Abstract

The research discusses: First, the existence of traditional law community and its regulation in Constitution 1945; second, the attempts that the traditional law community (MHA) must do as to preserve their values in a community; third, the relevance between theory and concept in preparing the development and making of the legal instrument for MHA values conservation. The literature study was conducted by collecting the primary and secondary materials to answer the research questions. The findings conclude that: First, the MHA position has been ratified as stipulated in Article 18B verse (2) and Article 28 verse (3) of Constitution 1945 and in other sectoral laws. Second, the MHA status and other traditional rights are not yet able to apply due to internal factors including the contradiction between the regulations of law related to MHA regulation and external factor, which is state institutions such as Ministry of Forestry and Ministry of Mining with formal evidence can easily turn down the MHA claim and its traditional rights. Third, the strengthening of MHA status and its traditional rights will increase if the Central Government describes them in the more concrete law.Key words : Conservation, MHA, constitutional rights

Abstract

An agression used by USA and its allies to Irak is apparanthy not legal for the absence strong legal arguments. The inclusion ofthe use ofthe UN Resolution No. 627 and 1441, the pre-emptive strike and anticipatory self-defence are obviously contravene againts the international obligations and the general principle of international accepted by civilizednations. As a result ofthe invalidity ofwar, the USA andits allies cannot escape from legal responsibility. Not only because its military aggression was not permitted by the Security Council, butalso because the role ofmilitar troops did hotcomply the demand ofthe 1948 Geneva Convention. Thousand civilians of Iraq aiid'public facilities were ruined toprove in significant that USA should take responsibility both collectively or individually, especially in treating bodly prisoners in Guantanamo andAbu Ghraib.

Abstract

The urgency of the presence of the Natural Disaster Act is due to the fact that a hight tecnology detection used to prevent natural disaster from happening is less effective than the use of legal instrument. In this contexts, however, Indonesian government should in the Draf of Natural Disaster Act acommodate the external components such as, internatinnal convention, status ofIDP's as victims, and foreign assistance and international relief worker. In Addition, The Draf need to explicitly contain certain legal nations like, effort of people's prevention, mitigation, rights and duties, and government responsibility. This includes legal advocacy and the people right to take legal action, when the government faits to fulfil the duties.

Abstract

This essay reveals that indigenous people such as Indian people in America^and Aborigine in Australia find it dificult to culturally and socially Integrate with white people who are colonizers. Some cases of state conflict relating to the land dispute have placeda vital role in which neighbors countries are involved in the arms conflict or wars. It is not be cause the absence of the law to handle dispute, rather the political interest of certain country predominate to treat the case unjustly as demonstrated in Palestine case. In relation to the current situation, the Australian and Indonesian government concern very much to improve land reform for the interest of the people by is suing certain laws andregulations. In fact, however, the Australian government currently recognizes the Native Title Act for Aborigine to occupy and own their own land in conjuction with their own beliefs' and myths. The positive development takes place in Indonesian, not only, because the presence of the state platform of guideline and the law No 22/1999 concerning the local autonomy, but also due to the people welfare, the government requires to implement thebasic principle of agrarian law. It is in fact, however, uneasy to implement it because the practice ofthe state of local autonomy is challenged by internal problems of professional workers and also in certain territories, such as Yogyakarta, is uneasy to fully adhere the law because of its special treatment.

Abstract

The first and foremost issue in this study is the general principles and legal arrangements of tapping into national and international human rights law. Second, as lex specially can tappin be prosecuted to national or international law? Third, why is the wiretapping of Australia against Indonesia not considered as a crime but a violation of the diplomatic code of conduct. This is a normative research. The study reveals that first: legally tapping is prohibited by law and international human rights based on the Universal Declaration of Human Rights (UDHR) in 1948, the International Covenant on Civil and Political Rights (ICCPR) in 1966, the European Convention for the Protection of Human Rights and Fundamental Freedoms (1958) and the 1961 Vienna Convention. While in the national law, the prohibition of tapping is provided in Article 28G paragraph (1) of the 1945 Constitution, Article 32 of law No. 39 of 1999, Article 40 of Law No. 36 of 1999, Article 31 paragraph (1) of Law No. 11 of 2008, and Article 31 paragraph (2) of Law No. 11 Year 2008. Tapping is allowed when the order and security of the country is being threatened as stipulated in the Law on Combating Criminal Acts of Terrorism, Narcotics Law, the Law on the Corruption Eradication Commission, and the Law on State Intelligence. Second, the ban on wiretapping in international criminal law can be excluded for particular crimes as stipulated by Rome Statute of 1998, and Transnational Organized Crime. Thirdly, in the context of the behavior relations between countries, Australia tapping against Indonesia has shifted meaning from a crime  into a violation of the diplomatic code of conduct. Indonesia acted diplomatically towards Australia’s violation by forgiveness.
