Abstract

Religious revelation teaches two ways to acquire knowledge. First, through revelation, namely through communication from God to humans, and secondly through reason or thought, namely using impressions obtained by the five senses as food for thought to arrive at conclusions. Knowledge obtained through revelation is believed to be absolute knowledge, while knowledge obtained through reason is believed to be relative knowledge, which requires continuous testing, can be right and can be wrong. In contrast to the revealed religion, the earthly religion departs from the knowledge acquired. through contemplation, to gain truth and enlightenment. In the age of scientific and technological advances, the question arises, which knowledge is more trusted, knowledge obtained through thought, knowledge through revelation, or knowledge obtained through both.

Abstract

 Maṣlaḥat  adalah sebuah produk pemikiran dari para ulama yang menggambarkan tentang kemahaadilan Tuhan dalam menurunkan syari’at kepada mukallaf. Sedemikian pentingnya maṣlaḥat ini sehingga para ulama banyak berbicara tentang dalam konteks menyetujuinya dan sebagian lainnya masih mengkaji ulang eksistensinya dalam syari’at. Maṣlaḥat  bukanlah dalil yang qaṭ’iy dan ia juga bukan merupakan dalil yang ẓannīy.  Ia hanyalah dalil ijtihadi yang secara mendasar melingkupi aspek-aspek penetapan hukum (al-tasyri’) dan menjadi kajian intens ketika mukallaf  menuntut keadilan Tuhan dan  ketika mukallaf  itu dimintai keterangan dan pertanggungjawaban perbuatannya. Diskursus ulama seputar maṣlaḥat telah berkembang dan mengantar mereka pada tahapan berbeda pendapat.

Abstract

This research discusses the application of simple, fast, and low-cost principles in resolving inheritance cases at the Sungguminasa Class IB Religious Court. This research is a type of field research and qualitative research with an empirical legal approach. The results of the research show that the application of the principles of simplicity, speed, and low cost in inheritance cases at the Sungguminasa Class IB Religious Court has been well implemented, but especially in inheritance cases, it is very difficult to apply the principles of simplicity, speed, and low cost. low cost. There are several factors that hinder the simple, fast, and low-cost principles from being maximized at the Sungguminasa Class IB Religious Court, namely differences in the area of residence of the parties involved in the case, the summoning of the parties, and the use of lawyers. As an implication, for those who bring inheritance cases to the Sungguminasa Class IB Religious Court, especially in the case of the settlement process, to avoid complicating the process, the defendant should know how to proceed. The application of the principle of simple, fast, and short life is possible because our own decision as litigants is to make peace before a judge.
