Abstract

Seiring perkembangan zaman yang begitu pesat tidak dipungkiri kian banyak para pelaku bisnis khususnya pencipta songket motif baru Sumatera Barat berlomba-lomba untuk menciptakan kreasi baru terhadap motif-motif songketnya agar laku dipasaran, baik pada skala nasional maupun skala internasional. Supaya ciptaannya tersebut dapat dilindungi dan tidak disalahgunakan oleh pihak lain, maka para pencipta perlu untuk mendaftarkan hasil karyanya tersebut dalam bentuk hak cipta. Sebenarnya perlindungan atas Hak Cipta itu sendiri sudah diatur dalam konvensi-konvensi internasional. Kenyataannya saat ini, banyak dari pencipta songket khususnya songket Sumatera Barat tidak berminat untuk mendaftarkan Hak Cipta dari songket hasil karyanya. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana perngaturan dari hukum nasional dan internasiona dalam Memberikan Perlindungan Terhadap Hak Cipta Songket di Sumatera Barat serta apa saja upaya atau kendala yang dihadapi oleh pengrajin songket maupun Pemda Sumatera Barat sendiri dalam melindungi hak atas motif songket tersebut. Metode penelitian yang dipakai dalam penulisan tesis ini adalah metode penelitian normatif yang di topang dengan sosiologis empiris, dengan cara mengumpulkan data primer dan sekunder pada beberapa instansi yang berwenang di bidangnya. Hasil penelitian ini menunjukan bahwa aturan intermasuional yang telah dituangkan dalam beberapa konvnesi seperti TRIPS dan Konvnesi Bern telah mengatur tentang perlindungan hak cipta itu sendiri khususnya songket walaupun belum begitu eksplisit. Bahkan aturan internasional tersebut telah diimplementasikan kedalam Undang-undang No. 19 tahun 2002 tentang Hak Cipta. Beberapa faktor yang menjadi kendala dari pengrajin adalah seperti kurangnya pengetahuan pengrajin tentang hak cipta, sosialisasi yang kutrang tepat, kesadaran dari masyarakat, serta tata cata pendaftaran yang berelit-belit atau biaya mahal. Kendala dari Pemda sendiri yaitu kurangnya koordinasi antara pihak-pihak terkait, kurangnya tenaga ahli dalam bidang HKI, keterbatasan dana serta lemahnya kepastian hukum.

Abstract

Implementation of Standard Operating Procedure for Immigration Detention Center (Rudenim) is still not running smoothly or less effective. This is due to the confusion and contradictions in the statement of basic measures and policy objectives which have resulted in disciplinary regulations that intersect with Standard Operating Procedures regarding temporary exit permits for Deteni without escort. The level of supervision carried out by Rudenim is not optimal. The existing regulations have not been able to provide effective supervision so that violations may occur. If there is no current supervision of asylum seekers outside the shelter, it is possible that other bad things will happen, so there is a need for a good formulation of the Code of Conduct. And also the lack of rudenim at the Immigration Office in Indonesia which causes overload, resulting in unwanted cases.

Abstract

This paper is based on CHAPTER III Law no. 6 of 2011 concerning Immigration "Entering and Exiting the Territory of Indonesia". Every foreigner or citizen who wants to enter or leave the territory of Indonesia must go through the Immigration Checkpoint (TPI), if there is a discrepancy and doubt about the validity of the travel document, the immigration officer has the right to refuse to give the person entry or exit stamp. Therefore, immigration has a very vital role in maintaining the country's sovereignty, immigration officers are required to be competent in carrying out their duties. Maintaining state sovereignty through selective policies must be maximized. The need to guard the door of state sovereignty to avoid potential threats that come from various angles.

Abstract

The traffic of people in and out of the country's territory is something that cannot be stopped by any countries in the world, include Indonesia. Various factors such as economic, cultural, and social become stimulants of traffic, which then called immigration. The principle of selective policy is the principle applied in the implementation of immigration in Indonesia, which it’s implementation is carried by Directorate General of Immigration, under the Ministry of Law and Human Rights of the Republic of Indonesia. The selective policy is the basis of the implementation of immigration examination that carried out in immigration checkpoints located at airports, seaports, land border, and other immigration checkpoints, which only people who are useful and do not endanger the unity of the nation can be allowed to enter the territory of the Unitary State of Republic of Indonesia. Immigration checks are also carried out strictly on Indonesian citizens to minimize the possibility of becoming non-procedural labor which can lead to the criminal act of human trafficking. In order to increase security for achieving the welfare of the Indonesian people, the Directorate General of Immigration needs to improving the quality of its human resources which leads to advances in policy and regulation making, systems and technology, and also the technicality of immigration services.

Abstract

Immigration services are provided by the Immigration Office under the Immigration Directorate of the Ministry of Law and Human Rights. These services cover all processes related to entry, stay and exit of citizens and foreign nationals in a country. In accordance with Law Number 6 of 2011 concerning Immigration, the class II immigration office of TPI Sumbawa Besar has the following tasks: Granting and Supervision of Visas and Stay Permits, Registration of Foreigners, Granting of Citizenship, Provision of Consular Services, Immigration Law Enforcement, Border Control, International Cooperation while its functions are: Controlling the Movement of People, Security Monitoring, Services and Facilitation, Control of Illegal Immigration, Provision of Information, Law Enforcement, Data Management, Policy Implementation. In this activity the Immigration Office Class II TPI Sumbawa Besar together with lecturers and cadets of the Immigration Polytechnic introduced the Immigration Polytechnic as one of the official schools under the Ministry of Law and Human Rights which focuses on the field of immigration.
