Abstract

Seiring perkembangan zaman yang begitu pesat tidak dipungkiri kian banyak para pelaku bisnis khususnya pencipta songket motif baru Sumatera Barat berlomba-lomba untuk menciptakan kreasi baru terhadap motif-motif songketnya agar laku dipasaran, baik pada skala nasional maupun skala internasional. Supaya ciptaannya tersebut dapat dilindungi dan tidak disalahgunakan oleh pihak lain, maka para pencipta perlu untuk mendaftarkan hasil karyanya tersebut dalam bentuk hak cipta. Sebenarnya perlindungan atas Hak Cipta itu sendiri sudah diatur dalam konvensi-konvensi internasional. Kenyataannya saat ini, banyak dari pencipta songket khususnya songket Sumatera Barat tidak berminat untuk mendaftarkan Hak Cipta dari songket hasil karyanya. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana perngaturan dari hukum nasional dan internasiona dalam Memberikan Perlindungan Terhadap Hak Cipta Songket di Sumatera Barat serta apa saja upaya atau kendala yang dihadapi oleh pengrajin songket maupun Pemda Sumatera Barat sendiri dalam melindungi hak atas motif songket tersebut. Metode penelitian yang dipakai dalam penulisan tesis ini adalah metode penelitian normatif yang di topang dengan sosiologis empiris, dengan cara mengumpulkan data primer dan sekunder pada beberapa instansi yang berwenang di bidangnya. Hasil penelitian ini menunjukan bahwa aturan intermasuional yang telah dituangkan dalam beberapa konvnesi seperti TRIPS dan Konvnesi Bern telah mengatur tentang perlindungan hak cipta itu sendiri khususnya songket walaupun belum begitu eksplisit. Bahkan aturan internasional tersebut telah diimplementasikan kedalam Undang-undang No. 19 tahun 2002 tentang Hak Cipta. Beberapa faktor yang menjadi kendala dari pengrajin adalah seperti kurangnya pengetahuan pengrajin tentang hak cipta, sosialisasi yang kutrang tepat, kesadaran dari masyarakat, serta tata cata pendaftaran yang berelit-belit atau biaya mahal. Kendala dari Pemda sendiri yaitu kurangnya koordinasi antara pihak-pihak terkait, kurangnya tenaga ahli dalam bidang HKI, keterbatasan dana serta lemahnya kepastian hukum.

Abstract

Implementation of Standard Operating Procedure for Immigration Detention Center (Rudenim) is still not running smoothly or less effective. This is due to the confusion and contradictions in the statement of basic measures and policy objectives which have resulted in disciplinary regulations that intersect with Standard Operating Procedures regarding temporary exit permits for Deteni without escort. The level of supervision carried out by Rudenim is not optimal. The existing regulations have not been able to provide effective supervision so that violations may occur. If there is no current supervision of asylum seekers outside the shelter, it is possible that other bad things will happen, so there is a need for a good formulation of the Code of Conduct. And also the lack of rudenim at the Immigration Office in Indonesia which causes overload, resulting in unwanted cases.

Abstract

This paper is based on CHAPTER III Law no. 6 of 2011 concerning Immigration "Entering and Exiting the Territory of Indonesia". Every foreigner or citizen who wants to enter or leave the territory of Indonesia must go through the Immigration Checkpoint (TPI), if there is a discrepancy and doubt about the validity of the travel document, the immigration officer has the right to refuse to give the person entry or exit stamp. Therefore, immigration has a very vital role in maintaining the country's sovereignty, immigration officers are required to be competent in carrying out their duties. Maintaining state sovereignty through selective policies must be maximized. The need to guard the door of state sovereignty to avoid potential threats that come from various angles.

Abstract

The traffic of people in and out of the country's territory is something that cannot be stopped by any countries in the world, include Indonesia. Various factors such as economic, cultural, and social become stimulants of traffic, which then called immigration. The principle of selective policy is the principle applied in the implementation of immigration in Indonesia, which it’s implementation is carried by Directorate General of Immigration, under the Ministry of Law and Human Rights of the Republic of Indonesia. The selective policy is the basis of the implementation of immigration examination that carried out in immigration checkpoints located at airports, seaports, land border, and other immigration checkpoints, which only people who are useful and do not endanger the unity of the nation can be allowed to enter the territory of the Unitary State of Republic of Indonesia. Immigration checks are also carried out strictly on Indonesian citizens to minimize the possibility of becoming non-procedural labor which can lead to the criminal act of human trafficking. In order to increase security for achieving the welfare of the Indonesian people, the Directorate General of Immigration needs to improving the quality of its human resources which leads to advances in policy and regulation making, systems and technology, and also the technicality of immigration services.

Abstract

This research is motivated by the main problem related to the supervision of the Indonesian immigration authorities which is inadequate when compared to immigration control with other countries. In many cases, Indonesian immigration authorities often fail to face immigration violations committed by foreign nationals, therefore improvements in supervision by Indonesian immigration authorities need to be carried out to minimize the negative impact of immigration violations committed by foreign nationals. The results of this study found immigration problems that should have been fixed by collaborating with other agencies, one of which was the navy or improving the system or internal rules of the Directorate General of Immigration itself so that the optimization of supervision related to entrances and exits can run as expected.

Abstract

TPI Bengkulu Class I Immigration Office as a public service sector in the field of immigration strives to provide excellent service facilities for every community, especially applicants Republic of Indonesia passport. The services provided by employees are in accordance with standard operating procedures for services, but there are still applicants whose needs have not been met. So that it is still necessary to increase employee competence through socialization of excellent service. The existence of various backgrounds of applicants both in terms of culture, education, customs and others causes complaints from applicants for passports of the Republic of Indonesia to still exist. However, the percentage is relatively small compared to the total number of passport applicants at the Immigration Office Class I TPI Bengkulu. This study aims to determine the process of implementing excellent service socialization for employees at the Immigration Office Class I TPI Bengkulu. The type of research method used is descriptive qualitative, with data collection techniques through observation, interviews and documentation. The results of the study show that the socialization of excellent service at the Immigration Office Class I TPI Bengkulu is secondary socialization according to Berger and Luckman (2019) which has been well implemented at the Immigration Office Class I TPI Bengkulu by using 6 indicators according to Chao (1994), namely performance proficiency), people, politics, language, organizational goals and values, and history (history).

Abstract

Immigration services are provided by the Immigration Office under the Immigration Directorate of the Ministry of Law and Human Rights. These services cover all processes related to entry, stay and exit of citizens and foreign nationals in a country. In accordance with Law Number 6 of 2011 concerning Immigration, the class II immigration office of TPI Sumbawa Besar has the following tasks: Granting and Supervision of Visas and Stay Permits, Registration of Foreigners, Granting of Citizenship, Provision of Consular Services, Immigration Law Enforcement, Border Control, International Cooperation while its functions are: Controlling the Movement of People, Security Monitoring, Services and Facilitation, Control of Illegal Immigration, Provision of Information, Law Enforcement, Data Management, Policy Implementation. In this activity the Immigration Office Class II TPI Sumbawa Besar together with lecturers and cadets of the Immigration Polytechnic introduced the Immigration Polytechnic as one of the official schools under the Ministry of Law and Human Rights which focuses on the field of immigration.

Abstract

Penelitian ini menganalisis secara kritis fenomena "No Viral No Justice" sebagaigejala krisis legitimasi hukum dan dampaknya terhadap supremasi hukum diIndonesia. Dengan pendekatan hukum normatif-empiris, studi ini menganalisissejumlah kasus yang viral untuk mengidentifikasi faktor pendorong dandampaknya, dengan Teori Ruang Publik Habermas sebagai salah satu pisauanalisis utama. Hasil penelitian menunjukkan bahwa media sosial berfungsisebagai ruang publik baru di mana intensitas partisipasi warganet, peraninfluencer, serta narasi emosional terbukti mendorong percepatan respons aparatpenegak hukum. Namun, ketergantungan pada viralitas ini mengancam prinsipprinsip inti sistem hukum. Fenomena ini, meskipun mempercepat keadilan dalambeberapa kasus, berisiko menciptakan trial by social media dan mendorongdisparitas penanganan kasus. Studi ini menyimpulkan bahwa "No Viral No Justice"berfungsi sebagai pedang bermata dua: sebuah bentuk kontrol sosial yang lahirdari ketidakpercayaan publik, tetapi juga menjadi ancaman potensial bagi keadilansubstantif. Oleh karena itu, reformasi sistemik mendesak diperlukan untuk memulihkan kepercayaan publik dan memastikan keadilan tidak ditentukan olehtren viral, melainkan oleh proses hukum yang objektif.

Abstract

Eksploitasi Warga Negara Indonesia (WNI) sebagai administrator judi daring di Kamboja menunjukkan adanya kelemahan signifikan dalam kerangka regulasi keimigrasian Indonesia pada era migrasi digital. Penelitian ini bertujuan untuk menganalisis celah yuridis dalam sistem keimigrasian Indonesia dan merumuskan rekomendasi kebijakan berbasis praktik terbaik internasional. Pendekatan penelitian menggunakan metode yuridis normatif melalui telaah undang-undang, putusan pengadilan, laporan internasional, dan literatur bereputasi, termasuk Palermo Protocol, Konvensi ILO C029, dan rujukan kebijakan migrasi digital di Malaysia, Filipina, dan Thailand. Hasil analisis menemukan kelemahan mendasar pada kategori visa pekerja digital, minimnya integrasi data antar-instansi, lemahnya SOP deteksi perdagangan orang berbasis teknologi, serta belum optimalnya implementasi protokol perlindungan korban. Studi komparatif dengan kebijakan e-visa berbasis geofencing, lisensi agen ketat, dan emergency repatriation system di negara tetangga menunjukkan potensi penerapan inovasi teknologi dan perlindungan berbasis hak asasi manusia di Indonesia.
