka terhadap Irak dan Suriah, mereka didukung oleh konsep solidaritas Islam dari beberapa negara Muslim. Meskipun ISIS memenuhi persyaratan untuk berperang, seperti sebagai memiliki zona dibawah kendali, komandan, pengikut, dan seragam militer; tetapi ia tidak dapat diklasifikasikan sebagai berperang dalam hukum internasional karena fakta bahwa tindakan ISIS melanggar hukum humanis, ISIS saat ini ditolak oleh negara-negara muslim. Mengusulkan bantuan kemanusiaan yang dilakukan oleh muslim akan menjadi pilihan yang lebih baik untuk dipromosikan daripada melakukan intervensi kemanusiaan. Pemerintah Indonesia berupaya untuk memerangi pengikut ISIS, dan hal ini tidak akan berhasil tanpa ada usaha yang dilakukan. Kata kunci: Solidaritas Islam, ISIS, Hukum Internasional, Pemberontakan Abstrak Brotherhood in Islam (ukhuwah Islamiyah) is an ideal teaching based on Islamic principle.  It’s related to the concept of Islamic solidarity that is effectively used for resistence and self protection against non Moslem aggression. When the Islamic State of Iraq and Syria (ISIS) claimed their control to the Iraq and Syria, they are supported by the concept of Islamic solidarity from some Moslem countries.  Althought the ISIS comply belligerent requirements like as having under control zone, commander, follower, and military uniform; it cannot be classified as belligerent in international law due to the fact that the ISIS actions violate agains humanitarian law the ISIS currently rejected by Moslem countries to be valid and just war. Proposing humanitarian assistance conducted by Moslem would better choice to be promoted rather than humanitarian intervention. Indonesian government attemptes to combat against the ISIS followers cannot be tralled effectively, whithout any effort played.  Key Words: Islamic Solidarity, Islamic State of Iraq and Syria, Internasional Law, Belligerency

Abstract

Local governments, though they may establish international collaboration, they can not be considered as a subject of law in the international law, but rather as an auxiliary instrument of the central government. From the perspective of international law, the responsibilities raised by such international collaboration or international agreement is not in the hand of local government. Another significant point with regards to the said collaboration is that this is also does not contradict with the principle of national unity (NKRI). Because, the local government is merely as an agent of the state which is a subject of international law. In case of any disputes that may the agreements cause shall also be emphasized to be settled within national legal system of Indonesia.Keywords: Authority, Local Government, Collaboration, MoU, Sister City, Foreign Private

Abstract

This article sum up that Judicial Commission (JC) in Indonesia has a strong position in the constitution, UUD 1945 (after amendment). Its JC‘s position is legally considered a similar position with The Supreme Court and Constitutional Court. In practice, however, its JC‘s function is less effective to be an external control against judges code of conduct.Three factors are involved to make the JC fails to establish control effectively. One is the decreasing integrity of the JC due to the fact that The Deputy of Chief was involved in bribery practice. Second, the weakness of leadership which set a side of the JC‘s core business, as an external control. The third, The Constitutional Court is decision led the JC‘s function to undermine its authority. In order to improve its effective control, it is necessary to attempt certain efforts. On the one hand, the JC is demanding not only to maintain its personal integrity, but also need to change a leadership system. More importantly, the JC capability to join collaboration in supporting government and legislative member in revising the bill No 24/2002 need to take into account.Key words : Judicial commission, judges code of conduct, and supreme court
