Abstract

Penelitian dalam tesis ini berjudul “Penerapan Pendaftaran Jaminan Fidusia Secara Elektronik oleh Kreditur Dinjau dari Peraturan Menteri Hukum dan Ham Nomor 9 Tahun 2013” dalam penelitian tesis ini mengkaji tiga rumusan masalah mengenai pendaftaran jamiinan fidusia secara elektronik, faktor apa saja yang menghambat dalam proses pendaftaran jaminan fidusia dan juga mengenai wanprestasi. Metode penelitian yang diterapkan dalam penelitian ini adalah penelitian normative yang mana digunakan dengan mengingat permasalahan yang diteliti yang berkaitan dengan materi yang dikaji berdasarkan peraturan perundang-undangan. Data penelitian ini di kumpulkan dengan cara studi pustaka, serta wawancara. Hasil dari penelitian dari tesis ini adalah bahwa penerapan asas publicitet adalah di wajibkan dikarekan termasuk asas yang wajib untuk di patuhi. Kendala dalam proses pendaftaran jaminan fidusia bukan kendala yang disebabkan oleh Notaris melainkan dari sistemnya yang terkadang error. Cara penyelesaian wanprestasi tidak ada bedanya dengan yang sebelum berlakukan perndaftaran secara elektronik, hanya saja jika jaminan fidusia didaftarkan maka besar untuk memiliki perlindungan hokum. Jika terjadinya wanprestasi maka dapat di selesaikan dengan cara litigasi maupun non-litigasi.

Abstract

Children must be protected from all forms of cruelty and oppression, in any form, even though there are already a set of regulations that protect children from the dangers of economic exploitation, and the problem of economic exploitation of children from year to year experiences very complex developments, so that child exploitation increases every year. annually indicates that there are significant obstacles that occur at the level of implementation. The discussion in this study is to analyze the factors that cause economic exploitation accompanied by violence against children, and criminal law policies in tackling child exploitation and as well as legal protection for child victims of economic exploitation accompanied by violence. This type of research is normative legal research. Based on the results of this study, it is concluded that the background that makes children victims of trafficking in persons is due to the motive of poverty, and difficulty finding work,  education, law enforcement against perpetrators of child exploitation crimes must be implemented strictly and indiscriminately, by implementing statutory regulations - promulgation along with the application of serious criminal threats is one step to be able to provide a deterrent effect for the perpetrators

Abstract

Intellectual property protection contributes significantly to national and international economic development. Indonesia as a developing country must be able to take appropriate steps to anticipate all changes and developments as well as global trends so that national goals can be achieved. Protection for communal intellectual property is one way to reduce the practice of biopiracy, while ensuring fairness and equal treatment between owners and users of communal intellectual property. There are at least three important ways that must be considered:  First, documentation of communal intellectual property is carried out through database development; Second, there is an obligation to fulfill the requirements for Communal intellectual property for which legal protection will be applied for, whether it has been in force or has been determined. Third, the owners of intellectual property rights, must show proof of approval for the use, distribution of ownership, or profit sharing from the owner of the communal intellectual property.

Abstract

Penelitian ini membahas regulasi dan penegakan hukum dalam Pemilihan Kepala Daerah (Pilkada) Kota Subulussalam dalam konteks keberlakuan berbagai peraturan perundang-undangan, yakni Undang-Undang Nomor 1 Tahun 2015, Undang-Undang Nomor 8 Tahun 2015, Undang-Undang Nomor 10 Tahun 2016, serta Qanun Aceh Nomor 12 Tahun 2016 tentang Pemilihan Gubernur, Bupati, dan Walikota beserta wakilnya. Permasalahan muncul ketika Komisi Independen Pemilihan (KIP) Subulussalam menggugurkan pasangan calon Affan Alfian Bintang–Irwan Faisal karena dinilai tidak memenuhi syarat sebagai “orang Aceh” sebagaimana diatur dalam Pasal 24 Qanun Aceh Nomor 12 Tahun 2016 dan Pasal 211 ayat (1) Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh. Namun, ketentuan tersebut menimbulkan ketidakpastian hukum karena tidak terdapat mekanisme pembuktian atau lembaga yang berwenang menentukan status “orang Aceh”. Kasus ini menggambarkan lemahnya implementasi norma hukum daerah yang berpotensi menimbulkan konflik hukum dalam pelaksanaan Pilkada di Aceh, khususnya terkait asas kepastian hukum dan keadilan dalam proses demokrasi lokal.

Abstract

Procurement of government goods and services is one of the activities that is very prone to corruption, collusion, and nepotism (KKN). In addition to carrying out law enforcement, to overcome KKN in the procurement of goods and services, various supporting policies are established that are enforcement and prevention. The research conducted is normative juridical or research that analyzes written law, jurisprudence, and norms that live in society. The descriptive-analytical approach aims to take systematic, factual, and accurate data on a problem based on applicable laws and legal norms. The results of this study show that Good Governance can anticipate state financial losses in the Government BJP through the implementation of the principles of participation, rule of law, transparency, effectiveness and efficiency, and accountability. The forms of policies in the procurement of fair goods and services are the establishment of integrity pacts by both relevant agencies and PJB participants, the E-procurement System, the procurement of goods and services through electronic tenders that are spared, and a comprehensive audit system to find indications of violations.Keywords: Good Governance, Goods and Services, State Finance, E-Governance, E-Procurement.

Abstract

Positive impacts of national development progress include the growth and development of economic activity centers, resulting in the establishment of new industrial centers and providing employment opportunities for the community. The legal framework for employment relations between outsourced workers and parties in the labor sector is regulated by Pancasila Industrial Relations (hereinafter abbreviated as HIP). HIP is an industrial relationship based on the manifestation of all the principles of Pancasila and the 1945 Constitution (hereinafter abbreviated as UUD 1945), and develops in accordance with the character of the Indonesian nation. Meanwhile, industrial relations refers to all types of employment relationships between employers and employees, both at the regional and national company levels, relating to socio-economic matters such as wages, working hours, working conditions, employment relations, and so on. Employment relations serve as a basis for parties to protect their respective interests and avoid discriminatory practices and human rights violations during the organizational process to achieve company goals. Outsourced labor practices related to employment relations are frequently discussed and debated among various groups. This is directly related to companies' efforts to reduce costs related to human resource utilization and their responsibility to provide legal protection for workers in the employment relationship. The employment relationship between workers and companies in outsourcing practices must reflect legal protection for workers, as stated in the Preamble to the 1945 Constitution: to protect the entire Indonesian nation and its entire homeland and to advance general welfare based on Pancasila to achieve social justice for all Indonesians. Although outsourcing is limited to specific fields, it is widespread in companies' core businesses. Therefore, the government's role is crucial in ensuring that workers' rights within an employment relationship are fulfilled in accordance with applicable laws.

Abstract

The communal culture of traditional societies fundamentally contrasts with the individualistic framework of intellectual property rights (IPR). Indigenous communities prioritize collective interests without negating individual rights. This study aims to examine and analyze the optimization of traditional knowledge protection as an effort to improve the welfare of communal societies. The research employs a normative juridical method by reviewing statutory regulations and related legal instruments. The findings reveal that communal intellectual property is recognized under both international and national legal frameworks. National regulations require each region to conduct an inventory of community intellectual property; however, public awareness of its importance remains limited. Therefore, renewed strategies are needed to ensure that communities fully understand the economic, social, and cultural value of their traditional knowledge. Local governments play a crucial role in disseminating information and implementing inventory programs through regional regulations. Furthermore, the development of traditional knowledge–based products can be advanced to the industrialization stage through Micro, Small, and Medium Enterprises (MSMEs), thereby supporting the welfare of indigenous peoples. The ideal model of local government intellectual property protection is to guarantee community ownership rights while ensuring a fair profit-sharing mechanism with third parties.
