Abstract

Abstrak Hukum selalu berkaitan erat dengan moralitas. Hukum tidak ada artinya jika tidak dibarengi dengan moral, sehingga kualitas hukum sangat ditentukan oleh kualitas moral. Hukum lebih dikodifikasikan daripada moralitas, artinya dituliskan dan secara lebih sistematis disusun dalam peraturan perUndang-Undang, Hukum membatasi diri pada tingkah laku secara lahiriah, sedangkan moral menyangkut sikap batin seseorang subjek hukum. Hukum didasarkan atas kehendak masyarakat dan akhirnya atas kehendak negara dan moralitas didasarkan pada norma-norma moral yang melampaui para individu dan masyarakat. Meninggalkan moral dalam berhukum sama saja dengan hukum yang kehilangan ruhnya. Kata kunci: Hukum, Moral, Penegakan Hukum, Indonesia

Abstract

ABSTRAKKejahatan lingkungan yang marak terjadi di Indonesia beberapa dekade belakangan ini, banyak memakan korban, baik itu korban manusia ataupun non-manusia seperti hewan, pohon, sungai dll. Namun dalam kenyataanya dilapangan, perlindungan korban masih jauh dari yang semestinya, apalagi berkaitan dengan korban non manusia. Penelitian ini menggunakan pendekatan hukum normatif atau penelitian hukum kepustakaan (library research), dengan pendekatan peraturan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), pendekatan analitik (analytical  approach), pendekatan historis (historical approach), pendekatan futuristic (futuristic approach). Sifat penelitian yang digunakan dalam penelitian ini adalah deskriptif-preskriptif, penulis menganalisis dengan menggunakan teknik analisis isi (content analysis). Hasil dari penelitian ini adalah mencoba konsep green victimology dalam upaya perlindungan korban terhadap kejahatan lingkungan, yang menetapkan bahwa batasan korban atas viktimisasi lingkungan dalam perspektif green victimology tidak hanya terbatas pada manusia saja, namun juga termasuk dapat mengklasifikasikan korban non-manusia seperti, hewan, pohon, dan sungai, yang didasari pada nilai ekosentrisme (mengakui nilai-nilai intrinsik) dan sudut pandang keadilan lingkungan (ecojustice).Kata kunci: green victimology; hukum; Indonesia; korban; lingkunganABSTRACTEnvironmental crimes have been rampant in Indonesia in recent decades, taking many victims, human or non-human victims, such as animals, trees, rivers, etc. But in reality, on the ground, victim protection is still far from what it should be, especially for non-human victims. This study uses a normative legal approach or library research, with a statute approach, a conceptual approach, an analytical approach, a historical approach, and a futuristic approach. The nature of the research used in this research is descriptive-prescriptive. The authors analyze using content analysis techniques. The result of this study is to try the concept of green victimology to protect victims against environmental crimes, which stipulates that the victim's limitation on environmental victimization in the perspective of green victimology is not only limited to humans but also includes being able to classify non-human victims such as animals, trees. , and rivers, which are based on the value of ecocentrism (recognizing intrinsic values) and the point of view of environmental justice (ecojustice).Keywords: environment; green victimology; Indonesia; law; victim

Abstract

Penal Mediation is an alternative form of case settlement that originates with the idea of restorative justice. Seeing a large number of medical personnel being convicted in malpractice cases (primum remedium), mediation in dispute settlement for malpractice cases in hospitals becomes the concept of victim protection, harmonization, and overcoming rigidity/ formality in the applicable system. Therefore, the purpose of this study is to find solutions to avoid the adverse effects of the Criminal Justice System with the concept of mediation as an effort to resolve malpractice cases in the future. This paper used normative legal research or library research with a statute, conceptual, and comparative approach. The nature of the research used in this study is descriptive-prescriptive. The author used content analysis. The findings of this study are meant to provide an alternative solution to punishment which should be a last resort (ultimum remedium) from law enforcement in the form of non-litigation settlement through mediation.

Abstract

This study analyzes the provision of community service sanctions under the Indonesian Criminal Code (KUHP Nasional) as a viable alternative to conventional sentencing aimed at mitigating overcrowding in correctional facilities. Imprisonment remains the cornerstone of criminal justice enforcement in Indonesia, leading to escalating inmate populations that far exceed available prison capacities. Consequently, this has engendered multiple challenges, such as diminished rehabilitation efficacy, inadequate amenities, and elevated tensions among inmates (Directorate General of Corrections, 2023). Adopting a normative methodology, the research scrutinizes the statutory provisions for community service sanctions and their prospective integration into criminal adjudication processes. Results affirm that these sanctions represent a more humane and proportionate punitive measure, extending beyond retribution to encompass offender restoration and societal reintegration (Articles 70-72, KUHP Nasional). Moreover, their adoption holds substantial promise for alleviating pressures on penitentiary systems. Nonetheless, deployment encounters hurdles including law enforcement preparedness, insufficient technical protocols, and constrained field-level resources. Hence, resolute collaboration among key stakeholders is imperative to facilitate the efficacious and enduring enforcement of community service sanctions.

Abstract

The phenomenon of overcrowding in correctional institutions has reached a critical point, threatening the stability of the criminal justice system in Indonesia. This study aims to analyze how Law No. 1 of  2023 concerning the Criminal Code (National Criminal Code) addresses this problem through criminal policy reform. Using normative legal research methods, this study examines new de-incarceration norms in the National Criminal Code. The study concludes that efforts to address overcrowding in Law No. 1 of 2023 are carried out through modifications to more humane sanctions, namely prioritizing non prison sentences (community work and supervision) for crimes punishable by imprisonment under five years. Furthermore, expanding the requirements for conditional sentences and formally recognizing restorative justice are expected to minimize the influx of convicts into prisons. The effectiveness of these instruments requires synchronization between law enforcement agencies and the availability of monitoring infrastructure outside prisons. The National Criminal Code offers new hope for resolving the issue of overcrowding through a criminalization approach that is no longer prison centric.

Abstract

Supervisory punishment is one of the alternative sanctions developed in the Indonesian criminal law system as an effort to reduce dependence on imprisonment, especially in addressing the problem of prison overcrowding. This study aims to examine the role of supervisory punishment as an alternative sanction and to assess its effectiveness in achieving the objectives of criminal sanctions, which include aspects of prevention, rehabilitation, and community protection. The method used is normative legal research with statutory and conceptual approaches, through a study of Law Number 1 of 2023 concerning the Criminal Code and related legal literature. Research results show that supervisory punishment plays an important role in reducing the number of inmates in correctional institutions, thereby helping to address overcapacity. In addition, this type of punishment provides opportunities for offenders to remain in the community under certain supervision, making the rehabilitation process more effective. From the perspective of the objectives of punishment, supervisory punishment is considered capable of preventing the recurrence of criminal acts, supporting the improvement of offenders' behavior, and still providing protection to society. However, in its implementation, there are still obstacles, including the limitations of supervisory officers, the suboptimal supervision system, and public views that still emphasize imprisonment.
