Abstract

The goal of this study is to examine the mechanism of the murabaha contract as it is enforced in BSM and its applicability in the National Sharia Fatwa Council (DSN) of the Indonesian Ulema Council (MUI) No: 04/DSN - MUI/IV/2000 about General Provisions on Murabahah Contracts. The study technique employed is descriptive qualitative, with data gathering methods based on primary data acquired from Fatwa BSM and DSN-MUI official websites, as well as secondary data sourced from related articles and journals. The results of the research are that the mechanism for managing pension funds for murabahah contracts is very flexible, starting with the customer's will and BSM's approval, then BSM takes over from TASPEN and then the funds are disbursed. and the mechanism for changing the pension fund agreement has met the standardization of the DSN-MUI Fatwa Number 4 of 2000.

Abstract

Savings products at BSI use a wadiah yad dhamanah agreement, namely the use of customer savings funds by the bank without sharing profits with the customer, but the customer is given a bonus from time to time by the bank according to the management's interruptions. Wadiah yad amanah almost does not exist in Indonesian sharia banks. In muamalah, both in trading and in Islamic banking, Islamic banking has also regulated that it must not harm other parties, must be transparent and there must be no element of usury. This research uses qualitative research. It is hoped that this research will be able to provide a detailed description of the theory regarding the comprehensive systematic application of wadiah contracts regarding matters relating to bank business activities with sharia principles, especially in raising funds, namely wadiah. The results of this research show that the implementation of the wadiah contract using wadiah yad dhamanah in Indonesian sharia banks seems forced in order to attract as many customers as possible, where the majority of the Indonesian population is Muslim, as well as in order to gain the trust of its customers.

Abstract

Penulis melakukan penelitian penemuan ini bertujuan untuk membedah tentang tentang Hukum Islam Sui Generis Kum Empiris terhadap Pendekatan yang dilakukan secara Sosiologis Dan Antropologis. sebagaimana dapat dipahami bahwa di era sekarang banyak sekali persoalan atau problematika terkait sebuah kegiatan dalam hukum Islam yang merupakan isu-isu kontemporer hukum Islam, dengan demikian isu-isu kontemporer ini perlu adanya suatu metode dalam penemuan Hukum Islam seperti halnya Hukum Islam Sui Generis dengan pendekatan sosiologi dan antropologis. penelitian ini menggunakan pendekatan kepustakaan dimana data diambil berdasarkan literatur, adapun data primer diperoleh dari sumber bacaanartinya buku yang berkaitan dan relevan dengan judul penelitian penulis seperti halnya buku Prof Syamsul Anwar terkait penemuan Hukum Syariah. adapun data skunder diperoleh dari artikel, website tertentu dan jurnal. dengen demikian diperoleh hasil bahwa Pendekatan sosiologis melihat bagaimana hukum dan faktor sosial lainnya berhubungan satu sama lain secara analitis dan empiris. Sedangkan pendekatan antropologi adalah studi tentang bagaimana hukum membentuk kehidupan manusia. Ini dimulai dengan sistem berpikir manusia, yang menghasilkan nilai-nilai dan kebudayaan, yang pada gilirannya membentuk hukum dalam masyarakat.

Abstract

  The Musyarakah Mutanaqisah (MMQ) contract, as one of the increasingly popular financing products in Islamic banking, offers a unique alternative to asset ownership that is in line with sharia principles. This study aims to comprehensively analyze the MMQ contract, highlight its Sharia foundations, and identify and explore the issues that arise in its implementation in the field. The research methods used include literature review and qualitative analysis of fatwas issued by the National Sharia Council of the Indonesian Ulema Council (DSN-MUI), Islamic banking regulations, and practices observed in several Islamic banks. The analysis shows that, in theory, MMQ is built on three basic contracts that do not conflict with each other: the syirkah or musyarakah contract for partnership, the ijarah contract for lease, and the sale and purchase contract for transfer of ownership. The combination of the three forms an innovative financing structure. However, in practice, several crucial issues arise. One of these is the issue of al-Ijarah al-Mawsuqah bil-Bay', or lease followed by a promise of sale, which some contemporary scholars still debate its validity. Nevertheless, the DSN-MUI has issued a fatwa permitting this scheme under certain conditions and terms

Abstract

Abstrak Penelitian ini bertujuan untuk menganalisis pengelolaan zakat di Baitul Mal Kabupaten Bireuen dengan menggunakan perspektif teori struktur fungsional Talcott Parsons (AGIL). Data penelitian bersumber dari Laporan Kinerja Instansi Pemerintah (LKjIP) tahun 2023 yang menunjukkan bahwa Baitul Mal Bireuen memiliki legitimasi hukum yang kuat melalui Qanun Kabupaten Bireuen Nomor 3 Tahun 2016 yang diperbarui dengan Qanun Nomor 3 Tahun 2019, serta diperkuat oleh Qanun Aceh Nomor 3 Tahun 2021. Struktur organisasi yang jelas dan dukungan sumber daya manusia berpendidikan sarjana menjadi modal penting dalam pengelolaan zakat. Realisasi anggaran tahun 2023 mencapai Rp29,17 miliar, dengan lebih dari 91% dialokasikan untuk belanja bantuan sosial berupa penyaluran zakat dan infak. Program utama meliputi pendistribusian zakat kepada fakir miskin, bantuan korban bencana, sosialisasi zakat, serta pemberdayaan ekonomi umat. Analisis dengan kerangka AGIL menunjukkan bahwa Baitul Mal Bireuen telah menjalankan fungsi adaptasi, pencapaian tujuan, integrasi, dan latensi secara efektif. Hasil penelitian menegaskan bahwa zakat melalui Baitul Mal bukan hanya kewajiban ritual, tetapi juga instrumen strategis dalam membangun masyarakat yang adil, sejahtera, dan harmonis, sekaligus memperkuat integrasi sosial dan mendukung pembangunan daerah berbasis syariat Islam Kata Kunci: Pengelolaan Zakat, Baitul Mal, Talcot Person   Abstract This study aims to analyze zakat management at Baitul Mal of Bireuen Regency using Talcott Parsons’ structural functional theory (AGIL). The research data is derived from the 2023 Government Agency Performance Report (LKjIP), which highlights that Baitul Mal Bireuen possesses strong legal legitimacy through Qanun Bireuen Regency No. 3 of 2016, revised by Qanun No. 3 of 2019, and further reinforced by Qanun Aceh No. 3 of 2021. The institution’s clear organizational structure and the support of qualified human resources, predominantly with bachelor’s degrees, serve as essential assets in zakat management. The 2023 budget realization reached IDR 29.17 billion, with more than 91% allocated to social assistance in the form of zakat and infaq distribution. Key programs included zakat distribution to the poor, disaster relief, zakat awareness campaigns, and community economic empowerment. Analysis using the AGIL framework demonstrates that Baitul Mal Bireuen effectively fulfills the functions of adaptation, goal attainment, integration, and latency. The findings emphasize that zakat, managed through Baitul Mal, is not merely a ritual obligation but a strategic instrument for building a just, prosperous, and harmonious society, while simultaneously strengthening social integration and supporting regional development based on Islamic law. Abstract

This study aims to analyze the resolution of breach of contract in lease agreements under Islamic law. A breach (wanprestasi) in an ijarah (lease) contract occurs when one party fails to fulfill agreed obligations, such as late payment, misuse of the leased object, or violation of contractual terms. In Islamic law, the resolution of such breaches emphasizes the principles of justice (‘adl), public interest (maslahah), and good faith between the parties. Dispute resolution is primarily conducted through mutual deliberation (ṣulḥ) to reach an amicable settlement without harming either party. If such efforts fail, the dispute may be brought before judicial institutions, where decisions are made based on evidence and sharia principles. Sanctions for breach in Islamic law are not punitive in nature but aim to restore rights and obligations proportionally, including compensation (ta‘wīḍ) for actual losses incurred. Additionally, contract termination (fasakh) may be applied in cases of substantial violation. Therefore, the resolution of breach of contract in Islamic law highlights a balance between enforcement of rights, responsibilities, and moral values grounded in sharia principles.
